Patna: BSSC job aspirants lathi-charged by police for protesting against exam paper leak

On Wednesday, 4th January 2023, the Bihar police lathi-charged the young aspirants of the Bihar Staff Selection Commission exam protesting n Patna against the state government over the paper leak scandal. Due to accusations of question paper leaks on social media channels, the first sitting of the BSSC third graduate level joint preliminary test was cancelled, triggering student protests.

Students have been asking for the cancellation of all assessment phases, citing potential risks to their future.

At 11:15 am, candidates aspiring for the BSSC began to march from Patna College to Dakbunglow Road. Several candidates were hurt during the lathi-charge, and the Bihar Police also detained a number of candidates.

The students, who took to the streets, accused the Nitish Kumar government of playing with the future of the students. Anti-government slogans were raised.

MS Khan, the special executive magistrate, Patna, said, “They started violence and vandalism, and to control it, (lathi-charge) was done. Some have been arrested. FIR will be registered against them.”

Following the submission of a report by the Bihar Police’s Economic Offenses Unit (EOU) on the question paper leak, the state commission decided to cancel the first round of the recruitment exam that was scheduled to take place in the last week of December 2022. The exam was meant to fill 2,187 openings in the Bihar government. Before the first test session, the question paper purportedly appeared on social media, and pictures of it quickly went viral.

An examinee was already arrested by officials following the scandal. Nitish Kumar, the chief minister of Bihar, said previously that the probe is being done properly in the case.

CISF denies claims of Musician Krishani Gadhvi that she was humiliated during security check at Bengaluru Airport, contemplates legal action

Krishani Gadhvi, a woman musician, alleged on 3rd January 2023 that she was asked to remove her shirt during a security check at the Bengaluru airport. Krishani Gadhvi, a young musician, described the experience as “really humiliating”. After her allegations made the headlines, Bengaluru airport authorities had expressed regret, but now it has emerged that the allegations she made are false and baseless. Denying the charges, CISF is now contemplating taking legal action against Gadhvi. The woman was flying to Ahmedabad from Bengaluru on an IndiGo flight.

Krishani Gadhvi made the allegation in a post from her Twitter account on January 3rd, but now the account has been deactivated. She tweeted tagging the Bengaluru Airport authorities, “I was asked to remove my shirt at Bengaluru airport during security check. It was really humiliating to stand there at the security checkpoint wearing just a camisole and getting the kind of attention you’d never want as a woman. @BLRAirport Why would you need a woman to strip?” She shared the tweet on 3rd January 2023 in the evening.

Copy of Krishani Gadhvi’s tweet

However, now it has been revealed that the allegations are false, and Bengaluru CISF has said that she levelled the false charge because she was asked to remove her jacket during the security check as per rules.

According to a thread of tweets by Times of India journalist Petlee Peter, the claim of Krishani Gadhvi that she was asked to remove her shirt and made to stand in her undergarments is false. CISF sources at the airport reportedly said that the woman was wearing a denim jacket with badges and readings, which was asked to be removed by the female CISF staff. It is notable that as per rules, jackets are required to be scanned at airports, and therefore they are needed to be removed during security checks and put into the handbag scanner.

Accordingly, her denim jacket was removed and put into the scanner by her friend, while she was frisked behind curtains. CISF sources added that the female staff who had frisked Krishani Gadhvi had asked her to remain behind the curtains while her jacket is brought back, but she said that she is comfortable stepping out. Apparently, she was not happy that she was asked to remove her jacket, and that’s why she posted the false allegation on Twitter. But realising that her lie would not sustain as every inch of an airport is under CCTV surveillance, she later removed the tweet and then deactivated her Twitter account.

Reportedly Bengaluru CISF is contemplating legal action against the woman passenger for levelling false allegations against the Central Armed Police Force. It is notable that CISF is responsible for most airports in the country, including the pre-boarding security checks.

After the tweet by Krishani Gadhvi which she removed on 4th January 2023 before deactivating her account, the Bengaluru airport’s official Twitter handle responded to her expressing regret. It said, “We deeply regret the hassle caused and this should not have happened. We have highlighted this to our operations team and also escalated it to the security team managed by CISF (Central Industrial Security force) a Government sovereign.”

However, later the tweet by Bengaluru Airport was deleted after it was revealed that the allegations are false and baseless.

