Kolkata Rape and Murder: CBI says crime scene was altered, body cremated before registering FIR, Supreme Court questions lapses by Police including long delay in recording the case

The CBI has made several shocking revelations in its status report on the rape and murder of a trainee doctor at RG Kar Medical College and Hospital in Kolkata. The probe agency, along with Kolkata Police, submitted their respective status reports to the Supreme Court, as the apex court is hearing the matter.

CBI has alleged that the crime scene was altered and tampered with before the case was handed over by Kolkata Police, there was long delay between discovery of the crime and registration of the case, the FIR was registered after the body was cremated, and there an attempt to cover up the case. The CBI also mentioned that the family was initially told that it was a suicide, as already revealed.

The Solicitor General representing the CBI told the court that the FIR was registered at 11:45 PM, after the body of the victim woman was cremated. He added that CBI has not been handed over the medical report of the injury of the accused, saying the agency was not told that such a report exists. The SG said that after the discovery of the body, senior doctors and colleagues of the victim asked for videography, which means even they felt there was a cover-up.

Chief Justice DY Chandrachud noted the timeline of the events, and said that one aspect is extremely disturbing, the long delay in registering the case. He noted that the General Diary entry of the death was recorded at 10:10 AM as per police records, but securing of the crime scene, the seizures etc was done at 11:30 at night.

Justice Mishra noted that while autopsy was conducted on evening hours, the general diary entry of unnatural death was recorded after that, at 11:30 PM. Kapil Sibal representing Kolkata Police said that the post mortem examination was done from 6:10 PM to 7:10 PM.

The CJI read out the timeline of the events on 9th August, which started at 10:10 am with the recording of the general diary based on a phone call received that a PG lady doctor was found unconscious at 3rd floor. The medical board verbally opined that death was due to strangulation, with the possibility of sexual assault. Then the post mortem was done at 6-7 PM, after which the police started investigation. Then, unnatural death was recoded at 11:30 PM and the FIR was registered at 11:45 PM. The CJI noted that a blue jeans was found on the dias.

Justice Pardiwala said that when it was decided to conduct Post Mortem, it means that this is a case of unnatural death. Because post mortem test is not done for natural deaths. But despite that, unnatural death was recorded hours after post mortem, at 11:20 PM and FIR was registered at 11:45 PM. He said that this is very surprising, because post mortem is done after recording unnatural death.

However, Kapil Sibal claimed that the unnatural death case was registered at 1:46 PM. But the court noted that this is not mentioned in the report. The court said that even 1:46 PM is very late, given that the body was discovered in the morning itself. When the timeline mentioned by Sibal didn’t match with the records, the court wondered what document he was referring to. The court asked the presence of a responsible police officer in the next hearing to avoid such mismatches.

Kapil Sibal claimed that the recorded 11:30 PM is the time the police officer reached the police station after conducting the procedures, but the court refused to accept that. The CJI said that if the case was registered after the police returned to the police station after the post-mortem was done and body was handed over to the family, how the inquest report prepared in the afternoon refer to the unnatural death report.

Justice Pardiwala said that he has not come across such a case in 30 years, where there is such a long delay in recording a case after discovery of a dead body with clear signs of unnatural death. He also noted that the conduct of the Assistant Superintendent of Police is also very doubtful.

When Sibal referred to a report showing that the general diary entry for unnatural death was recorded at 1:45 PM, not 11:30 PM, the court said it looks doubtful. Justice Pardiwala said that it looks like it was inserted into the records later, and asked the CBI to look into it.

Both the CBI and the court agreed that the case was registered at 11:30 PM, not in the afternoon as claimed by Kolkata Police.

Apart from questioning the lapses in handling the case, the court also questioned the role of police during the vandalism of the RG Kar Medical College and Hospital.

On Wednesday, August 21, an FIR has been filed against a Trinamool Congress (TMC) worker at the Bolpur police station in Birbhum district for the rape and torture of a married woman. Following the incident, the accused, Firoz Khan, has gone into hiding.

Khan, a resident of Karimpur in the Bahiri Panchchoa Gram Panchayat area, is alleged to have forcibly abducted the married woman at gunpoint and taken her to his cowshed, where he tied her hands and legs and raped her.

