Meghalaya: FIR filed against social media influencer after his video chanting ‘Jai Shri Ram’ at a church goes viral

An FIR was filed in Meghalaya against social media influencer Akash Sagar after a viral video surfaced showing him and two others innocuously chanting ‘religious song ‘Jai Shri Ram’ at a church. The controversy erupted after bigots on social media started demanding action as Akash’s video started doing the rounds on the internet.

The footage depicts Akash chanting ‘Jai Shri Ram’ at the Church of Epiphany in Mawlynnong, East Khasi Hills district, and engaging in actions that religious zealots deemed as disrespectful to the church’s sanctity.

A Shillong-based activist filed a complaint at Laitumkhrah Police Station, alleging that the act was deliberate and premeditated. The complaint accused Akash of intentionally insulting the Christian faith and inciting communal tensions in a region renowned for its religious harmony.

Following the complaint, the Meghalaya Police registered an FIR against Akash and his companions, charging them with trespassing, disrupting public harmony, and disrespecting religious beliefs.

However, Akash dismissed these allegations. In a now-deleted post, he questioned the complaint’s validity, stating, “For saying Jai Shree Ram?” and shared screenshots of news articles about the FIR, labelling his critics as “traitors.” He also referenced a Karnataka High Court ruling in a separate case that dismissed criminal charges against individuals chanting religious slogans in a mosque.

The 92-year-old bureaucrat-turned-politician has an unforgettable history of contributions to Indian politics and the economy. Former Congress president Sonia Gandhi described his demise as a ‘personal loss’ and reminisced about the time she spent with him.

Dr Singh was recognised as a skilled economist and a dedicated politician. His tenure as the Prime Minister of India was also marked by controversies and incidents of humiliation. He faced political pressure and personal insults numerous times during his tenure, but his loyalty and commitment to the nation kept driving him to work for the greater good.

Today, the Congress Party is singing his praises. However, it was the Congress Party itself that was often responsible for his humiliation. Here are four key incidents from Dr Singh’s life where he endured humiliation yet kept working for the country.

Rajiv Gandhi likened the Planning Commission to a ‘joker commission’

In 1986, then-Prime Minister Rajiv Gandhi publicly dismissed the Planning Commission, where Dr Singh was serving as deputy chairman. Gandhi termed it a “joker commission”. The remarks were given after a presentation by Dr Singh on the rural economy that had angered Gandhi. The comment was deeply humiliating for Dr Singh, who reportedly considered resigning but was persuaded to stay on by his colleagues.

Congress MPs opposed him as Finance Minister

The humiliation of Dr Singh did not end there. In 1991, Dr Singh served as Finance Minister in PV Narsimha Rao’s government. He introduced bold economic reforms that included the dismantling of the licence raj. His policies were resisted by then-Congress MPs, who criticised him during parliamentary meetings. Even the Congress-backed newspaper National Herald labelled his policies as anti-middle class. Despite the humiliation from his own party leaders, Singh’s resolve to improve the nation’s economy remained unshaken.

Prime Minister in name, but power lay with Sonia Gandhi

Sonia Gandhi reportedly declined the post of Prime Minister in 2004 after immense pressure from the public. The power and responsibility were then handed over to Dr Manmohan Singh. People hoped for strong and independent leadership. However, Dr Singh was often sidelined in major decisions. In the book ‘The Accidental Prime Minister’, it was revealed that he wished to retain the finance portfolio but was overruled by the Congress high command. The portfolio was given to P Chidambaram. Throughout his tenure, Singh was often seen as following the directives of the party.

In 2012, as Prime Minister, Singh famously remarked outside Parliament, “My silence is better than a thousand answers; it shields the dignity of countless questions.” However, today, when Sonia Gandhi describes his demise as a personal loss, one cannot help but recall narratives about her being a ‘super PM’ and Singh a mere ‘puppet‘.

