NCB responds to Nawab Malik’s allegations, says raid on cruise ship, Aryan’s arrest all done as per due process of law

Amidst the ongoing drug case involving Shah Rukh Khan’s son, Aryan Khan, NCB Mumbai Director Sameer Wankhede has responded to the allegation meted out by Maharashtra minister Nawab Malik. Malik had alleged that the raid on a luxury cruise liner was fake and was done to target Shah Rukh Khan.

Wankhede said on Thursday, September 7, that “all action has been taken within the ambit of the law.”

While speaking to India Today, the NCB chief said that the panchnamas (seizure memos) were drawn as per the provisions established by the law.

The agency hit out at the NCP leader saying that his allegations seemed to be motivated by prejudice and malice.

“We have already held a press conference, yet let us tell you that we have given 9 names who did the panchnama as witnesses in the case. All action has been taken within the ambit of the law,” Wankhade said.

The NCB had also said in its statement that two persons, namely, Manish Bhanushali and Kiran Gosavi were among more than half a dozen of its ‘independent witnesses’ during the October 2 rave party raid. NCB slammed the Nationalist Congress Party for levelling allegations against the agency.

“We are all government servants and doing our duty. NCB is a professional organisation and whoever is found violating the NDPS rule, we are taking action against them and will continue to take action. In the last one year in Mumbai and Maharashtra, we have tried to create a drug-free environment and have the statistics prove this,” Wankhade said.

He added that in a year, NCB has arrested 320 people, raided 2 big drug factories and busted many big drug syndicates and gangs.

“You know the names of a lot of people, so the statistics are testimonials to what we do. In 1 year, drugs more than 100 crores have been caught. We will continue to do the same thing in the future,” Wankhede added.

Speaking on the arrest of Aryan Khan, the NCB Mumbai chief asserted that the agency had submitted all the evidence in court and will continue to do so. Wankhede asserted that Khan was not the only person to be arrested. So far the department has arrested 16 people in the case and had seized many different types of drugs.

Sameer Wankhede was responding to NCB leader and Maharashtra Minority Affairs and Skill Development Minister Nawab Malik’s allegations that the raid conducted on the luxury cruise liner on October 2 was ‘fake’ and the department found no drugs during the raid. Nawab Malik claimed that BJP has misused the central agency to frame Aryan Khan.

He had also asserted that a BJP person was accompanying the NCB team during the raid. Nawab Malik had levelled these allegations on Wednesday, October 6.

“Aryan Khan’s arrest is a forgery. For the last one month, information was being circulated to crime reporters that the next target is actor Shah Rukh Khan,” said Malik.

Nawab Malik’s son-in-law arrested in drug case

It may be recalled that the Narcotics Control Bureau (NCB) had on July 10, submitted a 1,000-page charge sheet against Nawab Malik’s son-in-law Sameer Khan for procuring, purchasing, transporting, and distributing drugs. Sameer Khan was arrested for possession of drugs on January 13th this year.

Nearly nine months after he was arrested in connection with a drugs case, a special court had granted bail to Sameer Khan on September 27.

Amidst all the brouhaha around the arrest of Bollywood megastar Shahrukh Khan’s son in the drug case, the NCB is likely to seek an extension in the custody of Aryan Khan, media reports suggest.

According to a report by Times Now, the NCB’s decision follows the arrest of a foreign national from Bandra by the NCB late Wednesday night. He was found with a commercial quantity of mephedrone (MD), according to reports.

Aryan Khan drug case

On Sunday, October 3, Aryan Khan, Arbaaz Merchant and many other people were detained from a luxury cruise liner where a rave party was going on. As per reports, cocaine MD, charas and MDMA pills were found on Khan and others with him.

Khan has been remanded to NCB custody till the 7th of October. Arbaz Seth Merchant and Munmun Dhamecha have also been sent to NCB custody along with Aryan.

On Thursday, an ABP journalist took to Twitter to inform the public that Congress has informed journalists about Priyanka Gandhi Vadra fasting for Navratri this year.

