Hathras case: SC pulls up Kapil Sibal over plea seeking release of PFI member Siddique Kappan arrested for planning to create caste unrest

The Supreme Court Monday adjourned the habeas corpus plea filed by Congress leader and senior lawyer Kapil Sibal, seeking the release of Siddique Kappan, one of the four PFI members arrested by UP police for planning to create caste-based unrest and communal tension over Hathras case. The apex court bench headed by Chief Justice S A Bobde, while adjourning the plea for 4 weeks, pulled up Sibal for not approaching the Allahabad court with regards to the plea.

Senior advocate Kapil Sibal, representing Siddique Kappan, an active PFI member also working as a journalist, urged the Supreme court to let him approach them under Article 32 of the Constitution, which gives every citizen the right to move the Supreme Court. “When we filed this plea, it was a habeas corpus petition,” Sibal told the court. “Now we learnt that an FIR was registered. UAPA was invoked. No court in UP will grant us bail. Let us approach you under Article 32 of the Constitution,” he added.

Sibal was representing the Kerala Journalists’ Union in Kappan case.

However, Chief Justice S A Bobde told Sibal to approach the Allahabad High Court over the matter. Sibal argued that this would mean the petitioners will continue to remain in jail. However, the court said, “You approach the High Court, we are here only in case something wrong happens.”

Four men linked with PFI booked under UAPA for conspiring to use Hathras case to cause caste-based unrest

It may be recalled that the Uttar Pradesh police had arrested four people, Siddiqui of Nagla in Muzaffarnagar, Siddique of Malappuram, Masood Ahmed of Jarwal in Bahraich district, and Alam of Kotwali area in Rampur district in connection to the Hathras case.

As per the reports, the arrested four have connections with Popular Front of India (PFI) and were planning to cause caste-based unrest in the state. They had been booked under the Unlawful Activities Prevention Act (UAPA). The police had alleged that they were conspiring to spoil the government’s image and disturb the atmosphere in the area.

As per the reports, the Uttar Pradesh police had recovered the mobile, laptop, and suspected literature from the suspects. The FIR launched against the four has serious charges, including threatening the unity and integrity of the country (treason).

Bollywood’s leading associations and production houses file a suit in Delhi High Court against Republic TV, Arnab Goswami, Pradeep Bhandari, Times Now, Navika Kumar and Rahul Shivshankar. As per reports, the suit asks them to refrain from making ‘irresponsible, defamatory and derogatory remarks’ against Bollywood in wake of mysterious death of Sushant Singh Rajput and subsequent drug scandal that has emerged.

The suit also asks them to take down all “defamatory” content published by them against the film industry. The Bollywood bigwigs are upset at the alleged use of words like “dirt”, “filth”, “scum”, “druggies” & expressions such as “all the perfumes of Arabia cannot take away the stench and the stink of this filth and scum of the underbelly of Bollywood” to describe the film industry.

Four cine-associations and 34 production houses including the ones owned by Aamir Khan, Shah Rukh Khan, Karan Johar, Farhan Akhtar, Rakesh Roshan, Salman Khan and his brother Sohail Khan, Ajay Devgn and Aditya Chopra amongst others have filed the suit.

The defendants claim that livelihood of people associated with Bollywood is impacted because of alleged smear campaign. They also allege their privacy is also invaded and reputation “irreparably damaged” by painting entire industry seeped in drug culture.

Uttar Pradesh: CM Yogi Adityanath announces 5% reservation for ex-servicemen in state govt jobs

Uttar Pradesh Chief Minister Yogi Adityanath has announced that the UP-domiciled ex-servicemen from all three services Army, Navy, and Air Force will be eligible for the 5% reservation in the Group C posts. The ex-servicemen who are original residents of Uttar Pradesh will be eligible for the job under the scheme. The reservation will be provided at each level on a horizontal basis.

The Uttar Pradesh state cabinet has approved an amendment to the Uttar Pradesh Public Service (Reservation for Physically Handicapped, Dependents of Freedom Fighters and Ex-Servicemen) Act, 1993, to ensure the above-mentioned reservation.

In a tweet, the UP government spokesperson said, “With this decision, the morale of former officers and employees of the Indian Army will be increased and their family will get effective support.” As many people from UP join defence services, the decision will prove to the beneficiary for all.

Financial assistance for the family of martyred soldiers increased

The government of Uttar Pradesh also increased the financial support provided to the family of martyred serviceperson of the armed forces. It has been increased to Rs. 50 lakh from the earlier Rs. 25 lakh.

The government in 2018 announced jobs for dependents of martyred soldiers

The government announced that the state had made arrangements for the employment of dependents of the martyred soldiers. The dependents of the soldiers who were martyred after 01 April 2017 will get jobs in the government departments.