Jharkhand: Khaleel Miya arrested for force-feeding beef to tribals in Hazaribagh

In Jharkhand, a case of force-feeding of beef (cow meat) has come to the fore. The incident transpired in the Bariyath Birhor Tola in the Barhi block of the Hazaribagh district wherein people of the tribal community were forced to eat beef. An FIR has been lodged by one Manoj Birhor at Barhi Police Station.

According to the FIR, on Friday, December 30, accused Khaleel Miya, a resident of Dulmaha village, reached Barhi. The accused told the locals that he will be hosting a new year party. Subsequently, Khaleel Miya offered food and liquor to several people who attended his party. However, upon noticing pieces of meat in the food, people protested against Khaleel, who in turn compelled them to eat beef by brandishing sharp weapons.

In his complaint, Manoj Birhor alleged that accused Khaleel Miya brought a cow that was tied at Rajesh Birhor’s residence.

Barhi Police Station informed OpIndia that three days after the incident took place, Manoj Birhor reached the police station on January 2 and filed a complaint against Khaleel Miya. Acting upon Birhor’s complaint, police reached the village and began the investigation. During the investigation, police recovered some quantity of cow meat, bones, and skin at Rajesh Birhor’s residence. Following this, accused Khaleel Miya was arrested. As per local media reports, Khaleel Miya force-fed cow meat to around 50 people and also attempted to convert them to Islam.

Another incident of force-feeding beef reported in Jharkhand

Notably, a similar incident has been reported in the Radhanagar Police Station area in the Sahibganj district of Jharkhand. On December 31st, 2022, a man named Chandan Ravidas was forced to consume beef. The victim claimed in his FIR that the accused Mithun Sheikh, Naseem Sheikh, and 5 others assaulted him and forced him to eat beef following a minor argument.

In his complaint, Ravidas stated that the incident took place when he stepped out to celebrate new year’s eve. Chandan had gone to a shop at Pakinja Mor, which falls under the jurisdiction of Radhanagar police station, on Saturday night. When he went behind the shop to pee, he found 5 people drinking and consuming cow meat. This led to a heated argument between the victim and the accused, following which they forced him to consume alcohol and eat beef. Chandan managed to escape but was later chased down by the accused men. He was then stripped naked and thrashed brutally.

In another incident on Tuesday, January 3, some unidentified persons threw pieces of meat in the compound of a Kali temple in the Dhaka village of Shikaripada block in Jharkhand’s Duma district. Along with the meat pieces, the police also recovered pamphlets with the name and the mobile number of Khalila, the deputy head of Shivtalla Panchayat, scribbled on them.

Reacting to the back-to-back incidents of force-feeding cow meat to non-Muslims, Bhartiya Janata Party (BJP) leader and former Chief Minister of Jharkhand, Babulal Marandi took to Twitter to raise the matter and warn the CM Hemant Soren-led government against its “appeasement politics meant to destroy tribal community.”

“First in Sahibganj and now in Hazaribagh, a tribal youth was thrashed for refusing to eat beef. Who were the ones who beat them? This politics of appeasement which destroys the tribal society will have dire consequences, keep it in writing @HemantSorenJMM Ji,” Marandi’s tweet written in Hindi read.

Other than Babulal Marandi, BJP’s State President Deepak Prakash also accused the Hemant Soren government of doing appeasement politics and demanded strict action against the culprits.

“Such incidents were carried out as part of a well-thought-out conspiracy, but does it matter to the Chief Minister, who endorses appeasement politics? There is no adequate condemnation for the Hazaribagh incident, and such people must face harsh punishment,” BJP State President’s tweeted in Hindi.

Angry Chinese overturn police car over fireworks ban, here is what we know

Protests have been happening in China against the firecrackers ban across cities. Videos have emerged on social media platforms where the protesters overturned a police vehicle on January 2. The residents defied the orders at many locations and set off fireworks to celebrate New Year’s Eve.

As per social media posts, the police said protesters “deliberately vandalized a police car … causing chaos at the scene”. The incident occurred around 11 PM (local time) on January 2. The police arrested six people. In the videos, people were seen jumping on the police car. Another man in a black jacket was seen holding the license plate of the police car that was ripped off from the vehicle.