Rahul Gandhi tore up an ordinance, publicly humiliating Singh

One of the most humiliating incidents came for Dr Singh in 2013, when his government proposed an ordinance to overturn a Supreme Court ruling disqualifying convicted lawmakers from contesting elections. The ordinance was approved by the Cabinet. However, Rahul Gandhi, who held no official position in the government, publicly dismissed the ordinance as “nonsense” and tore it up during a press conference. His actions not only embarrassed the government but also undermined Singh’s authority as Prime Minister. Dr Singh was deeply hurt by the incident and reportedly contemplated resigning but prioritised national stability instead.

The enduring label of ‘puppet’

Throughout his tenure as Prime Minister, Dr Singh endured the label of being a ‘puppet’. His tenure symbolised how power could reside elsewhere while the Prime Minister remained a figurehead. Books like The Accidental Prime Minister revealed how decisions were often dictated from 10 Janpath (Sonia Gandhi’s residence). Despite leading the nation for a decade, Singh was denied the autonomy to act independently.

Today, while the Congress Party glorifies Dr Singh, history cannot ignore how the same party subjected him to repeated humiliations. Yet, despite these setbacks, Singh worked tirelessly for the country, implementing critical policies and showcasing resilience in the face of adversity. His life serves as a testament to not only his economic and political acumen but also his ability to rise above personal slights for the nation’s progress.

However, the sincerity of Congress’s tribute to Dr Singh after his demise raises questions. How can the party that forced him to endure such indignities now laud his contributions with a straight face?

Sonia Gandhi’s 2004 letter declining PM post was drafted by Vir Sanghvi, Manmohan Singh lost 1999 LS polls due to internal sabotage, claims journalist Pankaj Vohra

After the Congress-led UPA won the Lok Sabha elections in 2004, Sonia Gandhi had declined to become the Prime Minister of India, and chose Dr Manmohan Singh for the position, making him the ‘accidental Prime Minister’. Now after Singh’s death, it has been revealed that Sonia Gandhi’s letter declining the position was drafted by journalist Vir Sanghvi. Moreover, it has been claimed that Dr Singh lost the Lok Sabha polls 1999 due to sabotage by some Congress leaders.

This was revealed by journalist Pankaj Vohra in an article published on the Daily Guardian on Saturday, 28 December. In the article titled ‘Manmohan Singh, the designated survivor of Congress politics’, Vohra said that Vir Sanghvi was not in India at that time, and he had mailed the draft of the letter to 10 Janpath.

Pankaj Vohra, who was in Hindustan Times at that time, narrated the incident as one of the untold stories concerning Dr Manmohan Singh, saying that the letter released by Sonia Gandhi declining the position and nominating Singh for the post of PM was drafted by Vir Sanghvi, who was Editorial Director of Hindustan Times at that time.

Pankaj Vohra wrote, “The letter was drafted by my former Editor Vir Sanghvi who was on a vacation to either Thailand or Singapore and was contacted by me after receiving a call from Ten Janpath. First Madhavan and later Ambika Soni called me to trace Vir and get the draft, which finally arrived and was sent to a specific email at 10 Janpath from Vir’s office.”

Vohra claimed that Sonia Gandhi also wanted to Manmohan Singh to become the leader of the Congress Parliamentary Party, but she took the post on the insistence of Makhan Lal Fotedar, after which she announced that Manmohan Singh will be the PM.

The article also said that after the Atal Behari Vajpayee govt in 1999 after losing the confidence vote by just 1 vote, Sonia Gandhi had recommended Manmohan Singh’s name for the PM while claiming to form an alliance government. However, the alliance attempt was unsuccessful and fresh elections were held. In the polls, Dr Singh was given the ticket from South Delhi, and it was believed that he would win easily. But as per Vohra, certain Congress leaders ensured that he was defeated, in order to prevent him from entering the Lok Sabha.

He wrote, “While covering the polls, I had predicted that Manmohan Singh would lose, though no one believed me including my colleagues in the Hindustan Times, since I could see the sabotage of his election by Congressmen themselves. Sonia Gandhi who was aware of what was happening was unforgiving and was determined to deal with the saboteurs.”

