Supreme Court likely to hear Suvendu Adhikari’s petition to transfer Mamata Banerjee’s election result plea outside Bengal

0

The Supreme Court is expected to hear a petition filed by Bengal BJP leader Suvendu Adhikari on November 15 in the matter related to his demand for the transfer of the petition of Mamata Banerjee from Calcutta High Court to any High Court outsides of Bengal.

Fearing a fair hearing may not be possible in Calcutta High Court, Adhikari had moved a petition before Supreme Court on July 14 to transfer the case. His petition is expected to be taken up as the Supreme Court has told his lawyer that it has asked the SC registry not to remove his petition from the cause list for November 15.

TMC leader and West Bengal CM Mamata Banerjee had moved a petition at Calcutta High Court challenging her defeat at Nandigram assembly seat against Suvendu Adhikari with a thin margin. Hearing of her petition at Calcutta High Court had many twists, including Justice Kausik Chanda of Calcutta High Court recusing himself from hearing.

In his petition, Adhikari had alleged that right after the result of the Nandigram seat was announced, Mamata Banerjee started making baseless objections and allegations against the election. Adhikari said that she directed her supporters, party members and high-ranking officer bearers of the newly constituted West Bengal Government to start a scurrilous campaign to cast doubts and aspersions upon his fair and square victory from Nandigram seat.

He said that Mamata Banerjee in absolute violation of the spirit of democracy refused to accept the result. Adhikari charged Bengal chief minister for “misusing her office to interrupt and/or interfere with the functioning of constitutional bodies.” He said that as a petitioner he has apprehensions about a fair trial.

Giving grounds in support of his petition he said that potential witnesses in the election petition, who may provide crucial evidence and may possibly depose against Mamata Banerjee, may be threatened.  He said that it was not unprecedented for her to unduly influence the case in her capacity as the sitting chief minister of West Bengal.

Adhikari feared documentary evidence required for a fair trial in the election petition may be tampered with, suppressed, or concealed by her by using the state machinery. Adhikari mentioned instances of alleged lawlessness and insinuation by her. He referred to the instance of her biased views against Justice Kaushik Chanda and how TMC leaders Derek O’Brien and Mahua Moitra had cast aspersion on the Justice a BJP loyalist.

He referred to the case of her leading TMC workers in a protest at the CBI office in Calcutta following the arrest of some TMC leaders and ministers in the Narada scam case. “This is yet another stark example of Banerjee misusing her political clout and position to hold at ransom independent bodies like CBI,” he said.

26 Maoists killed in encounter with elite C-60 commando force in Gadchiroli in Maharashtra, 3 jawans injured

As many as 26 bodies of Naxals of CPI (Maoist) have been recovered from the forest area of Gadchiroli in Maharashtra following an encounter of C-60 elite force of Maharashtra police with Naxals on Sunday.

“We have recovered the bodies of 26 Naxals so far from the forest,” said district Superintendent of Gadchiroli Ankit Goyal. The official said that the police commando team was conducting a search operation led by additional SP Soumya Munde. According to media reports, three security personnel who were seriously injured were airlifted to Nagpur for treatment.

The encounter is learnt to have taken place in the forest area of Mardintola in Gyarahbatti. The spot is around 250 kilometres from Nagpur, and near the Chhattisgarh border. The elite force had launched an anti-Naxal operation following the specific intelligence inputs about the movement of armed Naxals from forests of Chhattisgarh into Gadchiroli.

According to reports, the incident occurred when jawans of the C-60 force, the elite anti-Maoist squad of the district, were patrolling the area and the Maoist extremists who were hiding in the jungle fired on the jawans. After that, the jawans retaliated immediately. The encounter began in the Kotgul-Gyarapatti forest in the early hours of Saturday and lasted till late in the evening.

A senior CRPF official who had earlier served in Gadchiroli told OpIndia that they had information that the C-60 team had moved in the forest area of Gadchiroli early morning.