The incident reportedly occurred after the police tried to impose the firecrackers ban. Soon after, the crowd blocked the pathway and did not let the police car leave. They threw drinks and smashed the car. Later, the car was overturned by the protesters.

Reports suggest that the ban will continue until the Lunar New Year, starting later this month. However, people continued to burst crackers to defy the ban on New Year’s Eve. Deliberate setting off of fireworks was reported in multiple cities, including Guangxi, Shandong and Chongqing. Political commentator Wang Jian in a statement, said that though the ban has been imposed across the country, people are defying it everywhere.

This is the second time China has seen widespread protests in three months. In November this year, people in China took to the streets to protest against China’s Zero-Covid policy, resulting in multiple strict lockdowns in several cities. They held blank white printing papers, and it was popularised as the “White Paper” campaign. They also demanded the Chinese President Xi Jinping and the ruling Communist Party step down and called for elections.

The firecrackers ban in China

China pats its back for the invention of firecrackers along with gunpowder. However, over time, firecrackers have been propagated as one of the major sources of pollution in the country. Firecrackers were banned in Beijing for the first time in 1993 after reportedly 544 people were injured in firecrackers-related incidents. Over 200 letters were sent to the government demanding a ban on firecrackers.

As the ban was not practical and people defied it every now and then, the government proposed changing the law and allowing some relaxation. In 2005, the government lifted the complete ban and allowed people to burst crackers around Lunar New Year. In 2012, when the air quality declined in Chinese cities, the ban was reinforced.

Chinese firecrackers problem in India

Chinese firecrackers are known for having inadequate quality control and are often considered more polluting than Indian firecrackers. Low prices and easy availability of Chinese firecrackers had caused the Indian local market of fireworks to collapse in India. The Directorate of Revenue Intelligence has notified various government departments on several occasions about the illegally imported fireworks from China. As per government guidelines, importing fireworks from foreign countries is banned in India. A 2016 notification clearly mentioned that India has never provided any license to import fireworks into the country. However, the rampant availability of low-quality Chinese cheap fireworks has caused not only environmental problems in the country but also resulted in unemployment at large scale in the fireworks industry.

Passenger who urinated on an elderly woman inside an Air India flight gets banned for 30 days by airline, DGCA action awaited

Air India airlines on Wednesday banned for 30 days the man who allegedly peed at an elderly woman travelling in business class and exposed his private parts to her on a flight from New York to Delhi in November 2022.

The airlines, in an official statement, said that they have taken very serious note of the incident that has caused extreme distress to a passenger.

“Air India has taken a very serious note of the incident, where a passenger behaved in an unacceptable and undignified manner on the New York-Delhi flight that caused extreme distress to a fellow passenger. A police complaint has already been lodged in this case and Air India is committed to assisting the law enforcement agencies as well as regulatory authorities to ensure that justice is delivered to the aggrieved passenger,” the Air India spokesperson said adding that they have reported the matter to the Directorate General of Civil Aviation (DGCA) for further action.

As a first step, Air India has banned the passenger for 30 days, the maximum it is permitted to unilaterally do so, it said further.

“We have also constituted an internal committee to probe lapses on the part of Air India’s crew and address the deficiencies that delayed quick redressal of the situation. We are also in regular contact with the aggrieved passenger and her family during the investigation and reporting process,” he added.

Meanwhile, the Delhi Police has also registered the FIR under sections 354, 509, 510 of the Indian Penal Code and 23 of the Indian Aircraft Act, against the man, who, in an inebriated state onboard an Air India US flight urinated on a woman co-passenger, a senior citizen, seated in the business class seat.

The police said that the incident occurred on November 26 and the concerned airline (Air India) approached the police after a month and two days, i.e., on December 28.

Air India has lodged a police complaint regarding the incident that took place on November 26 when the flight was on its way from John F Kennedy international airport in New York to Delhi.

In her letter to the Chairman of the Board of Tata and Sons, N Chandrasekaran, the victim woman passenger called the flight experience extremely traumatic and expressed deep disappointment over the incident that took place in the business class section of the flight.

In her letter, the woman said that the appalling incident occurred shortly after the lunch was served and the lights were switched off, as she was getting ready to sleep. Within minutes, an inebriated male walked to her seat and unzipped his pants, relieved himself, and continued to expose his private parts until another passenger asked him to return to his seat.