After the Centre agrees to a memorial to former PM Manmohan Singh, Priyanka Gandhi exploits his death to incite Sikhs

On Tuesday, December 28, hours after the last rites were performed for former PM Manmohan Singh (MMS), the newly minted Congress MP Priyanka Gandhi Vadra sought to exploit his death to advance the brand of divisive politics long championed by the Congress party.

Taking to X, formerly known as Twitter, Ms Vadra posted a tweet designed to defame the Centre and create a sympathy wave by insinuating he wasn’t treated well in death by the Modi government.

“By not providing an adequate place for the cremation of former Prime Minister Dr Manmohan Singh, the Government has not done justice to the dignity of the post of former Prime Minister, the personality of Manmohan Singh, his legacy and the self-respecting Sikh community,” the translation of Vadra’s tweet, which was in Hindi, said.

“Earlier, all former Prime Ministers were given the highest honour and respect. Dr. Manmohan Singh Ji deserves this honour and Samadhi Sthal. Today the whole world is remembering his contribution. The government should have thought beyond politics and narrow-mindedness in this matter,” she added.

Ms Vadra alleged that she witnessed Dr Manmohan Singh’s family members struggling to find space at the funeral site while alleging that the general public faced difficulties due to insufficient room to pay their final respects to the former Prime Minister of India.

Ms Vadra’s aspersions came a day after the Union Home Ministry announced on Friday night that the government will designate space for a memorial honouring former Prime Minister Manmohan Singh. This decision has been conveyed to his family and Congress President Mallikarjun Kharge.

In a late-night statement titled “Facts of the Matter Regarding Memorial for Former Prime Minister Late Dr Manmohan Singh,” the ministry revealed that the government had received a request from the Congress president to allocate space for a memorial for Singh.

Following the Cabinet meeting, Union Home Minister Amit Shah informed Congress President Mallikarjun Kharge and Manmohan Singh’s family that the government would provide space for the memorial.

Besides, the Congress leader’s desperation to play the Sikh card speaks to the party’s age-old tradition of pitting one community against the other and cultivating vote banks by instigating resentment among various sections of society. Similar fearmongering was also employed by her brother, Rahul Gandhi, during his recent trip to the United States, where he fallaciously claimed that Sikhs were being persecuted in India.

“First, it’s important to understand what the real issue is. The fight isn’t about politics; that’s just on the surface. What’s your name? The fight is about whether he, as a Sikh, will be allowed to wear his turban in India, or whether he’ll be permitted to wear a kada, or even attend the Gurdwara. That’s what this struggle is about, and it extends beyond him to all religions,” Mr Gandhi said in his usual rambling way while speaking at a public event in the United States.

Months later, Ms Vadra is attempting to foment discontent among the Sikh community by feigning concern for them in the aftermath of former PM Manmohan Singh’s death. And while Ms Vadra is at it, it is noteworthy to mention that it was under her party’s rule and leaders belonging to her party when Sikhs were ruthlessly massacred in 1984 following the assassination of former PM Indira Gandhi.

How Congress leaders perpetrated the 1984 anti-Sikh pogrom

The 1984 Anti-Sikh riots took place in the aftermath of the assassination of then Prime Minister Indira Gandhi. Indira Gandhi was assassinated on 31st October 1984 by her Sikh bodyguards as revenge for Operation Blue Star. From 1st November to 4th November, Sikhs across the country were killed. The government figures suggest the angry mobs, many of which were led by Congress leaders, brutally murdered 3,350 Sikhs.

Sikhs across the country, particularly in north India, went into hiding, with many men shaving off their heads, which is proscribed as per Sikhism. Yet, to save themselves from bloodthirsty mobs of rioters, several Sikh men had to give up their faith, remove their turbans, and shave their heads to avoid being identified as Sikhs.