“The figure of the casualty and injuries of Naxals may be much higher. We have been told that some Naxals were trying to run away along with dead bodies and injured. C-60 was formed in 1990 as a specialized group to eliminate Naxals from Gadchiroli which is the stronghold of Naxals,” the official said.

While the identity of the slain Naxals has yet to be ascertained, some top Maoist leaders are said to be have been eliminated in the encounter. It is also being said that that senior Maoist leader Deepak Teltumbde has been killed in a major operation in Gadchiroli.

Security forces also recovered weapons and other materials from the spot of the encounter, and a massive combing operation was underway to detect more bodies of the extremists. The bodies of the slain extremists will be brought to Gadchiroli for post mortem.

Once a breeding ground of terrorism, new university change face of Azamgarh: Yogi Adityanath after Amit Shah laid foundation stone

As the Union Home Minister Amit Shah laid the foundation stone of a state university in Azamgarh district of Uttar Pradesh, Chief Minister Yogi Adityanath said that the university will change the face of the district from Azamgarh to Aryamgadh.

The proposed university with an estimated cost of Rs 108 Crore will be located on 49.42 acres of land in Azam Bandh area and it is expected to be operational from June 2023. In March 2019, the Yogi Adityanath cabinet had taken the decision to set up a university here. 400 colleges in Mau and Azamgarh district with 2.66 lakh students will be attached to this university.

While the university is a gift to students, both Yogi and Shah believe that the university will revive the old glory of Azamgarh which became infamous due to alleged links with terrorist activities and Islamic fundamentalism.

“There should be no doubt that the university will make Azamgarh a Aryamgarh,” CM Yogi said.

Using this opportunity, Yogi and Shah also blew the poll bugle and hit hard at the former chief minister and Samajwadi Party chief Akhilesh Yadav who represents Azamgarh parliamentary seat. They alleged that the Samajwadi Party, Akhilesh Yadav and his family who ruled Uttar Pradesh can’t be absolved from the responsibility if Azamgarh remained in the news for wrong reasons.

“Remember, this is the same Azamgarh where I was attacked in 2007 when I had come here when ABVP worker Ajit Roy was murdered at Shibli National College because he had demanded recitation of Vande Mataram on occasion the Republic Day. But no FIR was taken at least for a month after his murder. Can anyone dare to play with law and order? They know what happened with Duryodhana and Dushasana,” Yogi said pointing out the rise of radicalism in Azamgarh as well as the overall law and order situation of Uttar Pradesh.

Yogi said that although Azamgarh gave two chief ministers to Uttar Pradesh, they created an identity crisis for Azamgarh. “I ask you whether your MP (Akhilesh Yadav) had come and inquired during Covid 19? Whenever election will approach they will come often to misguide you,” he said.

Amit Shah praises Yogi and proposes to name the university after Maharaja Suheldev

Shah praised the leadership of Yogi in bringing changes in Uttar Pradesh. He said that people should be thankful to Yogi for setting up the temple of Goddess Saraswati (university in Azamgarh which during Samajwadi Party rule had become infamous for Islamic radicalization.

“Azamgarh was the land of Rishi Vashishta and on this land, the university will be built. They had made Azamgarh the centre of anti-national activities here Yogi has set up a university for youths to get educated and contribute to the nation’s building. I want to suggest to CM Yogi Adityanath to name the university being built here after Maharaja Suheldev,” said Shah.

Chinese spy agency actively seeking to undermine Nepal’s relations with other countries, reports Nepalese daily

0

A Chinese intelligence agency is playing an “active role” in destabilising Nepal’s relations with other nations, a Nepalese Daily that reportedly had access to a confidential document prepared by the Nepalese security officials, reported on Saturday.

The report says Beijing has activated its spy network in Nepal to sabotage the Himalayan nation’s relations with other countries, most notably with the United States and is lobbying hard against the Millennium Challenge Corporation (MCC) Compact grant assistance provided by the United States.

