SC lifts stay on trial of Ram Rahim in ‘sacrilege of Guru Granth Sahib’ case, different bench with same Justice Gavai had stayed action against SP leader for insulting Ramcharitmanas

The Supreme Court on Friday, 18th October, lifted the Punjab and Haryana High Court’s stay on hearings against self-styled godman and Dera Sacha Sauda head Gurmeet Ram Rahim Singh in three separate sacrilege cases stretching back to 2015. A bench of Justices BR Gavai and KV Viswanathan served a notice on the Punjab government’s petition challenging the stay on proceedings.

The Bench was hearing the State of Punjab’s appeal against a March verdict by the Punjab and Haryana High Court, which imposed a stay on proceedings against Singh in the three sacrilege cases. The matter arose as a result of multiple incidences in Bargari, Faridkot district, where the scripture of the sacred book Guru Granth Sahib was allegedly desecrated and went missing.

In February of last year, the Supreme Court moved the trial of Singh and seven Dera Sacha Sauda followers in three sacrilege cases from Faridkot to Chandigarh. The decision occurred when Dera devotee Pardeep Singh Kataria, who is charged in the case, was shot dead.

Singh filed a High Court petition in December 2021, requesting that the Central Bureau of Investigation (CBI) continue its investigation into three sacrilege FIRs filed in 2015. Advocate General (AG) Gurminder Singh, along with Advocates Vivek Jain and Rajat Bharadwaj, represented the state of Punjab while Sonia Mathur, a senior advocate, appeared for Singh.

During the Supreme Court hearing, Senior Advocate Sonia Mathur, representing the respondent(s), contended that the High Court had simply followed the alternative prayer filed by the State of Punjab. She highlighted that the issue consists of two groups of cases: one involving police shootings and the other involving sacrilege. She further stated that due to differing views on the subject, the High Court referred the case to a larger bench.

Mathur went on to say that the matter is set to be heard by the Division Bench today and would have been resolved by now if the state had not sought adjournments. Mathur’s submission was contested by the Punjab AG, who stated that the notification covered all cases. The bench ultimately issued a notice and stayed the challenged ruling.

The controversy began on June 1, 2015, when the bir, or Saroop, a physical copy of the Guru Granth Sahib, was taken from a gurdwara in Burj Jawahar Singh Wala village, Faridkot district. On September 25th, several insulting posters were posted at Bargari and Burj Jawahar, and ripped pages of the Guru Granth Sahib were discovered strewn around the streets of Bargari on October 12th, that year.

In response to the sacrilege, a large throng was assembled at a site about 15 kilometres from Kotkapura. The police intervened early on October 14, leaving Ajit Singh with a bullet wound in his leg and others injured. Later that day, at nearby Behbal Kalan, police opened fire on protesters, killing Krishan Bhagwan Singh and Gurjit Singh.

Several members of the Sirsa-based Dera Sacha Sauda, including its leader Gurmeet Ram Rahim, were charged with sacrilege in all three incidents. Charge sheets were also filed in the Kotkapura and Behbal Kalan cases against a number of individuals, including the late former chief minister Parkash Singh Badal, the then-state home minister Sukhbir Singh Badal, the then-DGP of Punjab Police Sumedh Singh Saini, and the then-IG Paramraj Singh Umranangal.

Notably, Justice BR Gavai is the same authority who had stayed the criminal proceedings against Samajwadi Party leader Swami Prasad Maurya when he insulted the Hindu sacred book Ramcharitmanas. In January this year, the SC stayed proceedings against Maurya for insulting Shri Ramcharitmanas and inciting people to tear and burn pages of the Hindu epic. “Why are you so touchy about these things? It is a matter of interpretation. It is a line of thought. How is it an offense? He (Maurya) cannot be held responsible for burning of copies,” a bench of Justice BR Gavai and Sandeep Mehta had observed.

Additional advocate general (AAG) Sharan Dev Singh Thakur was informed by the Court that Maurya could in no way be held responsible for insulting the Hindu epic named the Ramcharitmanas.

An FIR was filed against Maurya and other Samajwadi Party members for making disparaging remarks about Tulsidas’ Ramcharitmanas. The FIR described a sense of public outrage and discomfort, with claims of leaders supporting the burning of the Ramcharitmanas books and using abusive language against its followers.

After analyzing the chargesheet and evidence, the Allahabad High Court concluded that there were adequate grounds for a prima facie case against Maurya. The court also then highlighted the importance of public authorities avoiding making statements or actions that could disrupt communal harmony.

Congress leader Pawan Khera on Friday slammed the Aam Aadmi Party over the air pollution in the national capital and said that the Delhi government is busy blaming the Haryana and this is how they work.

“This Delhi is worse than it was in 1998. For 15 years, Delhi was improved when the industries were removed, clean fuel was brought and CNG was introduced. Trees increased by 300 per cent. But in the 10 years after those 15 years, all the progress was wiped out. The central government blames the state government. The state government blames the Punjab and Haryana governments. Then they formed a government in Punjab and got confused about whom to blame. Then they blamed Haryana for it. This is not how it will work,” Khera said.

Earlier today, Delhi Environment Minister Gopal Rai said that the opposition has no right to comment on this as the BJP government is sleeping in UP, Haryana, Rajasthan and the centre.

