Indian courts have repeatedly clarified that that consensual relationships turning sour or culminating in marriages do not constitute the offence of rape.
While dismissing the case, a bench comprising justices JB Pardiwala and Sandeep Mehta on Wednesday (10th September), said that there is a “clear distinction between rape and consensual sex”.

The woman had alleged that the accused raped her with the promise of marrying her, and also threatened to make her obscene videos viral on social media.
“It is often said that a bad man is better than a bad name, and hence, a wise person will endure all hardships to avoid disgrace. Disrepute can destroy everything, making a person, though alive, equivalent to a corpse,” the court order reads.
The Allahabad High Court bench also observed that it was probable that the allegations of sexual offence and homicide were made against the accused only to get financial support from the government.