Nepal is set to receive a grant of $500 million in aid from the United States under MCC. Though it was signed in September 2017, it is still awaiting parliamentary ratification. The inordinate delay in approval from Nepal’s parliament had recently caused the United States to express its concerns to Kathmandu.

Prime Minister Sher Bahadur Deuba wants the MCC to get through the parliament, but his coalition partner, Pushpa Kamal Dahal, who chairs the Maoist Centre, is the one who is consistently opposing the ratification of the grant, according to news reports.

Besides, the 50-page confidential document prepared by Nepal’s intelligence officials also provides details of Chinese intelligence priorities, objectives, networks, and individuals in Nepal.

Nepal’s security forces assert that the top-most priority of China’s intelligence agency is to get MCC cancelled at any cost.

Chinese national Ning Lin among top on the security authorities’ list for crafting anti-MCC propaganda

According to the Nepalese daily, a Chinese national named Ning Lin features at the top of the security authorities’ list of those involved in crafting anti-MCC propaganda in Nepal.

The report says, Lin, also known as Oscar Ning, a Chinese intelligence agency (MSS) official, carries two passports and is said to have come from the Chinese province of Hubei. Among the 50-page secret report, 5 pages are dedicated to details about Lin alone, which include his activities, connections, contacts, mechanism, names of Nepali leaders and journalists.

US school postpones naming its theatre after actor-comedian Dave Chappelle after protests over his alleged transphobic comments in Netflix show

The Duke Ellington School of the Arts, in Northwest D.C., announced that it will postpone renaming its theatre after comedian-actor Dave Chappelle, one of its best-known alumnus, amidst concerns raised by students over his recent Netflix special.

In a statement released by the school, the institution said it will engage with members who raised concerns about the comedian’s latest Netflix comedy series “The Closer”.

The event, which was originally scheduled to take place on November 23, has now been shifted to April 22, the school said in its statement.

The development took place after Dave’s latest Netflix special, “The Closer”, attracted criticism from several LGBTQ organisations, Netflix employees, and some Duke Ellington students, who were miffed with the actor for his deprecatory remarks against the transgender community.

“Dave is an artist and activist and applauds the school taking time to develop creative and critical thinkers,” Carla Sims, a representative for Chappelle, told the Washington Post on Friday. “He supports the school and any effort to contribute to open conversations vs. cancellations.”

“The Closer – the most watched comedy special in Netflix’s history, which has garnered a 96% audience rating on Rotten Tomatoes – has sparked a national debate around race, gender, sexuality and ‘cancel culture’”, the school said.

“We also believe moving forward with the event, originally scheduled for November 23, 2021, without first addressing questions and concerns from members of the Ellington community, would be a missed opportunity for a teachable moment,” it added.

In an interview, the Duke Ellington School’s principal Sandi Logan said that she had had both formal and informal discussions with the students who took offence over Chappelle’s comments in “The Closer”. The principal further added that she has had a month of weekly meetings with an “advisory committee” of student leaders that includes representatives from the school’s Gender and Sexuality Alliance.

The principal also said that they will keep having discussions with the aggrieved students to understand their stance vis-a-vis Chappelle’s comments in his Netflix special. Logan said it is not their aim to convert their minds but they want time so that students can have a meaningful discussion over the issue.

Duke Ellington School remains one of the few schools where the student body is primarily composed of people of colour. Some students at the School, which has a large population of LGBTQ community, are disappointed with the school for going ahead with renaming the theatre after Chapelle. By announcing postponement to April 2022, the School has made it abundantly clear that they are going to rename the theatre after Chappelle, one of the students who disapproved of the school’s decision lamented.

The School, in its statement, has gone into raptures about the actor. It described Chappelle as its “most distinguished alumni” and “an important thought leader”, adding the comedian has personally donated or raised millions of dollars to address the school’s under-funding.

The decision to rename its theatre after Chappelle was taken last month, hours before “The Closer” dropped on Netflix. The school said Chappelle’s “current and future work and influence would raise the profile of the school, increase opportunities for the entire Ellington community, and provide critical fundraising support for the sustainability of our arts-based curriculum.”