“The effect of the adverse condition is visible in the pollution. The speed of the wind is decreasing in Delhi and the temperature is going down rapidly. As a result, the air quality has reached the poor category. In some hotspots, the pollution is more than the poor category… A meeting regarding the hotspots has been called at the Delhi Secretariat at 1 pm today… We are creating a plan while the BJP governments are sleeping in UP, Haryana, Rajasthan and the centre… The SC ordered Delhi and the central government to install one smog tower each… The BJP should also go to the Anand Vihar’s smog tower installed by them…” said Rai.

Meanwhile, BJP national spokesperson Shehzad Poonawalla reached ‘Smog Tower’ to protest over the air pollution in the national capital.

Slamming the Aam Aadmi Party (AAP), the BJP leader said that Arvind Kejriwal had cheated the people in the national capital in the name of air pollution now their health has been put at risk.

“Today Delhi has become a gas chamber due to blame game politics of the Aam Aadmi Party. They had made big promises that they would make Delhi pollution-free. Look at the condition of Yamuna today and Delhi has become a gas chamber. Aam Aadmi Party bans firecrackers on Diwali but the smog tower on which Rs 23 crore was spent has been locked… The way the Aam Aadmi Party has cheated people in the name of pollution and is working to make Delhi the most poisonous and polluted city, this will be exposed,” said Poonawalla.

A layer of smog engulfed the national capital as the overall Air Quality Index dropped to the ‘Poor’ category standing at 293.

As per the Central Pollution Control Board, the AQI when marked under the ‘Poor’ category can cause breathing discomfort to most people on prolonged exposure, whereas, when under the ‘Very poor’ category can cause respiratory illness on prolonged exposure.

Jo dikhe usey kaat do: Eyewitnesses reveal announcements were made from mosques to attack Hindus during Durga Visarjan procession in Bahraich

The violence in Bahraich left several injured while a Hindu youth Ram Gopal Mishra was brutally murdered by now-arrested Islamists on 13th October. After it was reported that Sudhakar Tiwari who was also attacked alongside Ram Gopal Mishra confirmed that some people from the Mosque initiated the attack on the Hindus, others injured in the anti-Hindu violence said announcements were made from mosques to attack Hindus.

Speaking to AajTak, a brother duo Vinod and Satyavan Mishra said that they were right behind the DJ during the Durga Visarjan procession when violence erupted. The eyewitnesses of the incident said that it was a horrific scene as stones were being pelted at Hindus causing injuries while announcements were being made from the most to attack the Hindu procession.

Vinod Mishra and Satyavan Mishra, who were injured in the Bahraich violence, say that Abdul Hameed’s family had raised objections to the song being played on the DJ. The Muslim side asked Hindus to stop playing the ‘offensive’ song. “We did not stop. They [Muslims] then abused and slapped the DJ operator and pulled the lead [wire]. After this, they attacked the idol of Maa Durga leaving it broken,” the Mishra brothers said.

During the anti-Hindu violence, Vinod Mishra sustained a head injury and his hand was broken while his 90% disabled brother was also severely injured.

The injured brothers said that “Jo dikhe usey kaat do [Slaughter whoever you see]” announcements were being made from the mosques. Consequently, Muslim mobs came out on the streets with swords and sticks. Amidst the escalating tensions, the Hindu side also turned enraged. In no time, the full-fledged violence erupted, Vinod and Satyavan said.

On the question of entering Hamid’s house, they said that people entered the house to save Ram Gopal Mishra so that he could be saved alive. But the stone pelting did not stop. Due to which, the people who went to rescue him also got injured. 

Today was the first Friday after the violence in Bahraich, and there was heavy presence of security forces in the town. Barricades have been put up on the roads in many places. Every person coming and going is being questioned. Moreover, the entry of outsiders has been prohibited in the district. Officers are continuously patrolling to monitor the situation.

‘Goli maari gayi toh marega hi’: The Wire downplays the cold-blooded murder of Ram Gopal Mishra in Bahraich as an act of “self-defence”

The Islamo-leftist propaganda outlets compete as to who can come up with the most inhumane justification for the killing of a 22-year-old Hindu youth by Islamists in Uttar Pradesh’s Bahraich. Ram Gopal Mishra was brutally murdered by Islamists for removing a green flag and replacing it with a saffron one at Abdul Hamid’s home following a dispute during a religious procession of Durga Visarjan. In a shameless attempt at downplaying the Islamist crime, leftist propaganda portal The Wire passed off Mishra’s killing as an act of ‘self-defence’.

On the 16th of October, The Wire published a report on YouTube, titled “Who is behind the communal riots in Bahraich?” In this video, ‘journalist’ Sharat Pradhan accused the BJP and RSS of instigating riots in Bahraich insinuating that violence erupted because bypolls are to be held in 10 seats in the state. He went on to accuse the Hindus of raising slogans against Muslims and abusing them which enraged Muslims who in turn resorted to violence.

After describing the sequence of events as to how Ram Gopal Mishra removed the green flag and demonising the Hindus, Sharat Pradhan justified the Hindu youth’s brutal murder saying that if Hindus storm into the houses of Muslims, remove their flags and hoist saffron flags, Muslims will kill Hindus in ‘self-defence’. Shrewdly, Sharat Pradhan blamed Hindus for the violence, diminished Ram Gopal Mishra’s brutal murder as an act of ‘self-defence’, while also giving a political colour to the incident claiming that it was BJP that disrupted communal harmony and caused riots so that it could build a narrative that Muslims are causing riots and use it for electoral gains in poll-bound Maharashtra.