The accused allegedly tortured the victim by inserting a gun into her genitals. He also took pictures of the victim during the assault. Her four-year-old son, looking for his mother, arrived at the cowshed. Upon seeing her in that condition he started to cry and shout. The accused TMC worker threatened him and tied him up in a gunny bag.

In the video, the victim recounts that the accused, Firoz Khan, had been harassing her for several days. He made advances and offered her money to be with him. When she rejected his proposal, he threatened to kill her by holding a gun to her head. On the day of the incident, she went to get water. Khan found her alone and forcibly took her to a secluded location at gunpoint, where he raped her. She also said that he attempted to kill her son by tying him up in a sack.

After the assault, the victim was admitted to the Bolpur District Hospital.

According to police, the victim was hesitant to report the incident for several days out of fear of public shame. Ultimately, her husband encouraged her to file a complaint against the accused. An FIR was registered at Bolpur police station based on the victim’s and her husband’s complaint, and the police are actively searching for Khan. Investigations began after recording the victim and her husband’s statement on Wednesday, August 21.

This incident has sparked significant public outrage in Bolpur, especially in light of the recent murder of a trainee female doctor at Kolkata’s RG Kar Hospital.

The victim claimed that Khan had been threatening her for some time to engage in an illicit relationship.

On Saturday afternoon, Khan allegedly kidnapped the woman at gunpoint. He took her to his cowshed, where he raped her; and reportedly tied her 4-year-old toddler in a sack during the assault.

Following the incident, the victim attempted to commit suicide. The police are conducting raids on Khan’s residence and other potential hiding places.

Bangladesh interim government decides to revoke diplomatic passports of Sheikh Hasina and other Awami League leaders

The interim government of Bangladesh has decided to revoke all diplomatic passports, including the one that previous Prime Minister Sheikh Hasina used to leave the country for India on August 5th, after weeks of violent protests in Bangladesh. 

The revocation of diplomatic or red passports, which are granted to government officials, ministers, and members of parliament, was announced by the Ministry of Home Affairs on Wednesday, 21st August. 

As per the reports, the decision has been taken because of the tense relations that have arisen between the two South Asian neighbors as a result of Hasina’s stay in India. “We have already directed the Department of Immigration and Passports. An official order will be issued soon,” Md Mashiur Rahman, senior secretary of the Security Services Division of the Ministry of Home Affairs was quoted as saying.

He continued, “Their red passports will be revoked as parliament has been abolished and ministers and lawmakers are no longer in their positions.”

Ministers and legislators will need to surrender their passports and apply for ordinary ones, once canceled. To obtain regular passports, those who have been arrested or have criminal cases filed against them must go through the legal process.

The number of people in the nation who carry red passports is unknown, according to the authorities. Further, according to the Home Ministry, only people whose time in government has concluded will have their red passports revoked. This would include former Prime Minister Hasina, who on August 5th resigned and escaped to India amid the political chaos in the country.

According to a memorandum of agreement between Bangladesh and India, diplomatic and official passport holders from both nations are allowed to stay for 45 days without a visa.

In the Bareilly district of Uttar Pradesh, a Muslim woman named Hina Bi flipped from her stand after reverting to Hindu Dharma and marrying a Hindu youth on 11th July. Hina has accused the priest who performed her marriage to her Hindu partner of pushing her to do gharwapsi. Meanwhile, Hina Bi’s Hindu husband has alleged that Hina and her family forced him to convert to Islam.

On 9th July this year, Hina Bi voluntarily reverted to Hinduism and changed her name to Priyanka Gupta. She had even shown her affidavit to Mahant Pandit KK Shankhdhar of Agastya Muni Ashram in Bareilly. After verifying the affidavit Pandit KK Shankhdhar got Hina married to her Hindu boyfriend Prem Shankar Gupta as per the Vedic rituals.

Hina, a Pilibhit resident, filed a complaint with Bareilly police around a month and a half after their marriage, alleging Pandit Shankhdhar of forcing her to embrace Hinduism. Hina has also accused her husband, Prem Shankar Gupta, and her brother-in-law of tricking her into marriage.

Several Islamist and leftist social media handles echoed Hina’s allegations. However, the matter has taken a new turn as Prem Shankar Gupta accused his wife Hina Bi of converting him from Hinduism to Islam. Prem Shankar has also filed a complaint letter with the Bareilly Police. The Hindu youth has also submitted evidence to the police on this matter.