Journalist Pankaj Jha said that the Congress party has sent out information to journalists that Priyanka Gandhi Vadra would be fasting for Navratri.

It is interesting that something as usual as fasting for Navratri has been broadcast as a press statement to journalists. With the Uttar Pradesh Elections coming up, it would appear that the Congress party is attempting to turn into seasonal Hindus again right ahead of assembly elections.

Rahul and Priyanka Gandhi: Seasonal Hindus right before elections

The Gandhis, especially Rahul Gandhi-Priyanka Gandhi Vadra duo have a penchant for turning into Hindus right before elections to garner Hindu votes. Ahead of the 2019 elections. Rahul Gandhi had suddenly declared that he was a “Janeu Dhari Hindu”. At that time, incidentally, an old video of Rahul Gandhi had also gone viral where Rahul was seen doing Ganga puja and being nonchalant about it.

In the video, Rahul Gandhi is offering puja, in a crisp white Kurta, the hallmark of every serious Indian politician. Later, the friendly NDTV journalist asks him what he was praying for. In a nonchalant tone that has become synonymous with Rahul Gandhi, he said, “I don’t know, they asked me to be here, so I am here”. In the background, one could hear loud chants of ‘Rahul bhaiya zindabad”.

Rahul Gandhi in this clip dons the role of the quintessential Bharatiya, with the tilak on his head and arms folded, closes his eyes and performs puja in the backdrop of the soothing mantras. He tries extremely hard to ensure that the country, which is still a Hindu majority country despite the best attempts of his family, sees him as his own.

However, his uncaring attitude while the puja was being offered gives him away as someone who is only pretending to be a pious Hindu for the sake of votes and public image.

Before that, in 2017, Rahul Gandhi had gone on a temple run right ahead of Gujarat State Elections. However, soon he got into trouble after social media erupted with reports of him declaring himself a non-Hindu before taking the Darshan of the famous Somnath Temple. Later Congress decided to clarify this ‘gaffe’ by causing extra confusion and later took things to the next level by calling Rahul a “Janeu dhaari Hindu”. This assertion by Congress was questioned by social media users who hinted towards a possible catholic origin of the politician.

Congress’ latest attempt to send a ‘press note’ about Priyanka Gandhi Vadra observing a fast for Navratri seems to be the party’s latest attempt to protect themselves as faux Hindus ahead of the Uttar Pradesh Elections.

While the Congress is sporting their faux Hindu credentials, interestingly, only recently, the Congress was distributing their manifesto in Mosques on Fridays. The minority cell of UP Congress had decided to distribute its Sankalp Patra among Muslims in front of 8432 mosques in UP on Fridays.

Uttar Pradesh Congress Committee’s (UPCC) minority department has started the process of distributing a 16-point manifesto in front of mosques containing promises to be made to the minorities in the upcoming 2022 UP assembly election.

Some of the important features mentioned in the manifesto include a promise to open tanneries shut down during the Samajwadi Party rule, a judicial investigation into the riots that happened when Akhilesh Yadav was the Chief Minister and also the setting up of Mathur Commission if anyone is found guilty.

This initiative of distributing manifesto outside mosques by the minority department of the Uttar Pradesh Congress Committee is consistent with Congress Party’s preferential policy towards the Muslims as highlighted by the former Prime Minister of India Manmohan Singh when he had said that Muslims must have the first claim on resources.

During the 52nd meeting of the National Development Council, Manmohan Singh had said “We will have to devise innovative plans to ensure that minorities, particularly the Muslim minority, are empowered to share equitably the fruits of development. These must have the first claim on resources,”

‘Going to Church or displaying Holy Cross cannot be ground to cancel SC certificate’: Madras HC

Quashing the cancellation order released by a scrutiny committee to scrap the Scheduled Caste certificate of a woman, the Madurai Bench of Madras High Court observed that merely following Christian practices cannot be the ground to cancel the caste certificate. 