“When Hindus partaking in Durga Visarjan procession enter someone’s house and instigate them, they [Muslims] had licensed gun. They [accused Muslims] took out the gun and fired it and the bullet hit the same boy who changed flags. He was taken to the hospital but died. Since bullets had struck his body, he had to die. There is no doubt that the shot was deliberately aimed at the boy [Ram Gopal Mishra]…provocation…this is fine…but the arson after that, the houses and shops of Musalmans were selectively attacked and burnt. By doing all this who is benefitting from this…it is being said about BJP that it would benefit from this incident in other states like Maharashtra where the Hindu-Muslim divide can work in favour of the BJP…,” The Wire ‘journalist’ said.

How casually Sharat Pradhan said “Goli maari gayi hai toh marega hi” just because the victim is a Hindu and the perpetrators are Muslims and it is the ideological imperative of the Islamo-leftists to defend the Islamist criminals.  The Wire not only downplayed Ram Gopal Mishra’s murder by Islamists as self-defence, indulged in victim-blaming but also conveniently blamed Hindus for starting the riots and justifying the Islamist aggression.

The Wire claims that BJP incited riot in Bahraich to capitalise on it in Maharashtra elections

Several claims regarding what initiated the riots have emerged including the songs mocking Pakistan, Mughal invader Babur etc being played on the DJ in the Hindu procession, now The Wire is claiming that Hindus raised slogans against Muslims etc, etc. However, none of it justifies the brutal killing of the Hindu youth. The leftist media wants to normalise the Islamist argument that if Hindus will ‘instigate’ Muslims they will kill Hindus. The Wire tried to create a narrative that Hindus provoked Muslims who then acted in ‘self-defence’ but cruel Hindus burnt the houses of poor, innocent Muslims out of revenge and to somehow ensure the BJP benefits from it in the elections.

The leitmotif of the 12-minute haranguing of Sharat Pradhan was that Muslims, no matter what, are always the victims and Hindus and the BJP are always the oppressors. This comes even as Sudhakar Tiwari who was also attacked alongside Ram Gopal Mishra confirmed that some people from the Mosque initiated the attack on the Hindus.

The Wire and leftist media ecosystem is doing exactly what the Communal Violence Bill proposed by Congress in 2011 would have done only if it was passed. This bill had provisions ensuring that only minorities and SCs/STs could be “victims” and the perpetrators of communal violence would always be the majority, which is Hindus.

Before The Wire, another leftist propaganda outlet Newslaundry also attempted to rationalise Ram Gopal Mishra’s brutal murder. As a local man told the propaganda portals’ reporter that the Hindu side was playing the “Tel laga lo Dabur ka naam mita do Babur ka” song, Newslaundry suggested that it was this song being played by Hindus to offend the Muslims thus causing the riots and the Hindu youth’s murder even as the Muslims had started abusing and threatening Hindus first.

In a nutshell, as per the logic of Islamo-leftist propagandists, a song, a few slogans, removing a flag or any real or imaginary thing can offend Islamists and once offended, any criminal activity they carry out is ‘self-defence’ but when Islamists raise Sar Tan Se Juda slogans outside Hindu temples during Muharram, it is by default an act of consolidating communal harmony, preservation of Ganga Jamuni Tehzeeb.

While The Wire insinuated that BJP benefits from a Bahraich-like incident of communal clashes by projecting Muslims as the rioters, it is in reality, the Muslim appeasing political parties that benefit the most by positioning themselves as the protectors of ‘minorities’ against ‘fascist Hindutva regime’. It was seen how opposition parties benefitted from Muslim-majority constituencies in Uttar Pradesh during the Lok Sabha elections. Also, Samajwadi Party which thrives on the M-Y [Muslim-Yadav] formula did not condemn the killing of Ram Gopal Mishra by Islamists, however, as soon as the news of Mishra’s killers Sarfaraz and Talib getting injured in a police encounter while attempting to flee to Nepal came up, its supremo Akhilesh Yadav came in action and accused UP Police of deliberately carrying out encounters to kill the accused.

Going by Sharat Pradhan’s logic, it was the BJP who asked Hindus to take out a procession in Maharajganj and provoke Muslims, and get a Hindu youth brutally murdered so that the BJP could ‘polarise’ Hindu votes. Later on, Pradhan appeared to indulge in monkey balancing by saying that people on both sides did wrong, his emphasis remained on how the BJP government will ‘target’ Muslims only.

Supreme Court dismisses PIL seeking regulatory board to monitor and manage OTT and streaming platforms in India

The Supreme Court on Friday dismissed a PIL concerning the need for a regulatory board to monitor and manage over-the-top (OTT) and streaming platforms in India.

A bench of Chief Justice of India DY Chandrachud and Justices JB Pardiwala and Manoj Misra said, “This is the problem of PILs. They are all on policy now and we miss our genuine PILs.”

The plea has said that these platforms operate without the same checks and balances that traditional media — like films and TV — are subject to.

“Unlike films shown in theatres, OTT content doesn’t go through a certification process before release, which has led to a rise in explicit scenes, violence, substance abuse, and other harmful content, often without proper warnings,” said advocate Shashank Shekhar Jha who filed the plea.