OpIndia examined the details of the matter wherein Hina married Prem Shankar Gupta on 11th July 2024 after performing “ghar wapsi”. She had given an affidavit on stamp paper stating that she was an adult and that there was no pressure on her to change her religion.

After 15th August, Hina, who had gladly identified herself as Priyanka a month and a half ago, suddenly altered her claims, including the affidavit she had signed. Hina filed a complaint with the Bareilly police, alleging that Prem Shankar Gupta and his brother had ‘trapped’ her by claiming to be Muslims. Following that, she targeted Pandit KK Shankhdhar.

In her complaint, Hina claims that Pandit KK Shankhdhar forced her to revert to Hinduism by holding a knife to her neck. Bareilly police have launched an investigation after receiving Hina’s complaint. Even before the police revealed the findings of the investigation, Islamist X users like Zakir Ali and Wasim Akram, who go by the surname Tyagi, blamed Pandit KK Shankhdhar and Prem Shankar Gupta.

While Hina’s complaint is being investigated, Prem Shankar has also submitted a complaint to Bareilly SSP. In his complaint, Prem has said that a week after the marriage, Hina fabricated a false story that her father had consumed poison and took him home with her. There, Hina’s family members trapped Prem in an emotional manipulation game by talking about defamation and pressured him to marry Hina again according to Islamic customs.

When Prem Shankar refused, he was taken to Shahji’s shrine on 18th July with a gun pointed at his head. Inside the shrine, he was forced to perform Nikah with Hina. Moreover, Prem Shankar was made to sign on pre-prepared documents in which he was declared a Muslim. After this Hina created so much trouble in Prem Shankar’s house that Prem had to leave his family.

Meanwhile, Hina contacted a Maulvi and attempted to forcefully circumcise her husband. In addition, preparations were made to change details on Prem Shankar’s Aadhaar card. Prem Shankar Gupta eventually escaped Hina’s house on the 12th of August. While Gupta managed to escape, the incident left a profound impact on his mind.

While escaping, Prem Shankar sent Hina an audio message in which he talked about committing suicide. Meanwhile, Prem Shankar’s family became frustrated and filed a complaint at the Sitarganj police station. Sitarganj police arrived at Hina’s house and enquired about Prem Shankar. However, by then, Prem Shankar had fled and returned to his home in Bareilly.

Prem Shankar’s complaint expresses concern that Hina’s family is planning to kill her by crushing him using a vehicle. Prem Shankar stated that all of this is being done at the behest of a Muslim leader. The victim has asked the police to protect him and his family. Along with this, he has demanded stringent action against Maulvis who are involved in converting people to Islam.

Following Hina’s complaints and those made by her husband Prem Shankar, the Bareilly Police Department is conducting an extensive investigation into the matter. Efforts are on to examine the veracity of claims made in both the complaints.

Speaking to OpIndia, KK Shankhdhar, the head priest of Agastya Muni Ashram, who was accused in Hina’s complaint said that some Islamists of Bareilly are trying to mislead Hina for their own interests and spoil the communal harmony. The Pandit also said that he has all the evidence that will prove that the accusations made in Hina’s complaint are false and baseless.

Shankhdhar said that he had submitted the videos and images of Hina and Prem’s wedding to the police. In the wedding video, Hina is seen happy after her marriage which show that she was neither forced nor a knife was kept on her neck to make her marry the Hindu youth. He shared some of the videos of the wedding with OpIndia. Shankhdhar also pointed out that a Police officer’s gunner was also present during the couple’s wedding.

Furthermore, Shankhdhar questioned whether he could threaten someone by putting a knife on her neck in front of a policeman and the girl could look happy in the photo and video. The Agastya Muni Ashram Mahant emphasised that he had complete faith in God adding that he is exploring his legal options against those peddling false and malicious narratives against him.

Punjab police arrest Congress Sarpanch Kulbir Singh after woman alleges he raped and threatened her at gunpoint

On Wednesday, August 21, a woman levelled rape charges against current Congress Sarpanch Kulbir Singh in Gurdaspur, Punjab. She alleged that the Congress Sarpanch raped and threatened her at gunpoint. Based on the victim’s statement, the Punjab police registered a case and arrested the Congress leader.