Calling it a bureaucratic narrow-mindedness, the bench further advised the committee to deal with such matters with a broad mindset in the future.

Details of the petition and hearing

The petition was filed in 2016 by P Muneeswari, a doctor from Ramanathapuram, seeking to quash a 2013 order passed by the district collector cancelling her community certificate.

Muneeswari was born to Hindu pallan (a Scheduled Caste) parents. She later married a Christian and decided to bring up her children as members of the Christian community. 

While hearing her petition, a Division Bench comprising Chief Justice Sanjib Banerjee and Justice M Duraiswamy criticized the committee for assuming that she converted to Christianity by seeing a few symbols. 

“There is no suggestion in the affidavit that she has abandoned her faith or that she has embraced Christianity. It is possible that the petitioner accompanied her husband and children for Sunday matins, but the mere fact that a person goes to church does not mean she abandoned the faith born into,” observed the Chief Justice. 

“Nothing may be presumed upon a member of a particular community respecting another community or another religion and, indeed, that is the Constitutional mandate and not otherwise,” the Bench remarked further. 

Reportedly, the committee had submitted that the officials who visited her clinic, found a Holy Cross hanging on the wall. Basis this the officials insinuated that she had converted to Christianity and was, thus, disqualified from retaining the Hindu pallan community certificate. 

Observing that the action taken by authorities was based on assumptions, the judges quashed the order passed by the district collector. 

The authorities have also been directed to restore the certificate originally issued in favour of Muneeswari with immediate effect. 

Benefits of centrally sponsored schemes for SCs can’t be given to Converted Christians

Meanwhile, the Central government in the month of August, in response to a question in the Parliament had clarified that no person who professes a religion different from the Hindu, Sikh or Buddhist shall be deemed to be a member of a Scheduled Caste. 

As such, the benefits of Centrally Sponsored Schemes (CSS) meant for the welfare and development of Scheduled Castes can not be extended to Converted Christians from Scheduled Castes.

According to reports from Andhra Pradesh, an estimated 80 per cent of Christian converts were from the SCs and were enjoying the benefits which include allotment of land/house, free electricity, and loans that are intended to benefit Hindu SCs.

UP Govt constitutes Commission of Enquiry with HQ at Lakhimpur Kheri to investigate the violence that left 8 persons dead

On October 6, the Uttar Pradesh government constituted a single-member Commission of Enquiry with headquarters at Lakhimpur Kheri to investigate the death of eight persons during the violence on Sunday (October 3).

The Commission has been constituted by the orders of the Governor under the provisions of Clause (3) of Article 348 of the Constitution of India. The order says that the Governor opined that an enquiry is necessary in the case of the series of events that led to the death of eight persons in the Lakhimpur Kheri District on October 3.

Justice Pradeep Kumar Srivastava (Retd.) of Allahabad High Court has been appointed as the lone member of the Commission to probe the matter as per section 3 of the Commissions of enquiry Act, 1952(Act no. 60 of 1952). Section 3 gives the power to constitute a commission by notification in the Official Gazette for the purpose of making an inquiry into any definite matter of public importance.

The Commission would submit its report within two months from the date of its constitution. The Government of Uttar Pradesh holds power to change the tenure of the Commission if required.

What happened in Lakhimpur Kheri on October 3?

On October 3, eight people lost their lives, including three BJP members in Lakhimpur Kheri, Uttar Pradesh, after protesting ‘farmers’ turned violent. They pelted stones on the BJP convoy. Social media was full of reports that BJP leader Ajay Mishra’s son mowed down farmers. However, more details emerged later that stated Ajay Mishra’s son Ashish Mishra was not present on the ground at the time of the incident.

As more videos emerged on Sunday and Monday, it was seen that the vehicle was attacked and damaged already when it ran over the protestors. One video showed farmers threatening a man in a white shirt to say that he was sent by Mishra to kill the farmers. He died soon after. The man was identified as Shyam Sunder Nishad. He was brutally lynched by the protestors at the site.