An executive order was issued by the Yogi government on 19th March 2018 in this regard. There was no such provision to provide employment to the dependents in the state before.

Rs 10,000 special festival advance for govt employees, Interest-free 50-year loans to states: FM Nirmala Sitharaman

Finance Minister Nirmala Sitharaman has announced a slew of measures to stimulate the slowing economy in the wake of coronavirus-induced lockdown.

Addressing the economic issues, Sitharaman today convened a press conference wherein she announced that Rs 10,000 will be granted as festival advance to its employees to provide an impetus to demand in the country.

The government expects the scheme to cost Rs 4,000 crore. Sitharaman added that employees can spend it on any festival of their choosing and if the state governments also agree for disbursement, another Rs 8,000 crore is expected to be disbursed.

“The proposals being presented are designed in a way that they can stimulate demand by front-loading/advancing some of the expenditure with some offsetting changes. Others are directly linked to an increase in the GDP,” Sitharaman said before announcing the measures.

Acknowledging that the pandemic had an adverse impact on economy, Sitharaman said that the government has taken into consideration the hardships suffered by the poorer and weaker sections of the society in formulating the policies providing fiscal stimulus. She added that supply constraints have somewhat eased but demand still needs to be provided with a boost.

LTC cash voucher scheme announced for government employees

To spur consumer demand, the government has added a provision under the LTC cash voucher scheme for the government employees to opt for receiving cash amounting to leave encashment plus 3 times ticket fare, to buy items which attract GST of 12% or more. However, only digital transactions are allowed under the provision and GST invoice will have to be produced, she added.

Since central government employees will not be able to avail the LTC under the 2018-21 block due to the coronavirus pandemic, the LTC cash voucher scheme will enable them to encash their leaves and obtain the travel fare. The cash earned will not be taxed.

The government expects the LTC cash voucher scheme to generate additional consumer demand in the range of Rs 28,000 crore.

Government announces measures to boost Capital Expenditure by providing interest-free loans to states

The Finance Minister noted that Capital Expenditure—money spent on infrastructure and asset creation—has a multiplier effect on the economy and serves to increase not only the current GDP but the future GDP as well.

The government has announced Interest-free 50-year loans for states, earmarking Rs 2500 crore for the North-east states, Rs 900 crore for Himachal and Uttarakhand in the first leg. In second part, the government has allocated Rs 7,500 crore for other states and in Part 3-Rs 2,000 crore for states which meet at least 3 out of 4 reforms given in Atma Nirbhar fiscal deficit package.

“Both Part 1 and Part 2 of interest-free loans given to states are to be spent by March 31, 2021. 50% will be given initially, remaining upon utilization of first 50%,” Sitharaman said.

Four arrested after Chinese-made grenades hurled at Assam Rifles transit camp at Dhansiri, Nagaland: Report

Four people have been arrested in connection with an incident on Saturday when two Chinese-made grenades were hurled at the Assam Rifles Dhansiri Transit Camp near the Purana Bazaar area in Dimapur, the Nagaland Post has reported. It was reported that the Assam Rifles had arrested one suspect initially following which three more were arrested. No other information is known as of now.

Dimapur Police PRO T Relo Aye said that the incident took place at around 5 am on Saturday. The grenade exploded inside the camp but fortunately, no one was injured. One other grenade failed to explode. The motivation for the attack is not yet known. No terrorist outfit has yet claimed responsibility for the attack. Further details are unavailable at the moment.

Recently, it was reported that Indian Intelligence agencies had cautioned that China had been spying on over 10,000 Indian organisations and individuals using a global database and also inciting ‘internal unrest’ to halt the Naga peace deal process. Indian security agencies have revealed that the Chinese wanted NSCN (I-M) leader Thuingaleng Muviah to delay the peace process and that the Centre had prior inputs about such a development. Interestingly, Muviah had initially agreed on all major issues but began delaying the peace process by raking up minor and irrelevant issues about the interlocutor, during the Galwan Valley clash in mid-June.

Naga Peace Deal

Negotiations between the NSCN (I-M) and the Indian government began 23 years ago. However, it was only in August 2015 that the Centre reportedly signed a Framework Agreement to settle issues with NSCN (I-M). The Naga National Political Groups (NNPGs) also joined the peace negotiations as late as 2017 via the ‘Deed of Commitment’ agreement.

One of the demands of NSCN (I-M) is the formation of a Greater Nagalim, comprising Naga inhabited areas of Arunachal Pradesh, Assam and Manipur apart from the entire Nagaland. People and governments of these three states strongly oppose the proposal, and the government of India has also not accepted that demand.