Sajjan Kumar was one of the many Congress leaders accused of involvement in the 1984 anti-Sikh massacre. Even after grave allegations against him, Congress rewarded him with a ticket to contest elections in 1991, which he subsequently won. He also won the 2004 general elections on the Congress ticket from the Outer Delhi seat with the highest-ever votes at 8,55,543 votes. A Sanjay Gandhi loyalist, he served as a Member of the Committee on Urban Development and Committee on Members of Parliament Local Area Development Scheme in 2005. 

The ex-Congress MP was charged with the murder of a man and his son in west Delhi’s Saraswati Vihar. On November 1, 1984, a thousand-strong mob allegedly burned alive a father and son duo (Jaswant Singh and Tarun Deep Singh) in Raj Nagar, West Delhi. The prosecution had stated that the crowd burned alive the two men, as well as damaged, destroyed, looted, arson and inflicted severe injuries on their family members and relations, on Kumar’s incitement and abetment. While framing the charges, the court said sufficient evidence was on record to form a prima facie opinion that Sajjan Kumar was not only “a participant of the riotous mob but had also led it”. 

Sajjan Kumar was not the only loyalist of the Nehru-Gandhi family and Congress who was accused of leading the mob and running a riot. Another such leader was Jagdish Tytler, who continues to hold sway in the Congress party. The Nanavati Commission recorded the testimony of a witness namely, Jasbir Singh, who stated that on 3rd November 1984, he was passing by the TB hospital gate after taking dinner at the house of one Sucha Singh situated at Outram lane when he had seen Jagdish Tytler coming there in a car.

Putin apologises to Azerbaijan’s president for ‘tragic incident’ involving Azerbaijan Airlines plane, does not admit that it was accidentally shot by Russian missile

After it was confirmed that a Russian air-defence missile shot the Azerbaijan Airlines plane that crashed in Kazakhstan, Russian President Vladimir Putin apologised to Azerbaijan’s president for the incident. As per reports, Putin apologised to Ilham Aliyev “for a tragic incident” in Russian airspace involving an Azerbaijan Airlines passenger plane.

According to the Kremlin, Putin made and call to his Azerbaijan counterpart and issued a formal apology. However, the Russian president didn’t admit that a Russian missile hit the plane and only mentioned a tragic incident in Russian airspace.

“President Vladimir Putin apologised for the tragic incident that occurred in Russian airspace and once again expressed his deep and sincere condolences to the families of the victims and wished a speedy recovery to the injured,” the Kremlin said in a statement. It added that the plane had repeatedly attempted to land at the airport in Grozny.

“At that time, Grozny, Mozdok and Vladikavkaz were being attacked by Ukrainian unmanned aerial vehicles, and Russian air defence systems repelled these attacks,” the statement added, explaining the circumstances behind the incident of shooting of the passenger plane mistakenly by its air-defence system.

Azerbaijan Airlines Flight J28432 was flying from Baku in Azerbaijan to Grozny in Russia’s Chechnya, but it was diverted from Grozny for unknown reasons and attempted to make an emergency landing at Aktau in western Kazakhstan on December 25, 2024. But the plane crashed near the airport, killing 38 of 67 people on the plane.

Soon after the crash, it was claimed by several sources including Azerbaijan and the USA that it was hit by a Russian missile, and shrapnel damage was seen on the aircraft, including its vertical stabilizer. Sources had said that at the time of the incident, the Russian air defence system was targeting Ukrainian drones over Grozny. It was also said that the missile that hit the passenger aircraft was fired from a Pantsir-S air defence system.

Now it has been known that the plane was hit in Russian airspace over Grozny, after which it attempted to land at Aktau in Kazakhstan. However, due to the damage from the missile hit, it crashed before reaching the airport.

It has also been revealed that before the crash, flight J28432 hovered over Aktau and its altitude moved up and down during this period. The Embraer ERJ-190 aircraft also faced GPS jamming during the period.

It has been concluded by experts that the Azerbaijan Airlines aircraft was hit by a Russian missile by mistake while targeting Ukrainian drones.

BJP says Congress has damaged the dignity of Manmohan Singh, asks party to not play politics after govt assured place for memorial

Reiterating the Bharatiya Janata Party’s belief in “dignity in death,” party MP Sambit Patra on Saturday attacked Congress for indulging in “politics” over the demise of former Prime Minister Manmohan Singh and said that if someone has “damaged the dignity” of former Finance Minister it’s Congress party.