In a video shared by IANS, the woman is heard stating that she had a financial loan transaction with someone, which led her to seek assistance from Sarpanch Kulbir Singh at his office in Prem Nagar, where Singh allegedly raped and threatened her at gunpoint.

“I had a money loan transaction with someone, for which I went to Sarpanch Kulbir Singh at his office in Prem Nagar for help. The Sarpanch raped her at gunpoint and threatened me…” the victim was quoted as saying by IANS.

In this context, female police officer Raman Lata stated that, based on the victims’ statements, a case has been registered, the sarpanch has been arrested, and the woman has undergone a medical examination. She added that the accused sarpanch will be presented in court, and further legal action will be pursued against him.

‘They said we are in shock’: Kapil Sibal defends Mamata Govt over lapses in probe in RG Kar case, shifts blame on the deceased doctor’s parents

On Tuesday, August 20th, the Supreme Court’s three-judge bench, headed by Chief Justice DY Chandrachud, strongly criticized the Mamata Banerjee government and the authorities at the government-run hospital for its handling of the investigation into the RG Kar rape and murder case. During the proceedings, senior advocate Kapil Sibal, representing the state, was observed shifting the responsibility for the delay in filing the FIR onto the destitute parents of the deceased doctor.

During the proceedings, the bench criticized the state for the delay in filing the FIR. CJI asked why the FIR was not registered until 11:45 pm though the victim’s body was handed over to the parents at 8:30 pm. CJI questioned why the FIR was filed 3.15 hours after the body was handed over. 

Sibal quickly responded by claiming that the delay occurred because the deceased victim’s father refused to file the complaint.

In a recorded video of the Supreme Court proceedings shared by Lawbeat on X, the senior advocate is heard conveniently placing the blame for the delay in the investigation—which should primarily be the responsibility of the state government—onto the father of the deceased doctor.

“This is the problem, they said we are in shock. Do whatever you want to do,” Sibal is heard saying at around 1.44-minutes in the video.

CJI Chandrachud asked Sibal, “What were the principal, and the hospital board, doing during this time?” He said was not it the hospital’s duty to file the FIR, especially in the absence of the victim’s parents.

The Chief Justice further remarked, “It appears the crime was discovered in the morning. The hospital’s principal attempted to dismiss it as a suicide, and the parents were not permitted to see the body. No FIR was filed.”

The Chief Justice also pointed out that despite the Calcutta High Court’s directive to the West Bengal Health Department not to reappoint Sandip Ghosh, the principal of RG Kar Medical College and Hospital, to any other medical college until further notice, Ghosh was reassigned as the principal of another college soon after his resignation.

The Supreme Court, which on Tuesday started the suo motu petition, also raised concerns about the vandalism incident at the RG Kar Medical College and slammed the state government for its failure to handle the issue of vandalism at the hospital. “We are unable to comprehend how the state was not able to handle the issue of vandalism at the hospital,” CJI said.

Expressing strong dissatisfaction with the West Bengal government and the authorities at the government-run hospital for the delay in filing the FIR and other procedural lapses in handling the case, Chief Justice DY Chandrachud pointed out that current laws do not adequately address institutional safety standards for doctors and medical professionals. 

The Supreme Court bench later constituted a 10-member national task force (NTF) comprising top doctors of the country to formulate a national protocol for ensuring safety and facilities for doctors.

Chhattisgarh: Pigeon failed to fly during August 15 celebrations, became meme material, SP demands disciplinary action

 The Independence Day celebration of Mungeli district in Chhattisgarh is buzzing around social media platforms after a video of a pigeon released by the Superintendent of Police failed to fly off.

After the incident, a video of the incident went viral on social media and people started comparing it with a scene from a popular web series ‘Panchayat’ season 3.

Following the incident, the officer demanded action against those responsible for the incident.

During the Independence Day celebration, BJP MLA and former minister Punnulal Mohle; Collector Rahul Deo and Superintendent of Police (SP) Girija Shankar Jaiswal released a pigeon, signifying peace and freedom.

While the pigeon released by the MLA, who was the chief guest of the event, flew off and the pigeon released by the SP fell to the ground.

In a letter to the Collector, the SP demanded disciplinary action against the responsible.