The murder of Rahul Rajput by the family of his Muslim girlfriend: Why the ‘no communal angle’ trope is just that, a hollow trope to whitewash communal hate

We are living in a culture of denial of the obvious. Even if truth danced naked in front of us screaming verses from the Bhagavad Gita, we would much rather close our eyes to it and comfort ourselves in the cocoon of falsehood that we have constructed over time. “Facts don’t care about your feelings,” we might say emphatically but when the time comes for us to walk the talk, we would much rather bend our knee to public sentiment abandoning our prior commitments to righteousness. And there are pertinent lessons to be learnt from the responses to the murder of Rahul Rajput.

It is these aspects of our prevalent public discourse that the Aam Aadmi Party encapsulated perfectly when they proudly declared that the brutal murder of the 18-year-old Hindu boy in Delhi ought not to be communalised. There was certain dark humour to the whole affair. The implication of the assertion was that the murder was not communal in itself and only morally inferior human being would reach that conclusion.

We are expected to believe that the murder of a Hindu boy by Mohammad Afroz, Mohammad Raj and three others for a romantic relationship with a Muslim girl was not communal in nature. A young boy is murdered because he dared to love someone from a different religious community and we are expected to believe there are no communal motivations involved.

Would Rahul Rajput have been murdered if he was not a Hindu? Would he have been murdered if his girlfriend was not a Muslim? Would he have been murdered if his killers did not believe it was scripturally forbidden for a Muslim woman to love and marry someone from a different religious community? The answer is clearly no. If the murderers were not so intent upon upholding the religious tenets of their faith, Rahul Rajput would have been alive today.

It is abundantly clear and extremely obvious that Rahul Rajput was murdered solely because he was a Hindu who was courting a Muslim woman. There is no reason for us to think that the AAP actually believes that the murder did not have any communal motivation. It is perfectly reasonable for us to assume that they, too, consider it to be a hate crime. They are not mentally challenged, of course.

However, in public life, they would assert the exact opposite because we have made a virtue out of the denial of the obvious. It is by denying the obvious that political actors assume the mantle of moral superiority. Denial of the obvious has verily become the most preferred avenue for political actors to pretend that they are morally superior to the rest of us. It is by endorsing positions that are antithetical to observable reality that political actors lay claim to moral superiority. It is quite disgusting, to put it mildly.

It is not merely political actors who resort to such antics. It is a plague that afflicts all our major institutions. The media, which claims to speak truth to power and but never actually does, is perhaps most guilty of it. Even our police and the judiciary and every other social institution has made a virtue out of outright lying. The greater the magnitude of the lie endorsed, the greater is the sense of moral superiority that the individual feels.

We have seen such a mentality manifest itself over and over again, whenever an event transpires that betrays the worldview of our cultural elites. The media works overtime to shield the core features of the identity of the perpetrators and the victims whenever a Hindu is murdered by a Muslim due to communal reasons.

For instance, when Ankit Saxena was murdered by the family of his Muslim girlfriend, India Today refrained from highlighting the communal nature of the crime in their headline. The news network stayed true to its traditions after the recent murder of the Delhi boy for similar reasons as well. And it will surprise no one if they observe the same rituals after the next such murder.

But this is a feature of our public discourse and not a bug. After Kamlesh Tiwari was murdered by Islamists, Uttar Pradesh DGP OP Singh claimed that his murderers were radicalised by the comment on prophet Mohammed he made. All of us know that is not true. Someone with IQ as low as me knows that is not true, so surely, DGP OP Singh knows it well. But he lied flatly and others did not call him out on it and even furthered it because denial of the obvious is how the cultural elites of our country maintain their credentials in their social circles.

It is for the same reason that Zomato could prance away on social media after claiming that food has no religion even after making provisions for Halal food and incite little to no adverse comments from their peers. It is for the same reason that media and politicians feel no compunction while pretending that Gau Rakshaks are more of a threat than cow smugglers. It is for the same reason that petitioners can pretend that marriage is not only between a man and a woman and genuinely expect the Courts to take them seriously. It is a farce that we are living through and it is a farce that we will have to endure because our cultural elites have given up on the truth.

The reason for such denial is as much political as it is cultural. People who engage in such denials do so because that is how they sustain and increase their political capital. Hindus must be fed the nonsense of Ganga-Jamuni Tehzeeb because that is the myth upon which the edifice of Nehruvian Secularism stands. If the myth is not constantly nourished with propaganda and whitewashing of hate crimes against Hindus, then the edifice will start crumbling and everyone who has built their mansion on it will lose their clout. And that cannot be allowed to happen.