“I am writing to express my deep disappointment regarding the appalling incident that occurred during my business class trip on flight AI102 (commencing in NY, JFK yesterday 26th November at 12.30 pm, and arriving this afternoon in New Delhi Indira Gandhi International Airport at approximately 1.30 pm). This has been the most traumatic flight that I have ever experienced. During the course of the flight, shortly after lunch was served and the lights were switched off, I was getting ready to sleep, and another passenger walked to my seat completely inebriated. He unzipped his pants, relieved himself, and continued to expose me to his private parts. The passenger sitting next to me asked him to return to his seat. He did not respond immediately, but after a few moments left the area,” the letter read.

Experts put Mamaearth valuation at 1,666 times its annual profits, Twitter debates whether it’s overvalued

On December 29, popular brand Mamaearth’s owner Honasa Consumer filed its Draft Red Herring Prospectus (DRHP) with market regulator Securities and Exchange Board of India (SEBI) to raise around ₹2,900 crore through an initial public offering (IPO).

In its Draft Red Herring Prospectus, Mamaearth said it is planning to raise as much as Rs 2,400 crore through its IPO. It expects to raise about Rs 400 crores through a fresh issue of shares and the rest through an Offer For Sale (OFS) of about 4.7 crore shares.

Honasa Consumer, the parent company of Mamaearth, said it plans to use the proceeds of the IPO towards advertising expenses to improve awareness and visibility of the brands, for coming up with new salons via its subsidiary BBlunt, inorganic acquisitions, and setting up new exclusive brand outlets.

Founded in 2016, Honasa Consumer currently operates of group of brands under its umbrella, with Mamaearth being its flagship brand and the fastest growing beauty and personal care brand in India to reach an annual revenue of Rs 10 billion (in the preceding 12 months) within six years of launch. In January 2022, it became a unicorn with a valuation of $1.2 billion.

At the end of FY22, Mamaearth posted a net profit of Rs 14.4 crores and the revenues of Rs 943 crores. With speculations abound that the organisation is looking at $3 billion market capitalisation (Rs 24,000 crores), the organisation’s price-to-earnings ratio would be about 1,666x, raising caution among investors and market experts, who assert that the valuation of the brand is exorbitant.

Twitter users slam Mamaearth IPO, raise question over company’s valuations and ad spend

Several social media users raised the alarm over Mamaearth IPO and exercised retail investors to exercise caution over applying for the Initial Public Offering in an already volatile market, especially after their unpleasant experience with Zomato and PayTM shares, which have had similar over-valuation concerns.

Many on Twitter said they would steer clear of the Mamaearth IPO over its sky-high valuation. The loss of ₹1,332 crore in FY21 and ₹428 crore in FY20, as per company’s DRHP, have also added to the anxiety among the investors.

A Twitter user asked his followers to not invest in Mamaearth IPO, describing its Initial Public Offering as a pump and dump scheme.

Several others also pointed out another metric, the company’s Return On Advertising Spend (ROAS), that they claimed had massively influenced their decision on Mamaearth IPO. ROAS is a metric that measures the amount of revenue earned for every rupee spent on advertising.

The company had spent Rs 391 crores in advertising, a staggering 40 per cent of its net sales of Rs 932 crores. The metric was similar for FY21, when it spent Rs 178 crores on ads against a net sales of Rs 460 crores, and in FY20, when it splurged Rs 46 crores compared to net sales of Rs 110 crores.

The company’s ROAS has hovered around 2.6 in the past three years. The more an organisation has a repeat customer, the less it has to spend on advertising its products. The fact that ROAS has remained close to 2.6 means the company has less repeat customers, market analysts claim.

By contrast, HUL has ROAS of 10.6 while Nykaa’s FY22 ROAS stood at 7.8.

Some social media users call outrage over Mamaearth IPO premature and baseless

However, many other Twitter users and market analysts dismissed the social media outrage on IPO valuation of Mamaearth as overreaction and baseless.

Mangalam Maloo, Assistant Editor at business news channel CNBC TV18, said he could not understand the outrage surrounding the Mamaearth IPO. “The DRHP doesn’t speak of valuations, there’s no official info on the price they’re seeking. The IPO hasn’t even opened, nor do we know the issue dates,” tweeted Maloo, advising to wait and analyse in entirety before taking a decision.