BJP worker Shubham Mishra and his driver Hariom Mishra were also lynched to death at the site by the so-called ‘farmers’. Shubham’s father said in his complaint that Shubham’s gold chain, mobile and wallet were stolen by the protesters who had killed him. He also named Tajinder Singh Virk of Samajwadi Party and Kisan Union leader one of the foremost perpetrators. The government has announced 45 lakh compensation and a government job to the kin of all who had died in the incident.

‘They were instigating to turn the vehicle upside-down’, brother of BJP worker speaks to OpIndia, tells how protesting ‘farmers’ killed him

BJP worker Shyam Sunder Nishad was one of the eight people who were killed in the Lakhimpur Kheri violence on October 3. Since the violent crash, Nishad’s video has gone viral on all platforms. It is so shocking and heartbreaking that no one is able to forget it. His face was covered in blood and one could see the fear of impending death in his eyes. He was stunned and under the immense pressure of the furious crowd. The situation was evident in the video.

Nishad was seen begging for his life in the video. However, the barbaric mob was hell-bent, forcing him to say that he was sent by BJP leader Teni to crush the farmers. It was clear that the mob was forcing him to speak against the political party, but Nishad refused to budge in.

Shyam did say that Teni sent him, but as soon as he denied the allegations that Teni asked him to crush the protesters, the mob started to charge at him. He joined his hands and urged them to leave him while saying ‘Dada Dada chhod do‘ (please leave me). After that, his dead body was found. One can only imagine his condition while he was being lynched. How frightened he would have been when the mob was beating him to death. Some reports suggest that he was hit on his throat and face in such a way that he died on the spot. His dead body was later thrown in the field. The police recovered the body in the evening and sent it for post mortem.

There are two stories ruling the media at the moment. On one side of the story, the mob of protesters is being held responsible for the violence, while on the other side of the story, BJP leader’s vehicle became the reason for the violence. The public is trying to judge the situation based on selective videos. Amidst all the speculations, judgements, politics and propaganda, OpIndia reached out to Sanjay Nishad, brother of the slain BJP worker to bring out his side of story.

Sanjay refuses to believe that the people who were forcing his brother to say something against BJP were farmers. He called them executioners. He said if those were farmers, they would not have done such horrendous acts.

Sanjay Nishad, brother of deceased BJP leader Shyam Sundar Nishad speaks to OpIndia

Sanjay Nishad is the brother of the late Shyam Sundar Nishad. He lives in Singha Kala Village that falls under the Singhahi Police Station area. He said, “My brother was a BJP Mandal minister. Wrestling matches have been happening at the village of Minister of Home Affairs (State) for a long time. This year, the matches were scheduled for October 2 and October 3. Keshav Prasad Maurya was scheduled to come for the matches. My brother was sent to receive him. The mob was gathered there. They killed him. Everyone was trying to force him to say that Teni had sent him to cause the accident. My brother told them that Teni did send him but not to kill anyone. He was sent to receive Maurya.”

Sanjay further added that the same people were the first to create nuisance and pelted stones on the glass of the car. It caused an imbalance leading to the accident. According to him, he got the information of his brother’s death via message. At that time, he was in Uttarakhand and could not attend his brother’s funeral. He said, “My family members came to know about the incident via video that they received on WhatsApp. There was a hue and cry that their son was killed. I somehow got the news at around 5:30 PM. The person said that my brother had been killed. I did not believe him. But when I saw the video, I was convinced that it really happened.”

Sanjay wanted to come for his brother’s funeral, but the bus from Uttarakhand got cancelled. He said, “I have seen my brother’s last video. I have also seen the video in which everyone was saying, ‘turn the vehicle, turn the vehicle’. After that, my brother died. But he never lied that Teni sent him to kill anyone. He told them the truth that he was there to receive Keshav Prasad Maurya.”