The Union of India and the Ministry of Information and Broadcasting introduced IT Rules 2021 to self-regulate OTT platforms however the same has been inefficient, the petition stated.

“These platforms continue to exploit loopholes, putting out controversial content unchecked, which has national security implications and promotes things like gambling and drugs,” he said.

The petition is about preventing harm before it happens, not after, by ensuring there’s a body to regulate this content before it reaches the public, just like we have for movies and TV, Jha said.

OTT medium has become a tool to promote substances prohibited for advertisements viz gambling, liquor, drugs, smoking, etc. while using the loopholes, the petition alleged.

The plea raised the issue of the absence of any law or autonomous body governing the digital content saying it has made these digital contents available to the public at large without any filter or screening.

The petition sought directions for the establishment of a proper board/institution/association for the monitoring and management of content on different OTT/streaming and digital media platforms.

“OTT/streaming and different digital media platforms have surely given a way out for filmmakers and artists to release content without being worried about getting clearance certificates for films and series from the censor board,” it added.

He further sought direction to the Central government to constitute an autonomous body/board to monitor and filter the contents and regulate the videos on various platforms for viewers in India.

The board must be headed by an IAS officer of secretary level and shall further have members from varied fields including movie, cinematographic, media, defence, legal field and field of education, he asked.

“The lack of a certification board for OTT platforms creates an unlevel playing field between traditional media (cinemas and television) and digital streaming services. While traditional media is subjected to stringent regulations, OTT platforms on the other hand operate in a largely unregulated environment, allowing them to bypass content restrictions that are otherwise mandatory for other media. That this lack of regulatory parity is arbitrary and unjustifiable,” added the petition.

Ground Report: ‘They’ve been caught, but not killed’- Ram Gopal Mishra’s family and villagers say the accused will come out in few days after having biryani in jail

The Uttar Pradesh Police arrested Talib and Sarfaraz following an encounter in Bahraich on Thursday, October 17, 2024. During the confrontation, both suspects were shot in the legs after they attacked the police while attempting to flee to Nepal. These arrests bring the total number of individuals detained in connection with the murder of Ram Gopal Mishra, which occurred on Sunday, October 13, to five. Authorities have announced that the accused will face charges under the National Security Act (NSA). However, Ram Gopal’s family and villagers remain dissatisfied with the police’s actions.

The police have been conducting raids to apprehend both known and unknown suspects in the case. Talib and Sarfaraz were among those captured. They fired at the police, prompting officers to return fire, injuring them in their respective legs. A viral video shows the two suspects groaning in pain and apologizing to the police, while another clip shows them being dragged by officers after the encounter.

Both suspects repeatedly can be heard saying to the police, “We won’t make this mistake again.” The police eventually moved the duo in a government vehicle and transported them to the hospital for treatment. A separate FIR has been registered against Talib and Sarfaraz launching an attack on the police, with charges including attempted murder. Bahraich Superintendent of Police Vrinda Shukla stated that a total of five accused have been arrested, and all will face action under the National Security Act (NSA).

Mishra’s family says ‘unsatisfied’ with police action

Following the encounter of Talib and Sarfaraz and the arrest of five suspects, Ram Gopal’s family has expressed dissatisfaction with the police’s actions. On Thursday, October 17, 2024, Ram Gopal’s widow, Roli Mishra, released a video in which she accused the police of taking bribes and disregarding her demands. In the video, Roli stated, “They may have been caught, but they haven’t been killed. We’ve only been shown that they were shot in the leg.”

Such encounter records no justice to Mishra’s family

After the encounter, OpIndia’s team visited Ram Gopal Mishra’s village, Rehua, on Thursday, October 17th. Police vehicles were patrolling the village with hooters blaring, and police along with PAC personnel were stationed around Ram Gopal’s house. No one was allowed to enter or leave the house, including media personnel who were prevented from speaking to the family. Ram Gopal’s brother, Harimilan, and family member Rahul Mishra informed us over the phone that even they were not allowed to move freely due to the police presence.

Speaking with villagers near Ram Gopal’s home, team OpIndia learned that several were unhappy with the police action as the accused were shot in the legs and were not killed instead. Ram Gopal’s cousin, Kishan Mishra, expressed frustration, saying that given the brutal nature of his brother’s murder, simply shooting the suspects in the leg and arresting them did not feel like justice. He said, “This used to happen before, but not under Yogi’s government.” Kishan believes that Sarfaraz and his family will live comfortably in jail, only to be released soon, enjoying privileges like eating biryani while incarcerated.

Around 3 pm, news quickly spread in and around Mahsi that the police had encountered the murderers of Ram Gopal Mishra. Following this, people across Bahraich tuned in to watch the breaking news on TV. In Bahraich city and areas like Mahsi, Hardi, and Nathurpurwa, we observed people closely following the updates on their TVs at home and in shops. Initially, many believed that Sarfaraz had been killed in the encounter, but this later proved to be false. Currently, the district is abuzz with discussions about the incident.