“This is a new low in politics of India, thanks to the Congress party. Due to the Congress party – we are here to have a press conference on the day when the last rites of the former prime minister were done… BJP believes that there has to be dignity in death,” Patra said addressing a press conference in Bhubaneswar.

Patra further added that after the passing of the former Prime Minister, the Cabinet had sent a letter to the Congress and Manmohan Singh’s family, expressing the government’s intent to build a memorial in his honour.

“The kind of politics Congress is doing, especially Rahul Gandhi who has tweeted accusing BJP of disrespecting former PM Manmohan Singh by conducting his last rites at Nigambodh Ghat. You all should know the truth behind it. We in a cabinet meeting after the demise of the former PM Manmohan Singh – decided that since he was the PM and had a big stature – the cabinet wrote a letter to Congress and Dr Singh’s family – where the cabinet said that we should build a memorial in his name so that the country and the world remember him for his positive works,” he added.

The BJP leader said that on a day of mourning the Congress should have refrained from this kind of politics.

“There is a procedure to build a memorial but cremation is a process that can’t wait… It was a direct communication that our party had extended. But, after that, the kind of politics Congress did, it shouldn’t have been done on the day of grief. I want to tell the Congress and its supporters who are saying absurd things – while being in office if someone who has damaged the dignity of former PM Manmohan Singh – it’s Congress party,” Patra said.

Earlier today, Rahul Gandhi attacked the central government for performing the last rites of Manmohan Singh at Nigambodh Ghat and said that the former Finance Minister deserves the “highest respect and a memorial.”

“The great son of India and the first Prime Minister of the Sikh community, Dr. Manmohan Singh ji has been totally insulted by the present government by performing his last rites today at the Nigambodh Ghat,” Rahul Gandhi posted on X.

He further said that he was the Prime Minister of India for a decade, during his tenure the country became an “economic superpower” and his policies still support the poor and backward classes of the country.

“Till date, respecting the dignity of all former Prime Ministers, their last rites were performed at authorized burial sites so that every person could have the last darshan and pay homage without any inconvenience. Dr. Manmohan Singh deserves our highest respect and a memorial. The government should have shown respect to this great son of the country and his proud community,” he added.

Congress had demanded a funeral in a place where a memorial to Singh could be built. However, the Centre said land for a memorial would be earmarked in the next few days. But it would not be the place where the funeral took place. The Congress called it a “deliberate insult to the first Sikh Prime Minister of India.”

After the Cabinet meeting on Friday, Union Home Minister Amit Shah communicated to Congress President Kharge and the family of the late Manmohan Singh that the Government will allocate space for the memorial. In the meanwhile, cremation and other formalities can happen because a trust has to be formed and space has to be allocated to it.

Manmohan Singh was accorded a state funeral with full military honours at the Nigam Bodh Ghat, a public cremation ground in north Delhi, on Saturday.

Manmohan Singh passed away at AIIMS, Delhi, on Thursday at the age of 92 due to age-related medical conditions. He had a sudden loss of consciousness at home after which he was rushed to the hospital.

Taliban targets several positions in Pakistan days after Pakistani aircrafts carried out bombardment in Afghanistan

 Afghanistan’s Taliban forces targeted “several points” in Pakistan on Saturday, Taliban said, days after Pakistani aircraft carried out aerial bombardments inside the country, as per Al Jazeera.

The statement, which was released by Taliban did not directly specify that Pakistan was hit, but said the attacks were conducted “beyond the “hypothetical line” – an expression used by Afghan authorities to refer to a border with Pakistan which has been in dispute since long.

“Several points beyond the hypothetical line, serving as centres and hideouts for malicious elements and their supporters who organised and coordinated attacks in Afghanistan, were targeted in retaliation from the southeastern direction of the country,” Al Jazeera quoted Taliban as saying.