In a letter to the Collector, the SP wrote, “During an event of national importance like Independence Day, the incident of a pigeon falling on the ground was prominently broadcast on social media. This situation was created due to the presentation of a sick pigeon for flying in the main flag hoisting event at the district level. If this incident had happened with the chief guest, the situation could have been more unpleasant.”

The letter further elaborated that before Independence Day, a meeting of all the department heads was organized and they were given responsibility by instructing them to perform their respective tasks properly so that the Independence Day celebration program could be completed successfully. Certainly, the officer responsible for this work has not discharged his responsibility properly. Therefore, it is proposed to take disciplinary action against the officer responsible for the incident.

Doctor Oumair Aejaz, originally from Bengaluru, charged with sex crimes in the US: had filmed thousands of nude videos of women, kids as young as 2 with hidden cameras

A 40-year-old doctor in Michigan, Oumair Aejaz was arrested in the US after being charged with numerous sex crimes. including recording thousands of nude images of women and children over the past six years. He was arrested on August 8 at his home in Rochester Hills, north of Detroit on a $2-million bond. According to media reports, the police, during their investigation, discovered over 13,000 videos on a single hard drive and seized 15 external devices.

The Oakland County Sheriff’s Office was quoted as saying that Dr Oumair Aejaz used hidden cameras to record children as young as 2 years old and women of various ages in locations such as hospital rooms, changing areas, closets and bathrooms.

Not only that, but investigators believe he recorded sexual encounters with numerous women and hospital patients, who were either asleep or in an unconscious state.

“This is one of the most disturbing sexual predator cases I have seen in my very long career,” said Oakland County Sheriff Michael Bouchard in a news release.

“He violates literally anyone and everyone he can. From a two-year-old boy to grown women, no one is immune from his disgusting predatory behaviour. Violating children in safe spaces as they change for a fun swim or sexually violating women who are still under sedation from a medical procedure shows his depravity has no limits.

Oakland County Sheriff Mike Bouchard added that the magnitude of Aejaz’s offences is so vast that it could take months to fully investigate the extent of his crimes.

“The victimisation is so broad and the perversion so great, we’re just beginning to wrap our arms around it,” Bouchard said.

“At the end of this case, it is my fervent hope he is held fully accountable behind bars,” he added.

The case came to the fore after Aejaz’s wife sent material evidence to law enforcement prompting the Oakland County Sheriff’s Office to execute several search warrants at his Rochester Hills home in Michigan.

The investigating officers have found six computers, four cell phones and 15 external storage devices in the accused’s home. One device had over 13,000 videos police said the man recorded in the last six years. It’s thought that it will take officials six months to complete a forensic examination of all the confiscated materials.

Aejaz, an Indian citizen, has been employed in the US on a visa. He came to the country around 2011 and completed his residency at Detroit Sinai Grace Hospital before to relocating to Dawson, Alabama. In 2018, he went back to Oakland County to resume his practice.

Sold unclaimed dead bodies, trafficked biomedical waste, corruption, and more: Former RG Kar Hospital official makes serious allegations against Ex-Principal Sandip Ghosh

On Wednesday (21st August), Ex-Deputy Superintendent of Kolkata’s RG Kar Medical College and Hospital, Akhtar Ali, told ANI that he has filed a criminal case in the High Court against Former RG Kar Principal Sandip Ghosh over his involvement in corruption and malpractices. According to Ali, Ghosh has been running a ‘very big nexus’ in the medical college and hospital. 

Ali has also appealed to the High Court to provide him security as he has been allegedly getting threats for exposing ‘a very big scam’. Strikingly, the Former-RG Kar official has made several serious allegations against Ghosh who has been facing public ire and received a dressing down from the Calcutta High Court as well as the Supreme Court for his role and initial response to the rape and murder case of the trainee female doctor in the Hospital’s seminar hall. Additionally, the CBI has continued his grilling for the sixth time on Wednesday. 

In his interviews with media channels, Akhtar Ali accused Sandip Ghosh saying that he was involved in several illegal activities. According to the allegations, Sandip Ghosh was selling unclaimed dead bodies, trafficking biomedical waste to Bangladeshi contacts, taking 20% commission in every tender, and deliberately failing students to extort money from them. OpIndia couldn’t independently verify the charges.

