Even though the Supreme Court has outlawed the draconian practice of triple talaq, some people haven’t yet decided to stop using it. Last week we had reported how a husband had give triple talaq to his wife after she stopped him from forcibly selling her land.
Now another case of triple talaq and assault has been reported from Hamirpur in Uttar Pradesh. According to the report, on Monday the woman had gone to the hospital to give food to her sister-in-law who was admitted there. There, as alleged by the woman she was assaulted by her husband who then fled after giving her triple talaq.
The husband and wife named Sania and Javed have reportedly have had their differences in the past. They had a love married on 8th February 2013. Soon disagreements started to happen between them and thus the wife went back to live with her parents.
Relatives later reconciled them and they also had a child. The fights again stated and a case was also filed in the police station.
But on Monday things took turn for the worse. According to the wife her sister-in-law had delivered a baby and she had taken food for her, which angered the husband. The SP Dinesh Kumar stated that instructions have been given to launch an investigation in the matter.
Now according to follow-up reports, the police have as a result filed a case of assault and dowry harassment against the wife’s in-laws. This report claimed that the in-laws started harassing her for dowry soon after her marriage and as a result Sania had filed a case against them in June 2013. In March 2014 the case was taken back after she allegedly was pressurised to do so by relatives. The harassment reportedly started again.
Apart from her husband, a case of assault has also been filed against her brother-in-laws, her mother-in-law and father-in-law. She has also alleged that he in-laws are trying to escape punishment by making a false accusation that she and her brothers stole their (In-laws’) jewels and cash after breaking open a locker.
The matter seems to be investigated under sections 498A, 323, 504, 506, which deal with cruelty at the hands of husband or his relatives, voluntarily causing hurt, intentional insults and criminal intimidation respectively.