‘Would have cut Ram Gopal Mishra’s body and made it disappear’: Hindu youth who reached Abdul Hamid’s roof to save him reveals Muslim mob’s sinister plan

A Muslim mob brutally killed Ram Gopal Mishra in the presence of police on 13th October in the Bahraich district of Uttar Pradesh during a visarjan procession of Goddess Durga’s idol. The accused dragged his body inside Abdul Hamid’s home after he was killed there. According to a viral video, his corpse was also attacked with stones and bullets as some people tried to bring down him from the roof. OpIndia interviewed the individual who removed the body. The youth’s name is Kishan Mishra and he is Ram Gopal’s cousin.

They studied and played together in childhood and grew up together. Kishan was assisted by Rajan Mishra in retrieving the body. We met Kishan in his village, Rehua, on 17th October. The entire village was under strict police surveillance at the time. However, he somehow managed to come out and speak to us. We spoke to him after dark as per his request.

Stone pelting by Muslims on one side, lathi charge by police on the other

Kishan Mishra recounted that chaos erupted, and simultaneously, the police launched a lathi charge on the procession. As a result, the devotees who had initially stayed together scattered, and the perpetrators dragged Ram Gopal into a house. When Kishan returned to rescue his cousin, he faced hostility from both sides: Muslims were throwing stones and firing shots, while the police continued their lathi-charge.

Kishan revealed that he repeatedly approached the authorities, informing them that Ram Gopal had been taken inside and urgently pleading for their help to rescue him. However, his appeals were ignored. With no response from the police, he decided to take matters into his own hands, attempting to save his cousin with the help of two companions, one of whom was his relative, Rajan Mishra. Kishan expressed the belief that Ram Gopal might still be alive today if the police had assisted the Hindus instead of using force against them.

They reached Abdul’s roof after opening the Hindu neighbour’s house

Kishan further explained that Ram Gopal was killed on the roof of Abdul Hamid’s house, which was difficult to access. The police action had caused a stampede, with crowds fleeing the lathi charge. Police officers were positioned in front, while the Muslim crowd hurled stones and fired bullets from behind. Given the chaotic situation, they decided to use the rooftops instead of the road to reach Ram Gopal. Abdul Hamid’s house was adjacent to a Hindu residence, which was opened after several requests. Kishan and Rajan then used that rooftop to cross over to Abdul Hamid’s place via another house’s roof.

Kishan disclosed that in such a short distance, he and Rajan had to constantly protect themselves from stones and gunfire. When Kishan arrived at Abdul Hamid’s roof, Ram Gopal was lying there in an unconscious state. The Muslim mob targeted him and Rajan Mishra as soon as they lifted the body by holding his hands and legs. Abdul Hamid’s son Sarfaraz was leading the attack. He fired shots at them and Ram Gopal’s body while hiding behind the wall.

Sarfaraz dropped his gun after they threw a brick

According to Kishan Mishra, Sarfaraz’s initial shot did not strike the target otherwise his body would have also been discovered at Abdul Hamid’s home like that of his cousin. After the initial shooting, Kishan and Rajan placed the body on the ground and hurled a brick towards Sarfaraz from the roof. It, fortunately, hit him and the gun dropped from his grasp. Kishan and Rajan had already taken out Ram Gopal before Sarfaraz regained his balance and prepared to fire again.

Kishan mentioned that Sarfaraz, his father Abdul Hamid and his brothers Talib and Faheem were actively participating in the violence. They were throwing stones along with the Muslim throng while Sarfaraz was busy firing bullets. He added that the commotion created by the devotees outside the house was distracting the attackers otherwise he and Rajan would have also been killed by Abdul Hamid and his associates, just like Ram Gopal.

Conspiracy to make the body disappear

Kishan highlighted that Abdul Hamid and his gang had planned to make Ram Gopal’s body disappear. He stated that the case likely would have been of a missing person if he and Rajan had not brought the deceased out of Abdul Hamid’s house. The police would have also claimed that Ram Gopal was not murdered but disappeared somewhere and all the culprits could have escaped from the purview of law.

Kishan Mishra told us that all the houses of the Muslim community including Abdul Hamid living in Maharajganj have a stock of sharp weapons and illegal guns. He believes that his cousin’s body would have been cut into pieces and disposed of somewhere. He voiced that Ram Gopal would have then become a mystery to the world and it would have been declared that he had fled to some other region due to his name being involved in the violence and did not return.

People continued to run while carrying the body

Despite his pleas, Kishan charged that the cops refused to lend him a car to take Ram Gopal to the hospital after he came out of Abdul Hamid’s house with the body. The Hindu devotees who had been struck with lathis (batons) continued to run with the body for a considerable distance on the road leading to the hospital. OpIndia has a video of this incident in which a policeman is also seen. Somehow he was able to reach the hospital where the doctors pronounced Ram Gopal dead.

Kishan feels Ram Gopal’s life would have been spared if the police had dispatched a car right away to accompany him. Additionally, he informed us that he has complained to Chief Minister Yogi Adityanath about the conduct of the police. Kishan Mishra started to cry as he spoke with us. In the end, he shared that the killers had taken away both his best friend and his cousin. Kishan added that he would not have regretted it if he had passed away alongside Ram Gopal. The duo used to work together as cooks in catering.

Supreme Court closes habeas corpus petition against Sadhguru’s Isha Yoga Centre, says proceedings can’t be to malign institutions

The Supreme Court on Friday dismissed a habeas corpus petition filed by a man alleging his two adult daughters were held captive in the Isha Yoga Centre of Sadhguru. The petition was disposed by the apex court after the two women, aged 42 and 39, categorically told the court that they were staying at the ashram in Coimbatore on their free will.