It is for the same reason that fake hate crimes against the Muslim community are invented while actual hate crimes against Hindus are whitewashed. For the edifice of Secularism to sustain itself, Hindus can never be allowed to be victims. Because painting the Hindu community as oppressor and the Muslim community as the victim is how Secularism is sustained in this country. Every crime, every incident that violates this assumption must be whitewashed and brushed under the carpet. The myth of ‘Dara Hua Musalman’ and evil ‘Upper Caste Hindus’ must be preserved at all cost for secular politicians to continue to hold their control over power.

Of course, the individuals who indulge in such blatant denial of reality do so because they wish to believe they are in the ‘right side of history’. At least in some parts, they appear to believe that by lying outright, they are contributing positively to society. But how does it benefit anyone when such lies are designed to antagonise one community at the expense of the other?

Such individuals also appear to believe that the minority community is genuinely on a morally superior pedestal than Hindus, especially ‘Upper Caste’ Hindus. Consequently, the worst is assumed in case of the latter while every transgression of the former is subsequently whitewashed. However, we do know that significant sections of the Muslim community harbour remarkably intolerant opinions towards other faiths.

We do know that significant sections of the Muslim community believes that the punishment for blasphemy could only ever be death. We do know that they believe women of other communities are valid grounds for sexual predation. We do know that they believe that murdering a man of different faith for courting a Muslim woman is justified. Therefore, in such cases, when authorities and institutions go out of their way to deny a communal link to the crime, they are only exposing their own moral frailties.

All of us know why Rahul Rajput was murdered. He was murdered because Islamic zealots, perennially insecure about their own masculinity, cannot tolerate the fact that a Muslim woman chose a chivalrous Hindu man over someone from their community. He was murdered because Islamic zealots believe ‘kaafirs’ who seek to marry a Muslim woman is worthy of only death. These are obvious realities and it is precisely because it is obvious that our cultural elites must stand in staunch denial of them.

It is of paramount importance that we refuse to allow such clowns to suffer no criticism when they indulge in such buffoonery. It is so because if they can get us to believe Rahul Rajput was not murdered due to communal reasons, they can make us believe absolutely anything. The distance between having us convinced that the 18 year old boy was not murdered due to communal reasons and “War is Peace, Freedom is Slavery, Ignorance is Strength” is far smaller than we assume it to be.

If we are not motivated enough by the honour of the victim to speak out against the attempts to deny the obvious here, then we must do so for the sake of our own sanity. If the cultural elites attempt to weaponize our social institutions against us by a radical inversion of the truth, then it is imperative upon us to stand our ground and declare in imperious fashion: “Thus far and no further”.

Youth who issued rape threats to the 5-year-old daughter of MS Dhoni arrested, confesses to crime

The 16-year-old youth who had issued rape threats to the five-year-old daughter of the former Indian cricket team captain MS Dhoni has been detained on Sunday from Mundra in Gujarat. The youth has confessed to having posted the threatening message on Dhoni and his wife Sakshi’s Instagram account after the IPL 2020 match between KKR and CSK cricket teams. The teenager is a class 12 student from Namna Kapaya village in the Kutch region of Gujarat. 

“The Class 12 student from Namna Kapaya village was detained for questioning in connection with a disgusting threat message that was posted on the Instagram account of Mr Dhoni’s wife Sakshi Dhoni a few days back,” senior police officer Saurabh Singh said.

According to reports, Ranchi police had shared information regarding the boy with the police in Kutch and asked them to confirm if he was the one who had posted the threat message. After receiving the message, the Kutch police detained the 16-year-old boy and informed the Ranchi police of the same.

“We have confirmed that the boy is the same who had posted the message. He will be handed over to Ranchi police as the FIR was lodged in that city,” police said, adding that a team of Ranchi Police is likely to reach Kutch tomorrow to take custody of the teenager.

BJP gears up for the upcoming Bihar elections

The BJP is fighting the Bihar assembly election 2020 in alliance with Nitish Kumar’s Janata Dal (United). Yesterday, BJP began the ruling coalition’s mega rally in Bihar with the party president-JP Nadda addressing the first poll rally after the election guidelines were revised.

The elections for the 243 Assembly seats in Bihar will take place in three phases between October 28 till November 7.

This will be the first election after the Coronavirus pandemic broke out earlier this year, therefore the EC has announced several measures to ensure social distancing. The poling time has been extended by one hour, and voters will be able to cast their votes between 7AM to 6PM. 7 lakh hand sanitisers, 46 lakh masks and 6 lakh PPE kits will be supplied by the commission for election officials to protect them from the pandemic. 6.7 lakh units of face shields and 23 lakh pairs of gloves will also be arranged.

Mumbai suffered a power out on Monday after a failure in the power grid that supplies electricity to the city. Local train services suffered and so did other services in the city.