Asked whether the statement referred to Pakistan, Taliban spokesperson Enayatullah Khowarazmi said, “We do not consider it to be the territory of Pakistan, therefore, we cannot confirm the territory, but it was on the other side of the hypothetical line.”

Afghanistan has rejected the Durand Line, a border between Pakistan and Afghanistan, which was drawn by the Britishers in the 19th century, as per Al Jazeera. The Taliban sees it as a divisive line between Pashtuns on both sides of the border.

“Clarity! Several points on the other side of the virtual line “Durand” in the south-eastern direction of the country were targeted, which were hideouts and centers for evil elements and their supporters, who were organizing attacks in Afghanistan,” Taliban said in a post on X. There are no reports of casualties from either side, Al Jazeera reported.

Afghanistan has a complicated history with Pakistan. While Pakistan welcomed the Taliban in Kabul as a natural ally, the Taliban government is proving to be less cooperative than Pakistan had hoped. The current Talibani regime is trying to align itself with the nation’s rhetoric as they are trying to form a ‘government’ as a metamorphosis from a fighting group. The regime is also trying to forge relations beyond heavy reliance on Pakistan, as per Al Jazeera.

ASI inspects ancient ‘Baori’ discovered during anti-encroachment drive in Sambhal, construction of new police station near Jama Masjid starts

The Archaeological Survey of India (ASI) team from Meerut on Saturday, conducted an inspection of an ancient Baori in the Chandausi area of Sambhal, where excavation work is currently underway.

Vinod Singh Rawat, Circle In-Charge of ASI Meerut, highlighted that several such Baoris are found in western Uttar Pradesh, all sharing a similar structure. He also mentioned ongoing discussions with the District Magistrate.

“There are several such baori in western UP…They all are the same in the structure…I met with the DM, discussions are being done..,” he said.

Meanwhile earlier today, excavation at the Laxmanganj stepwell, now in its eighth day, continues under the supervision of ASI officials, using manual tools to prevent any damage to the structure, as stated by Executive Officer of the Municipal Corporation Chandausi, KK Sonkar.

Speaking to ANI, Sonkar said, “Today marks the eighth day of excavation. The digging has been ongoing for the past eight days, and gradually, layer by layer, the structure is becoming visible. I have concerns that this may affect the nearby houses. Previously, excavation was being done using a JCB, but now machine digging has been halted to minimize damage to the surrounding structures. Instead, manual method is being used for the excavation.”

As per the Excavation Incharge, Priyanka Singh, “40-50 labourers are working here daily, and our work is going on in both shifts and digging is going on here continuously.”

In another development, construction began for a new police outpost near Jama Masjid in Sambhal, Uttar Pradesh on Friday.

Meanwhile, RAF jawans have been deployed near the construction site to ensure security. This development comes after recent violence in the area, which resulted in casualties. It aims to strengthen security and prevent further unrest.

On Friday, District Magistrate Dr Rajinder Pensiya said that efforts are underway to reopen wells and CCTV cameras are being installed to enhance security in Sambhal.

“19 wells and 68 sacred places, a total of 87, are known as Dev Tirtha… many of the wells are being reopened as natural resources of water conservation by removing encroachment,” Pensiya told ANI.

On Wednesday, to restore wells and pilgrimage sites in Sambhal and reconnect the local community with their religious traditions, a team from the ASI and local administration visited several historic locations. The ASI inspected ancient structures, including Ferozpur Fort, stepwells, and Chor Kuan.

Delhi HC acquits Sahjan Ali convicted of raping 14-year-old girl of ‘different religion’, says merely mentioning ‘physical relation’ does not amount to intercourse

On 23rd December, Delhi High Court overturned the life imprisonment sentence of a man convicted of raping a 14-year-old girl under the Protection of Children from Sexual Offences (POCSO) Act and the Indian Penal Code (IPC). The accused in the case, Sahjan Ali, was 22-year-old and the victim was only 14 years old at the time of the incident. The judgment was delivered by a two-judge bench comprising of Justice Prathiba M Singh and Justice Amit Sharma. The court cited a lack of evidence against the petitioner in the case as merely mentioning ‘physical relation’ cannot be converted automatically into sexual intercourse let alone sexual assault.