Their father had alleged that his two daughters were held captive and being brainwashed in the ashram. On the father’s plea, the Madras High Court had directed police to probe allegations against the Isha Yoga Centre. The Supreme Court bench of Chief Justice of India DY Chandrachud, Justice JB Pardiwala and Manoj Misra in its order today objected to the high court order.

The court gave the verdict after Isha Foundation approached the top court challenging the high court order. Earlier on 3rd October the court had stayed the high court order and stopped the police investigation against the Yoga Centre.

The bench said, “Since both of them are adults and the purpose of habeas corpus was fulfilled, no further directions were needed from the High Court.” The bench added that the jurisdiction of the court under Article 226 while dealing with habeas corpus is well defined and it would be unnecessary for this court to expand the ambit.” 

CJI Chandrachud said, “These proceedings cannot be to malign people and malign institutions.” 

The court told the counsel of the father, “When you have grown children who are majors, you cannot file a complaint to control their lives.” The CJI added, “However grave the anguish may be, she is a major. We cannot compel her to meet someone.”

When the father’s advocate argued that the conditions of the Ashram inmates should be investigated, the CJI hit back, wondering if there was a political motive behind the plea. He said, “Now I have doubts whether you are appearing for a political party or you are espousing cause for your daughter.”

The Madras High Court had directed the police to conduct an inquiry inside the Ashram accepting the habeas corpus petition filed by the father. In its petition, Isha Foundation said that even as per the police status report, the two women monks were residing at the ashram voluntarily, therefore there was no justification in continuing the habeas corpus petition.

Foundation’s counsel Mukul Rohatgi said that the high court should have closed the petition after the police report, but the court directed the police to conduct a probe inside the ashram instead.

After the bench closed the habeas corpus petition, the Tamil Nadu govt prayed the court to clarify that this order will not curtail the right of the police to investigate the pending cases. But Rohatgi objected to any such comments by the court, saying that it would be misused by persons with vested interests to target the institution. Solicitor General of India Tushar Mehta also agreed with him, saying that if the court makes any such comment, media will publish “clickbait” news articles claiming that the Supreme Court has directed an investigation against the Yoga Centre.

Based on the arguments, the court said, “We clarify that the only aspect dealt here pertains to the habeas corpus petition and that aspect of the matter will remain closed. One thing which we have made clear is that we have not commented and the High Court should not have commented on other things.”

However, when Tamil Nadu govt’s counsel said that certain irregularities were found during police visit, like expired licence of X-ray machine, the court noted that the closer of the petition will not affect any other regulatory compliance in the Isha Foundation.

The Supreme Court also refused to hear interventions made by other parties to raise other issues, including an intervention sought to be made by the OBC Mahasabha. 

Wire ‘journalist’ Arfa Khanum Sherwani wants return of man who coined ‘Two Nation Theory’ so he can direct Muslims in ‘right’ direction, hate exposed

The Wire’s Afra Khanum Sherwani often known for spreading anti-Hindu and anti-India agenda on several occasions remembered Sir Syed Ahmed Khan on 17th October and said that the Muslim community in India needed a leader like him today. She said that Khan was the only leader who could give proper directions to the community to deal with the so-called, alleged hatred being spread by the current government against Muslims. Sherwani remembered Khan, the founder of Aligarh Muslim University (AMU) on the occasion of his 207th birth anniversary.

“Today India and Indian Muslims need Sir Syed Ahmed Khan more than ever before. We are at a juncture in our history where the state and the society have totally abandoned its Muslims. The directionless and hopeless community is desperately searching for a leader. #SirSyedDay,” she posted on X.

Not only Sherwani but several other Leftists, Islamists and their supporters also extended praises for Khan who once propelled the theory to divide the nation into two based on the tenets of one religion – Islam. Zeeshan Ahmed Khan, National Vice Chairman NSUI Social Media (National Students’ Union of India (NSUI) is the student wing of the Indian National Congress) lauded the ‘leader’ for establishing AMU and leaving the legacy of education for the community.

“Education is the greatest legacy that parents can leave for their children Tribute to the founder of AMU Dr Sir Syed Ahmed Khan on his 207th birth anniversary, Sir Syed Day. Sir Syed Ahmed Khan has left a great legacy to the country and the world in the form of AMU!” he said.

The Aligarh Muslim University also celebrated the leader on his 207th birth anniversary, the video of which had been making rounds on social media.

However, it is important to note that while Congress and Left ‘historians’ kept blaming Swatantryaveer Vinayak Damodar Savarkar for allegedly propagating the idea of the ‘Two Nation Theory’, it was Islamist leader Sir Syed Ahmed Khan who first promulgated the theory and not Savarkar.

Syed Ahmad Khan said in 1876, “I am convinced now that Hindus and Muslims could never become one nation as their religion and way of life was quite distinct from each other.”

Seven years later, in the year 1883, he voiced similar sentiments. He said, “Friends, in India, there live two prominent nations distinguished by the names of Hindus and Mussalmans…To be a Hindu or a Muslim is a matter of internal faith which has nothing to do with mutual relationships and external conditions…Hence, leave God’s share to God and concern yourself with the share that is yours…India is the home of both of us…By living so long in India, the blood of both have [sic] changed.”