While Sanjay was speaking to OpIndia, the government officials paid him a visit to offer condolences and speak about the compensation. He said, “I had to disconnect the call during the conversation. The village head, Lekhpal and Patwari, had come along with the police. I got the compensation of Rs 45 lakh. They also promised a government job.”

Sanjay further said that Shyam used to fulfil all the financial needs of the family. He got his sisters married and later himself got married too. He is survived by his wife and two daughters, who are now all alone. Sanjay added that his brother had been going for the wrestling matches since over 15-20 years. He got a small post at first but later got promoted and became General Secretary, Mandal Minister.

When asked about the violent protests by the alleged farmers, Sanjay said that there were many people. They had blocked the roads. Sanjay also informed us that Rahul Gandhi was scheduled to visit his house as he was visiting Lakhimpur. However, it is not yet clear whether Rahul Gandhi indeed visited the slain BJP worker.

Recalling the face of his deceased brother, Sanjay said, “The government cannot bring my brother back. He begged for his life with folded hands, but he was not spared. They were not farmers. They were executioners. We got the compensation, but I will tell the media again and again that they were executioners. If they were farmers, why did they kill my brother? I am a farmer too….”

Congress leader justifies mob lynching of BJP workers in Lakhimpur Kheri, another says ‘let BJP leaders die, we will give 1 crore’

Politics around Lakhimpur Kheri violence is on a rise with the opposition fueling unrest by making controversial and misleading comments. In one such attempt, Congress leader Kamru Choudhary in a debate on Times Now justified the brutal mob lynching of Bharatiya Janta Party (BJP) workers, branding them as ‘murderers’ who deserved it. 

Choudhary in a rather appalling statement declared the BJP workers as criminals and said, “They do not deserve any sympathy or compensation.”

Anchor Padmaja Joshi then goes on to ask the legitimacy of Choudhary’s claim considering an investigation into the Lakhimpur Kheri violence is underway. 

Choudhary hitting back at Joshi for shielding ‘criminals’ reiterated that the dead opponents should not be liable for any compensation for ramming their car into ‘innocent farmers’.

When asked on what basis did he declare them criminals, Choudhary says, “You want me to call the murderers as gardeners who had come to plant lotus flowers?” 

Choudhary’s shocking support for ‘lynching’ and ‘mob justice’ further led to arguments in the News Hour debate. Moreover, Choudhury has retweeted snippets of the debate where he justifies the brutal lynching of BJP workers.

This is not the only Congress leader to politicize the incident. 

“Let BJP workers die, Congress will give compensation”

As per a Times Now report, Congress leader Amaregouda Patil Bayyapur from Karnataka’s Koppal district declared that ‘let BJP workers die and Congress party will give them a compensation of Rs 1 crore.’

“Today, the UP government has announced a sum of Rs. 45 lacs as ex-gratia. Let the BJP workers die, we will announce a sum of 1 crore as ex-gratia from the Congress Party Fund,” he was heard saying insinuating a possibility of such deaths in the future as well.

Bayyapur’s remark has sparked a controversy on social media.

Every attempt is being made by the opposition and the Congress-friendly media to derail and misguide the public opinion about Lakhimpur Kheri violence. Cropped videos, misleading headlines and political gimmicks are all that one can see from the opposition to milk the tragedy. 

Lakhimpur Kheri: Family members of deceased farmer appeal to politicians not to take political mileage out of the deaths

As ‘no to your fake sympathies’ posters greeted Rahul Gandhi in Lucknow during his much-hyped political tourism to Lakhimpur Kheri to meet families of deceased farmers, family members of the victims have requested Rahul and the opposition not to politicize the issue.

Lovepreet Singh was among the protesters who lost his life during the protest. His family members have appealed that they don’t want to be disturbed. They have further said that those who are trying to get political mileage out of the incident should refrain from doing so. They expressed satisfaction over support extended by the Yogi Adityanath government including financial ones. They further supported the stand taken by Samyukta Kisan Morcha (SKM) to resolve the crisis.     