Another Twitter user, Ashish Mishra, seemed bemused with the valuation of Rs 24,000 crores being thrown around. “Sorry late to it but where is it from that Mamaearth is seeking 24000 crore valuation?” Mishra tweeted.

A market analyst, declining to identify himself, said Mamaearth has a positive outlook in a field where companies take years to enter profitability. Against this background, the organisation’s profitability in FY22 is commendable, he added.

“The IPO is scheduled to be released somewhere in mid-2023. The document shared by the organisation is a draft prospectus. The price will be revealed once it releases its offer document. Let the company share the details of its financials before being targeted for its valuations through the Initial Public Offering. Once everything is in the public domain and the company’s expectations from the IPO, one can form an informed opinion on whether it is worth investing or not,” he added.

The company’s revenues are close to touching the Rs 1,000 crores mark, and its total income rose 101% to INR 952.4 Cr in FY22 from INR 472.1 Cr in the previous financial year. The startup, which has the backing of Tiger Global, had its revenue from operations soar 2X to INR 931.7 Cr from INR 459.9 Cr in FY21.

‘Main Pradhan Mantri Hun’: Viral video shows Gurugram woman misbehaving with cops, here is what we know

A video, allegedly from a shop in Gurugram of Haryana went viral on 2nd January 2023 in which a woman is seen misbehaving with Haryana police. The woman in the video is identified as so-called fashion journalist Aanchal Sukhija Khan who had participated in the anti-CAA protests in Delhi three years ago.

The video was shared by many accounts including Deepika Bhardwaj and @gharkekalesh.

In this video, it is seen that Haryana police approached the woman who was apparently sitting in what looked like a book cafe. The police team had apparently reached there to arrest the woman. According to reports, the incident occurred because the woman made a ruckus as she was allegedly charged Rs 14000 by a barber’s shop in Gurugram.

Throughout the video, it is seen that the woman is not at all listening to the policemen and seems violent. In this video, she is also heard calling a lady police officer “you bloody woman, shut the f*ck up”. She also flaunted saying that she will call someone for support. She even challenged the police officials to bring anyone they want from their side and claimed she is the Prime Minister.

Throughout the video, the woman journalist was seen threatening, scolding and behaving very rudely with the police officials.

She told her name twice aloud – “Aanchal Sukhija Khan”. In the end, the police team forcibly took her away.

A little more research showed that Aanchal Sukhija Khan is a so-called fashion journalist. She also participated in the anti-CAA protests in 2020. Her images holding the placards in these protests are also going viral on social media.

Twitter users also commented that Aanchal Sukhija Khan has studied at Jamia Millia Islamia university and that she is a repetitive offender of this particular kind. She lives in Gurugram and is said to have made a ruckus and indulged in similar behaviour over clearing dues in other shops in the area too.

Supreme Court refuses to hear Azam Khan’s plea to transfer the cases against him out of Uttar Pradesh

The Supreme Court of India has rejected to hear a plea by Samajwadi Party leader Azam Khan in which he had requested to transfer the cases against him out of Uttar Pradesh. The apex court ruled this on 4th January 2022. A bench of Chief Justice DY Chandrachud, Justice P S Narasimha, and Justice SA Nazeer also instructed him to go to the Allahabad High Court situated in Prayagraj, Uttar Pradesh.

Samajwadi Party leader Azam Khan had filed a petition and appealed to the Supreme Court that some cases registered against him in UP should be transferred to other states. The court rejected his demand and asked him to go to the High Court with the plea, and directed that his petition can be heard soon by the high court.

Advocate Kapil Sibbal appeared in the Supreme Court on behalf of the SP leader. In his petition, Azam Khan said, “I will not get justice in the state. I am being forcibly persecuted. It is not a judge, but the state who is persecuting me. The situation will remain the same everywhere within a state.”

As an example of the alleged bias of the state govt against Khan, Sibal said that he was convicted in a case when his Section 482 petition seeking production of additional evidence was pending in the High Court. Due to this conviction, his membership in the assembly has been cancelled.

Kapil Sibal also alleged that Azam Khan is being ‘harassed’ by the BJP government with hundreds of FIRs registered against him in Uttar Pradesh. He claimed that police were using forged documents against him and the trial court is not hearing to his objections.

