Madhya Pradesh: Man gives Triple talaq to wife calling her ‘obese’, arrested

After the Supreme Court ruled that Triple talaq is unconstitutional, the NDA government had brought an ordinance in September to make it a punishable offense.

A man has been arrested in Madhya Pradesh for giving triple talaq to his wife claiming she is obese. Arif Hussain Diwan was arrested under the newly promulgated Muslim Women (Protection of Rights on Marriage) Ordinance 2018 after a case was registered against him and his mother Hussain Bano in Jhabua yesterday.

As per reports, the wife was tortured by Arif for being obese. The women fled to her brother’s residence at Meghnagar unable to bear the mental and physical abuse she was allegedly subjected to. On the 12th of October, Arif with his mother visited his wife and verbally and physically abused her. He also reportedly demanded dowry from the woman’s family and finally pronounced Triple Talaq.

“The woman, Salma Bano, a native of Sherani Molla in Meghnagar was married to Arif 10 years back. The couple has two children, including a daughter and son. Following her complaint on Tuesday, we arrested her husband under section 323 and 498 of the Indian Penal Code(IPC),” station-in-charge (SHO), Kushal Singh Rawat said.

Salma Bano told ANI, “He mistreats and even manhandles me for being fat. Whenever he came to Meghnagar, he used to beat me up. I decided to register a police case against him after he gave me divorce by uttering talaq thrice.”

The husband and his mother have been reportedly booked under Sections 323, 498A, 506 and 34 of the IPC. While the husband has been arrested, the mother is said to be absconding.

After the Supreme Court ruled that Triple talaq is unconstitutional, the NDA government had brought an ordinance in September to make it a punishable offense.