Sir Syed Ahmed Khan was no ordinary Islamic scholar but a bigoted and radical cleric, baying for the blood of Hindus. During a speech on March 14, 1888, he said –

“…You must remember that although the number of Mahomedans is less than that of the Hindus, and although they contain far fewer people who have received a high English education, yet they must not be thought insignificant or weak. Probably they would be by themselves enough to maintain their own position. But suppose they were not. Then our Mussalman brothers, the Pathans, would come out as a swarm of locusts from their mountain valleys, and make rivers of blood flow from their frontier in the north to the extreme end of Bengal.”

In the same speech, he stated, “Now, suppose that the English community and the army were to leave India, taking with them all their cannons and their splendid weapons and all else, who then would be the rulers of India?… Could two nations—the Mohammedans and the Hindus—sit on the same throne and remain equal in power under these circumstances? Most certainly not. One of them must conquer the other. To hope that both could remain equal is to desire the impossible and the inconceivable. But until one nation has conquered the other and made it obedient, peace cannot reign in the land.”

Sir Syed Ahmed Khan clearly believed that Hindus and Muslims living together was an impossible and inconceivable idea, thus proposing that two nations, one for the Hindus and the other for the Muslims could bring peace to the land.

In several of his speeches, he said he believed that Muslims and Hindus had fundamental disparities in their religion, culture, and manner of life. He contended that these distinctions were significant enough to warrant separate social and political worlds.

Following the 1857 War of Independence, he acknowledged that Muslims had suffered tremendously following which he asked the Muslim community to improve relations with the British Empire which was dominating the power at that time in the country. He believed that cooperation with the British would safeguard the survival and prosperity of Indian Muslims, as opposed to the Congress who as per him represented the growing Hindu majority. 

He believed that Muslims over the period would be sidelined and that the community needed a separate political representation. In the year 1875, seeing that the community was standing backwards in education, he established Aligarh Muslim University to provide Western-style education to Muslims so that they could compete with other major communities.

His idea of separate political representations for the two communities led to the ideological development of the theory that led to the partition of the land at the hands of Jinnah, who later became the first governor-general of independent Pakistan.

Sherwani, remembering Sir Syed Ahmed Khan saying that he only could rightly ‘direct’ the Muslims today indicates her desire to allegedly wage a war between the two communities. What directions does the Wire ‘journalist’ want the Muslim community to be given? Does she want Khan to come back to call for baying for the blood of Hindus as he did in the year 1988? Does she want Khan to direct Muslims to conquer Hindus as he said he believed in the year 1888? Or does she want Muslims to compete with Hindus and establish social, political, and economic dominance in a Hindu-majority country, India?

The Wire ‘journalist’ eventually wants the Muslims to believe that Hindus and Muslims cannot live peacefully in this country.

Leftist Islamists such as Arfa Khanum Sherwani and her supporters have selectively embraced the habit of downplaying events against Hindus, arguing that they pose a threat to India’s minority communities. They have downplayed incidents of jihad and genocide against Hindus, further blaming them for allegedly sidelining the minority community.

But, it is crucial to note that it is the Islamists who want to sideline Hindus and see India as an Islamic nation by the year 2047, the day when India would complete 100 years of Independence. The Centre has obtained several proofs against the Islamists’ idea of making India an Islamic nation, which honestly even sounds scary. Calling for the person who propelled the ‘Two nation theory’ at such times, showcases nothing but pure hatred and desire for ‘good riddance’ from the majority community, posing a major threat to the ‘secular’ and independent fabric of the country.

In a tweet on Thursday (17th October), journalist Daniel Bordman confirmed the development on X (formerly Twitter). He informed, “This is a the gurdwara that was run by Hardeep Singh Nijjar planning to celebrate the mastermind of the air India bombing, the worst terrorist attack in our history.”

“Justin Trudeau cannot ask me and the rest of the country to die on this hill with him. Do something about these terrorists. Canadian lives are at stake,” he emphasised.

Daniel Bordman shared the poster, which was put out by the Guru Nanak Sikh Gurdwara in Surrey. According to it, the gurdwara will honour and felicitate four Khalistani terorirsts on 20 October 2024.

They include Talwinder Singh Parmar, Kulwinder Singh Happy, Nirmal Singh Mianvid and Kanwaljit Singh Sultanwind. The event is being publicly held in a Canadian city at a time when the Justin Trudeau government is accusing India of extra-territorial killings albeit without proof.

All the terrorists, whose ‘martyrdom’ is now being observed in full public display in Surrey, have been directly responsible for the killings of many Indian and Canadian citizens.

Kulwinder Singh Happy

The Khalistani terrorist was born on 17th October 1967 in Jalandhar district of Punjab. At a young age, Kulwinder Singh Happy became a radical follower of slain terrorist Jarnail Singh Bhindranwale.

After the Indian army neutralised Bhindranwale, a ‘motivated’ Kulwinder joined Khalistanis in their covert terror activities. He received the support of the chief of the banned terror outfit ‘Khalistan Commando Force’ (KCF) Manbir Singh Chaheru.

Kulwinder helped other Khalistanis by providing them with ammunition from Pakistan. He also worked with another terror outfit ‘Babbar Khalsa’ under Talwinder Singh Babbar.