Eight persons had died including four farmers on Sunday during farmers’ protest at Tikunia in Lakhimpur Kheri district of Uttar Pradesh.  

In a video featuring family members as well co-villagers of Lovepreet Singh, one of the family members Makkhan Singh is heard stating the above. Makkhan Singh who introduced himself as the brother-in-law of the deceased said that Lovepreet Singh died during farmers protest.

“We support the stand taken by Samyukta Kisan Morcha on this issue. We are also thankful to the government and the administration for extending all kind of support including financial assistance,” he said.

He further appealed not to politicize this issue and said, “such elements who want to get political gain during such a painful time we request them not to do such a thing and also don’t disturb others.” In the video, as many as six people are seen standing together. One of them is Keval Singh whom Makkhan Singh has introduced as an uncle of the deceased whereas as rest were introduced as Ladi, Sukkha and Bahadur Singh from their village.

Right after the violence, the Yogi government had announced a judicial inquiry under a retired High Court judge. Besides, the government announced a compensation of Rs 45 lakh to the family of deceased farmers and a job to a member of the family.

The statement of the family members seems to reflect the mood of farmers that the Congress and its twin boss Rahul Gandhi and Priyanka Gandhi Vadra can’t be trusted.

However, Congress left no stone unturned to vitiate the atmosphere in the poll-bound Uttar Pradesh. Party’s national general secretary Priyanka Gandhi Vadra tried accelerating the trouble. She was detained for some time, while the state government initially denied permission to Rahul Gandhi to visit Lakhimpur Kheri. But later on, the permission was granted and Priyanka Gandhi was released.

Tej Pratap Yadav expelled himself from party, has floated own political outfit, says RJD leader Shivanand Tiwari

All is not well it seems in the Lalu Prasad Yadav household as as per latest reports, his eldest son Tej Pratap Yadav is no longer associated with the Rashtriya Janata Dal (RJD). The information was given by RJD leader Shivanand Tiwari. He also informed that Tej Pratap Yadav also does not have permission to use the party election symbol lantern.

The news comes on toes of reports that Tej Pratap Yadav and his brother Tejashwi Yadav are not getting long well. Amidst this, it has been reported that Tej Pratap Yadav has been shown the exit door. That means it is likely that Tejashwi Yadav will inherit the party from his father, Lalu Prasad Yadav.

Shivanand Tiwari said that there was no need to expel Tej Pratap Yadav as he expelled himself when he floated his own political party. Often referred as maverick and mercuric Tej Pratap always alleged that a negative perception was created against him and he was deliberately kept away from his father. He had also threatened to file ‘PIL’ against journalists for ‘ruining his reputation.

Tej Pratap Yadav has recently launched his own political outfit Chhatra Janshakti Parishad, which is parallel to RJD’s students’ wing, Chhatra RJD. Last month, he launched Chhatra Janshakti Parishad and declared himself the President. He had however claimed it would be part of RJD only. As the time of this report, very little information is available on the party’s official website.

Tej Pratap Yadav had recently alleged that his father was being held hostage in Delhi by those who are dreaming of becoming RJD head. While he did not take any names, many believed this was a veiled attack on his brother, Tejashwi Yadav, who later reacted to the allegations as well. Tejashwi had stated that the man who has been chief minister of Bihar could not be held hostage. It is imperative to note that Lalu Yadav is convicted in fodder scam and is serving jail term.

That the two brothers do not get along too well is not a secret anymore.

Ahead of 2019 general elections, Tej Pratap had launched his own political party ‘Lalu Rabri Morcha’ where he had said he would contest as independent candidate. Prior to that, in June 2018, he had asserted that he would quit politics, only to change his decision in a matter of hours and ended up blaming the RSS for reports of a rift with Tejaswi. Later, in October that year, his sister Misa Bharti, Lalu’s daughter, had also confirmed the rift between the two brothers only to call it a ‘media twist’ later.

