PIL filed in SC against contemptuous remarks made by lawyers and politicians on Judiciary

Lawyer Gaurav Bhatia had yesterday moved to the Supreme Court with allegations that several lawyers and politicians are regularly making contemptuous remarks against the judiciary. According to reports, Gaurav Bhatia, who is also a BJP spokesperson, has filed a PIL seeking contempt of court action against these people who have made adverse remarks on the judiciary on social and mainstream media platforms.


A Supreme Court bench comprising of CJI Deepak Mishra, Justice AM Khanwalikar and Justice DY Chandrachud reportedly stated that they will hear the petition next week. Bhatia has reportedly cited various material available on social media where lawyers and politicians had attempted to taint the sanctity of the judiciary and put baseless allegations. Tweets by Congress social media head Divya Spandana is also reportedly cited by Bhatia in his PIL.

Bhatia has reportedly stated that certain unsavoury and uncharitable remarks are being made by advocates and political activists and they should be taken note of by the judiciary as they are contemptuous in nature. In the recent verdict in Judge Loya death case, the Supreme Court had remarked that it was just inches away from initiation contempt of court action against some of the lawyers for their constant contemptuous behaviour and disregard for the judicial process.

It is notable here that Congress party MPs including prominent lawyer Kapil Sibal had moved an impeachment motion against CJI Deepak Mishra. The motion was rejected by Rajya Sabha Chairman and Vice President Venkaiah Naidu on grounds that the allegations hold no merit and the attempts are only politically motivated to malign the sanctity of the SC. The impeachment motion and current errant and rude behaviour of lawyers was also condemned by senior lawyers. Finance Minister and prominent Lawyer Arun Jaitley had also called out the tactics of maligning the SC as politically motivated attempts.