Last month, Netflix Employees had staged a walkout to protest Dave Chappelle’s ‘The Closer’ for allegedly making transphobic comments. While Netflix said that they respect the sentiments of the employees protesting against the show, the company refused to take it down. Netflix CEO Ted Sarandos had cited “creative freedom” as one of the reasons for keeping the show online and said that it is too popular to cancel.

Bihar: Half-burnt body of missing journalist Avinash Jha found under a tree, was trying to bust fake nursing home scam in his district

The body of an independent journalist and Right to Information (RTI) activist Buddhinath Jha alias Avinash Jha, who went missing four days ago, has been found in Madhubani, Bihar. Jha had been reportedly raising the issue of private hospital mafias in his district.

A report by a local Hindi daily newspaper, Frontline24, confirmed that the RTI activist Avinash Jha’s half-burnt body, tied and packed in a sack, was found under a peepal tree in the Uren village near Benipatti-Basaith highway number 52 on the night of Friday, November 12.

Bihar Police sources revealed that the autopsy report of Avinash Jha suggests that he died four days ago. Now, after recovering the dead body of the journalist, the Benipatti police have registered an FIR against unknown people and lodged an investigation into the case. Benipatti SHO Arvind Kumar has confirmed that the police are investigating all possible angles including murder. He assured that the criminals would be identified and put to task soon.

According to Hindi daily Jagran, Avinash Jha, a freelance journalist and an RTI activist by profession, was a resident of Benipatti in Madhubani, Bihar. He had been continuously raising the issue of the private hospital mafia and trying to expose the mafia operating in his district. Jha went missing from his residence in Lohia Chowk, Benipatti at around 9.58 pm on November 9.

Avinash Jha’s brother Chandrashekhar Kumar Jha had approached the police after his family tried to search for him at every possible location but could not trace him. They had found both his mobile phones also switched off. Following this, his brother approached the police alleging that his brother, Buddhinath Jha aka Avinash Jha had been kidnapped.

Alleging a big conspiracy behind his sudden disappearance, Chandrashekhar told the police that his brother had been trying to expose the hospital mafia because of which he was kidnapped. He said that his brother had filed many RTI queries regarding the ongoing fake nursing home scam in his district. He had been, for years, trying to bust the nexus of private hospital operators, staff and authorities scamming the people of the district, due to which he was on the radar.

Chandrashekhar named various hospitals and nursing homes which he alleged were a part of the nexus. The hospitals he named were Maa Janki Sewa Sadan Ambedkar Chowk Benipatti, Shiva Poly Clinic Makiya, Sudama Health Care Dhakjari, Anshu Kasht and Center Dhakjari, Sonali Hospital Benipatti, Aradhana Health and Dental Care Clinic Benipatti, Jai Maa Kali Sewa Sadan Benipatti, RS Memorial Hospital Benipatti, Aljina Health Care Benipatti, Sanvi Hospital Nandibhoji Chowk, Ananya Nursing Home Benipatti and Anurag Health Care Center Benipatti.

Chandrashekhar alleged that since his brother had evidence against the operators of these fake hospitals and nursing homes, a conspiracy was hatched to eliminate him.

Arvind Kejriwal govt shuts schools for a week so that children don’t have to breathe polluted air, govt offices to work from home

After the Supreme Court asked the central and Delhi govt to take emergency measures for controlling pollution in Delhi, the Delhi govt has announced some measures in that direction.

Delhi Chief Minister Arvind Kejriwal announced today evening that the schools in the national capital will be closed for a week from Monday onwards. He said that the schools will be physically closed and classes will continue virtually so that children don’t have to breathe polluted air.

The same approach also has been taken for government offices, and they will operate from home at 100% capacity for a week. The government will issue an advisory to private offices also to switch to Work From Home (WFH) mode as much as possible. It is notable that during the Covid-19 lockdown, most private companies were using the WFH model, and now they will have to do that for pollution.