Ali has also approached Kolkata Police regarding his allegations against Sandip Ghosh that he ran a nexus from the hospital, earning lakhs from illegal activities, News18 reported adding that the portal has seen a copy of his complaint. 

In an interview with India Today TV, Akhtar Ali also alleged that the arrested ‘civic volunteer’ in the trainee doctor’s rape and murder case, Sanjoy Roy, was part of Sandip Ghosh’s security.

According to Akhtar Ali, Ghosh was doing business with “unclaimed dead bodies” and was also trafficking biomedical waste and medical supplies like gloves, and syringes, to his Bangladeshi contacts. As per reports, this was done in stark opposition to the rules which state that such waste can only be handed out to authorised centres for proper disposal and recycling.

Ali told India Today TV, “Sandip Ghosh used to do business with unclaimed dead bodies. A case was also registered against him. He was also involved in trafficking biomedical waste. He used to sell it to the people who were part of his additional security. It was then sent to Bangladesh.” 

Notably, Ali was posted at RG Kar Hospital till 2023. He said that he had raised an alarm about the illegal activities before the state vigilance commission and was also part of the inquiry committee against Sandip Ghosh. He lamented that no action was taken against the former principal even after the investigation found him guilty.

According to Ali, he had submitted an inquiry report to the state health department against Dr Ghosh. But he was transferred from RG Kar Hospital on the same day.

Ali added that the other two members of that committee were also transferred. He said, “I did whatever I could to save the students from this man, but I failed.”

He further told India Today TV, “Some students were deliberately made to fail. So that he could recover the money.” He added that Ghosh took a 20% commission on every tender. According to him, hospital-related tenders were only given to two close aides of Ghosh — Suman Hazra and Biplab Singha.

Ali said, “Sandip Ghosh used to take money first and then give a work order. Suman Hazra and Biplab Singha had 12 companies. Only they were given tenders for every work.” 

Ali further alleged that Sandip Ghosh had the support of many “powerful people” because of which he was brought back as the head of the hospital despite being transferred twice. 

The former RG Kar official said, “Such a person should be taken into immediate custody. He is harmful to society.” 

Meanwhile, Sandip Ghosh’s neighbours have also accused him of indulging in domestic abuse. These neighbours hail from Barasat where Ghosh lived for about two years. They said that the doctor assaulted his wife 14 days after she gave birth. 

“There was a war of words between me and Ghosh once. His behaviour was always bad. I later found out he was a doctor. During his time here, there was an incident where he beat his wife so badly that her Caesarean stitches tore, and she was bleeding. Initially, locals didn’t interfere because it was seen as a family matter, but when it became too severe, everyone came out and protested,” one of the neighbours told India Today TV.

Nonetheless, the CBI grilled Ghosh for the sixth time on Wednesday (21st August). According to reports, the CBI is also planning a polygraph test on Sandip Ghosh because some of his answers had “discrepancies”. On 20th August, the Kolkata Police filed a corruption case against Sandip Ghosh days after the West Bengal government had formed an SIT to probe financial irregularities during the tenure of former RG Kar principal, Sandip Ghosh. 

Sandip Ghosh resigned from the position of principal at RG Kar Medical College alleging that he was being defamed on social media platforms following the rape and murder of a trainee doctor at the hospital premises.

Telangana: Three-year-old girl raped in Siddipet, accused enticed her with chocolates

A three-year-old girl was reportedly raped by a man in Telangana’s Siddipet district, according to the police on Wednesday. The suspect, Ajay, has been taken into custody.

The incident occurred on Monday, August 19. Police stated that Ajay, a painter from Uttar Pradesh, worked in the housing complex where the girl resided.

He allegedly enticed the child with chocolates and brought her to his room, where he committed the assault, authorities said.

The incident was reported to the police by the girl’s grandfather, who works as a watchman, resulting in Ajay’s arrest the following day.

The girl is currently receiving treatment at a hospital in Siddipet, and doctors have confirmed that her condition is stable.

Police Commissioner Dr. B Anuradha stated that officials have been directed to expedite the investigation and file a chargesheet as soon as possible. Additionally, steps are being taken to ensure a fast-track trial for swift justice.

Ajay, a native of Uttar Pradesh and a painter in the housing complex where the girl resided was arrested on Tuesday for allegedly raping the three-year-old.