However, the Supreme Court bench was not convinced to take up the petition for transferring the cases out of Uttar Pradesh. The bench said that if Azam Khan has any grievances against the trial court, he can move next superior court. The court also said that even if the court order is wrong, it can’t be the basis for alleging bias and transferring the case to a different state.

The bench led by the CJI said, “More concrete reasons will be needed to transfer criminal cases against Azam Khan.”

CJI Chandrachud added, “you can approach the Allahabad High Court under Section 482 of the CrPC. Today trial is being conducted and witness statements are being recorded. This is not a ground for transfer. Can you not challenge this order before the High Court? You can always ask for a transfer before any other district of the State of UP. But you’re saying that they won’t hear your plea anywhere in the State! Sorry we can’t transfer.”

However, Kapil Sibal said that transferring the case to a different district in the state will not be helpful for Azam Khan, and urged the court to hear the matter. But the apex court didn’t relent, saying, “When we transfer, we need a far more cogent reasons for transfer. We are giving you liberty to approach the High Court but we can’t transfer.”

It is notable that Azam Khan has several criminal cases registered against him in Uttar Pradesh and recently his assembly membership was also cancelled after being found guilty in one case. The Rampur constituency in Uttar Pradesh has been a stronghold of Azam Khan for many years. Akash Saxena of the Bharatiya Janata Party won the seat in the by-election held in December 2022.

17 locations raided in West Bengal by NIA for anti-Hindu violence in October 2022

The National Investigation Agency on Wednesday carried out searches at 17 locations in West Bengal in connection with the Ekbalpore-Mominpur clashes that occurred in the state on October 9 last year, sources said.

The raids are being conducted at the house and office premises of the suspects, an official source privy to the development told ANI. Taking into cognizance the allegations of vandalism and damage of property during the clashes, the NIA re-registered the case in October last year and initiated a probe into the anti-Hindu violence in Mominpur in West Bengal. Earlier, Kolkata police filed a First Information Report (FIR) in the case on October 10.

The anti-terror agency’s move comes after the Counter Terrorism and Counter Radicalisation (CTCR) division of the Ministry of Home Affairs (MHA) directed it to register an FIR and start a thorough probe considering the gravity of the case.

MHA’s order followed the direction of the Calcutta High Court in October while hearing a writ petition relating to the Ekbalpore-Mominpur communal violence. The Court ordered the state police to form a Special Investigation Team (SIT) comprising experienced police officials to probe into the incident.

The petitioners had approached the Court alleging that the State Police administration remained silent spectators to the communal violence that erupted in the Ekbalpore-Mominpur area of Kolkata on the eve of Laxmi Puja.

Accordingly, the petitioners prayed for the deployment of the Central Para Military Forces for maintaining peace in the aftermath of the violence, and for the transfer of the investigation of the crimes to the NIA, alleging the inefficiency of the State Police to investigate the matter in a fair manner.

The Court looked at preliminary reports filed before it and noted that five criminal cases had already been registered over the incident under the Explosive Substances Act, 1908 and the Arms Act, 1959, the investigation of which cases was in progress.
A clash between two communities at Mominpur in Kolkata led to communal tension and many houses in the Mayurbhanj area were ransacked and cars destroyed late on October 9.

Ex-Uttarakhand CM and Congress leader Harish Rawat sits on ‘hour long fast’ to support Haldwani encroachers

Former Chief Minister and senior Congress leader Harish Rawat sat on an hour-long silent fast at his residence in Dehradun in support of the people of Banbhulpura of Haldwani.

Stating that the matter was in front of the Honourable Supreme Court, he said, “We are praying to god for justice. We are hoping that nothing happens to the homes of people.” Harish Rawat further said that through the silent fast, he urges the Chief Minister of the state to intervene.

“The Chief Minister is the guardian of the state. My silent fast for an hour is dedicated to the Chief Minister,” he said.

Terming Uttarakhand to be a spiritual state, he said, “If 50,000-55,000 people which include children, pregnant women, old men and women are forced to vacate their homes and come out on roads, then it would be a very sad sight.”

While talking to ANI, on Rahul Gandhi’s ‘Bharat Jodo Yatra’, he said, “Rahul Gandhi is working very hard. In the biting cold, he is out with lakhs of supporters on the roads. He is spreading the message of love and peace. I salute his efforts.”

In Haldwani, a large number of people are protesting on the streets after the order of the High Court to remove the encroachment from the railway land.