Along with that, the CM said that construction activities will not be allowed from November 14 to 17, to reduce the dust produced by construction activities.

Talking about the suggestion by Supreme Court to impose a complete lockdown for 2-3 days, Arvind Kejriwal said that they are drafting a proposal for the same to be submitted to the apex court. He said that it will be an extreme step, and said they are not implementing the same now. But the government is preparing a proposal for the same, in case it is needed if the pollution situation worsens.

The CM said that the proposal will be prepared after discussion with all agencies, and taking the central govt, CPCB, SAFAR into confidence. If such a situation emerges, all private vehicles, transport, construction and industrial activities could be stopped.

Hearing a petition on worsening air quality in Delhi, the Supreme Court of India had asked the authorities earlier today to take immediate steps to improve the situation. Saying that the air quality in the National Capital had deteriorated to an extent that people are now wearing masks at home, the court had asked the govt to impose a complete lockdown for 2-3 days if needed.

However, the court refused to blame the stubble burning by farmers for the pollution, saying it has become a fashion to blame farmers. The court instead blamed Diwali crackers for the same, even though the air quality in Delhi had started to deteriorate weeks before Diwali.

After social welfare dept withdrew notice to Kashmiri Pandit employees for absence, fresh notices issued to employees of other offices

Three days after the Anantnag office of the Social Welfare Department in Jammu and Kashmir withdrew a ‘unauthorisedly’ issued notice to 26 Kashmiri Pandit employees for their absence from duties, fresh notices have been issued to a number of other Kashmiri Pandit employees from their respective government departments, threatening them to either join work or face consequences, reports Times Now. A large number of Kashmiri Hindus have fled the valley after targeted attacks on minorities including Kashmiri Hindus by terrorists started a few weeks ago.

The media network shared a letter dated November 11, 2021, addressed to the employees by the Office of the Assistant Executive Officer, Mohura district, wherein it asked its employees to resume office in 2 days, failing which the department said that their salary from the month of November 2021 would be withheld in addition to action under CSR rule.

One government official alleged that for the past ten years, Kashmiri Pandits had been applying for jobs but they never join after acquiring it. He claimed that these Kashmiri Pandits are neither joining work nor quitting it. By doing this, they are also denying opportunities to other deserving candidates. In response to the attacks on civilians, the employer stated that residents in Kashmir have been experiencing similar dangers for years; nevertheless, has everyone left the valley and fled like them, he asked.

Responding to the repeated coercion, a Kashmiri Pandit speaking to the media network shared his apprehensions about returning to work due to the recent and continuous targeted killings of Kashmiri Pandits by the terrorists in the valley. He is heard saying that the government department is pressuring them to return to work. He stated that, while they have continued to work online, they are afraid to return to the workplace in person. “We want to return, but the ground conditions must improve first”, said the Kashmiri Pandit speaking to Times Now.

The Kashmiri Pandit added that they have sought representation in which they demanded that they are granted a breathing period and not pressurised to get back to work in the valley. They also demanded that their salaries be released with immediate effect.

It may be recalled that on November 10 the Anantnag office of the Social Welfare Department in Jammu and Kashmir had withdrawn a notice issued to 26 Kashmiri Pandit employees threatening action against them for their absence from duties. A tweet posted by the District Information & Public Relations Centre of Anantnag said that the notice was issued ‘unauthorisedly’, and it stands withdrawn by the department.

The notice was withdrawn a day after the Office of the District Social Welfare Officer in Anantnag had issued a notice to 26 officers of the department, all of whom are Kashmiri Pandits, who have fled the area due to recent attacks on civilians by terrorists. The notice was issued seeking an explanation from the absent employees for “unauthorizedly remaining absent from duties”.

After the notice emerged on social media, Netizens slammed the Jammu and Kashmir administration, claiming that Kashmir Pandit employees had left the region to safeguard their lives after numerous minorities were killed in the union territory in recent weeks.