Kulwinder Singh Happy

Kulwinder Singh Happy was part of the group that carried out the largest bank robbery in Ludhiana. He was involved in the brutal murder of Punjab police officer Murti Suri, and singers Amarjot and Chamkila.

The young terrorist also aided other Khalistanis in abducting the Romanian Ambassador to India, Liviu Radu. He had also travelled to Pakistan for guerrilla training and carrying out anti-India activities.

The Punjab police neutralised Kulwinder Singh Happy in an encounter on 15th October 1992 after being caught smuggling loads of ammunition from Pakistan. The Khalistani terrorist died in the Phillaur district of Punjab, just 2 days short of his 35th birthday.

Kanwarjit Singh Sultanwind

This Khalistani terrorist was born in Amritsar district of Punjab. Kanwarjit Singh Sultanwind was involved in burning down Hindu shops after the Indian army executed Jarnail Singh Bhindranwale in 1984. He was eventually put behind bars for carrying out arson and stealing firearms.

He was freed from jail when a group of 4 other Khalistani terrorists laid siege to the police station in Amritsar. Thereafter, he worked as a full-time terrorist with the proscribed Khalistan Commando Force (KCF).

Kanwarjit Singh Sultanwind was instrumental in the jailbreak of terrorist Sukhdev Singh Dhillon (popularly known among Khalistanis as General Labh Singh). He also carried out the murder of Indian Army officer, Major General BN Kumar.

Kanwarjit Singh Sultanwind was left paralysed after he was shot in the leg by the Punjab police during retaliatory firing. He had initially fired at the cops while trying to escape from his hideout.

Despite not being able to run, his resolve to carry on the path of terrorism remained undeterred. The Khalistani terrorist sold his ancestral land to collect funds to carry out his separatist agenda. He was in close touch with jihadis of Afghanistan.

Kanwarjit Singh Sultanwind also murdered an informant, who facilitated the arrest of 3 dreaded Khalistanis. He also worked in the direction of uniting 5 terror outfits under one faction but committed suicide before he could realise his unfulfilled fantasy.

The Khalistani terrorist died on 18th October 1989 after consuming a cyanide capsule. He was arrested by the police and was en route to the Jalandhar police station when he decided to take his own life.

Nirmal Singh Mianvid

This Khalistani terrorist was also born in Amritsar district of Punjab. A promising sportsperson, Nirmal Singh Mianvid was drawn towards the fantasy of Khalistan shortly after the execution of Jarnail Singh Bhindranwale.

Although he had a wife and 2 kids, Mianvid gave up on family life to focus on his full-time career of terrorism. He was an active member of the banned Khalistan Commando Force.

Nirmal Singh Mianvid had close ties with terrorist Kanwarjit Singh Sultanwind and would refer to the latter as ‘Bhau Ji’ despite being elder to him. “Bhau Ji, I may be older than you, but you are wiser than me,” he would often say.

Nirmal Singh Mianvid was arrested alongside Kanwarjit Singh Sultanwind on 18th October 1989. They were being taken to the Jalandhar police station. Before Sultanwind committed suicide, he directed Mianvid to jump out of the police van and escape.

Nirmal Singh Mianvi was shot in the back by the police and succumbed to his injuries.

Talwinder Singh Parmar

Talwinder Singh Parmar was born on 26th February 1944 in Kapurthala district of Punjab. A 10th-pass farmer, he went on to mastermind the deadliest act of aviation terrorism known to mankind before 9/11.

He immigrated to Vancouver city in British Columbia province of Canada in 1970. Parmar’s tryst with radicalism began in 1975 when he travelled to Pakistan for the first time.

Following the 1978 Sikh-Nirankari clashes, he travelled to Punjab and started an outfit called ‘Chalda Vaheer Chakarvarti Dal’. Talwinder Singh Parmar had started out by preaching ‘sikhi’ but quickly changed tactics to terrorism.

He went to Canada and arranged funds and arms for the separatist movement in the Indian State of Punjab. The arms supplied by Parmar were used in the murder of several Nirankari leaders.

He also provided weapons to Dal Khalsa terrorists to execute the hijacking of Indian Airlines Flight 423 in September 1981. Around the same time, he was aiding in the murders of Nirankaris in his ancestral village.

After the Punjab police began clamping down on Khalistani terrorists, Talwinder Singh Parmar fled the country like a ‘coward’ via Nepal. In the meantime, the administration put a bounty of ₹1 lakh on his head and that of his fellow terrorists.

Following that, Parmer focused on operating his terror network from Canada. He was arrested in West Germany in June 1983 during the course of one of his speeches and served 13 months in jail. Despite the best efforts of the Indira Gandhi government, Talwinder Singh Parmer couldn’t be extradited to India.

Following his release, he masterminded the bombing of Air India Flight 182 along with other Khalistani terrorists. The deadly attack claimed the lives of 329 people, mostly Canadian citizens of Indian descent.

Pierre Trudeau, the father of Justin Trudeau, is vastly blamed for the bombing, as it was him who protected the Khalistani terrorist.

Talwinder Singh Parmar also aided in the recruitment of his relative Manjit Singh, also a hijacker of a Pakistani plane, to the banned ‘Babbar Khalsa.’  In the 1990s, he laid the foundation of ‘Babbar Khalsa Parmar Group.’

The Khalistani terrorist was eliminated on 15th October 1992 in an encounter by the Punjab police.