Over time, Tej Pratap had made a habit of attracting media attention, although for rather unusual reasons. His marital life has been going through a rough patch as well and he can be often seen at various places dressed up in colorful attire. After 2019 elections were over, he had given himself a monicker ‘Dusra Lalu‘ and had declared himself as Lord Krishna equivalent to Tejashwi (who was the Arjun) and he would slain anyone who comes to destroy him with a Sudarshan Chakra.

Trolls attack PM Modi for standing while Rakesh Jhunjhunwala was sitting, here is how they’re being ignorant

Business magnate and ace investor Rakesh Jhunjhunwala and his wife Rekha Jhunjhunwala met prime minister Narendra Modi on Tuesday in New Delhi. PM Modi had posted a photograph of the three on Twitter saying that he was ‘Delighted to meet the one and only Rakesh Jhunjhunwala…lively, insightful and very bullish on India.’

However, another photograph of the meeting had emerged on social media which attracted criticism from some Congress workers and trolls on Twitter. In this photo, Rakesh Jhunjhunwala was sitting on a chair behind a table, while PM Modi and Rekha Jhunjhunwala were standing in front of him. While supporters of Modi praised him for his humility, critics slammed the PM for ‘bowing down in front of a broker’. Congress leaders and workers, anti-BJP ‘journalists’ and ordinary trolls joined this attack on PM Modi.

Youth Congress president Srinivas BV posted the image inviting his followers on Twitter to caption the same.

Later he posted another tweet.

Similar views were expressed by many saying that the PM was allowing Jhunjhunwala to sit while he was standing because of the wealth of Jhunjhunwala.

Allahabad HC orders removal of illegal mosque, mazar from historic Chandrashekhar Azad Park in Prayagraj

The Allahabad High Court has ordered the immediate removal of a mosque and a mazar illegally constructed inside the Chandrashekhar Azad Park at Prayagraj in Uttar Pradesh. We want the park free of all encroachments,” the Court said in its order while hearing a petition filed by petitioner Jitender Singh.

While passing the order, a Division Bench of Acting Chief Justice Munishwar Nath Bhandari and Justice Piyush Agarwal directed all illegal encroachments on this historic park that came up after 1975 must be removed within two days. The court further directed the Prayagraj district administration to submit a compliance report by October 8. This judgment will save the historic Chandrashekhar Azad Park (Alfred Park) where revolutionary freedom fighter Chandrashekhar Azad had last engaged the British government in a gun battle and sacrificed his life for the nation on 27 February 1931 when he was only 24 years old.

The petitioner had moved the petition through the senior advocate Hari Shankar Jain and brought the matter of the encroachment of this park to the notice of the court. He stated that the existence of this park is under threat as some members of the Muslim community have illegally constructed artificial graves and they are trying to convert a structure into a mosque. In this way, they want to convert the park into a graveyard and mosque, the petition had stated.

The members of Muslim community in their usual manner of capturing the land for their religious purposes are trying to construct a mosque within the park area and some artificial mazaars (grave yards) have been created at the instance of fundamentalists and the patronage of Waqf Board,” the petitioner had said. The Petitioner also stated that no part of this park ever remained the property of the Waqt Board.

“That it is relevant to mention that no part of the park has ever been used as Waqf property either for the purposes of buying the dead, dargaah or mazar and no mosque was ever constructed or had been in existence in any manner. Even today no mosque is in existence. A building illegally raised is being tried to be converted into a mosque,” the petitioner had said. The petitioner had also submitted photographs of those illegal constructions.

The petitioner pointed out that this is not only the violation of the ‘UP Parks Playgrounds and Open Spaces Act, 1975’ but a place of historical importance is under threat. He made references to the Allahabad Master Plan, 1967-1991 which mentions Azad Park as the most important city park, having historical importance. The petitioner further said that on previous occasions also the court had ordered the demolition of illegal structures in this park spread over 133 acres. He made reference to a similar petition by one Arun Kumar Civil Misc. 19296/1986 in which the court had issued suitable order.