Background of the case

On 18th March 2017, the mother of the minor girl filed a complaint at Madhu Vihar Police Station alleging that her daughter was kidnapped. The complainant stated that the minor girl was last seen at her home and later it was discovered that she was missing. The next day, the minor girl was located in Faridabad with Sahjan Ali. He was promptly arrested by the police.

In her initial statement, the minor told the police that she had voluntarily gone with the accused and described him as her boyfriend. She further claimed that they stayed together in a rented room. However, as the girl was minor, Ali was charged under Section 376 of the Indian Penal Code (IPC) for rape and Section 4 of the POCSO Act for penetrative sexual assault. He was convicted by the trial court and sentenced to life imprisonment. The trial court asserted that his actions constituted an offence irrespective of the consent given by the minor girl.

Ali filed a petition in the Delhi High Court challenging the trial court’s judgment. In its judgment, the High Court stated that the statements given by the victim cast doubt on the prosecution’s case. In the initial testimony, she identified the accused as her boyfriend and stated she had known him for over a year before the incident.

The victim told the court that she had left her home voluntarily to meet Ali and travelled with him to Faridabad via public transport. She further added that they had stayed in a rented room where they engaged in what she described as “physical relations”. However, the victim never told the court in detail or clarified the nature of those physical relations.

During cross-examination, she explicitly denied any use of force or coercion by the accused. The victim told the court, “During my stay with the accused, he did not commit any physical assault upon me, nor did he commit any wrong acts with me.” Furthermore, the victim added that she left the home because her parents opposed the relationship between her and Ali as he belonged to a different religion.

The complainant, the victim’s mother, who filed the initial complaint in the matter, stated that her daughter did not inform her of any incident of sexual assault. She said, “It is correct that my victim daughter did not tell me that the accused has ever sexually assaulted her or committed rape upon her.” The testimony by the victim and her mother weakened the prosecution’s case as it contradicted the charges of kidnapping and sexual assault.

Furthermore, the accused also claimed in his statement in the court that the victim willingly accompanied him. He categorically denied any intent to harm her and asserted the allegations against him were fabricated due to the opposition from the family of the victim who were not in the favour of their interfaith relationship.

What medical report said

Shortly after the incident, the victim was sent for a medical examination. The medical examination report (MLC) presented in the court revealed that there were no external injuries or evidence of physical or sexual assault. The MLC further noted that the victim reported having consensual physical contact with the accused. However, there were no signs of force or penetration. The MLC stated, “No history of physical/sexual assault as stated by her. Examination of injuries – no external injuries seen.” The court in its judgment highlighted that the MLC did not support the prosecution’s claims of penetrative sexual assault.

What law says

Section 375 of the IPC and Section 3 of the POCSO Act categorically state that consent for sex is immaterial when the girl is a minor. However, the High Court emphasised that the prosecution must establish clear evidence of penetrative sexual assault or other acts defined under these sections.

Justice Prathiba M Singh observed, “The survivor, in fact, used the phrase ‘physical relations,’ but there is no clarity as to what she meant by using the said phrase. Even the use of the words ‘samband banaya’ is not sufficient to establish an offence under Section 3 of the POCSO Act or under Section 376 IPC. Though consent would not matter if the girl is a minor under the POCSO Act, the phrase ‘physical relations’ cannot be converted automatically into sexual intercourse let alone sexual assault.”

How the judges reached the conclusion

The High Court noted that the trial court failed to provide any substantial reason for the judgment delivered against the petitioner Ali. Justice Singh, writing for the Bench, said, “It is thus unclear as to the manner in which the trial court came to the conclusion that there was any sexual assault by the Appellant. The mere fact that the survivor is below 18 years cannot lead to a conclusion that there was penetrative sexual assault.”

The judgment further stated, “The fact that she voluntarily went with the Appellant is also not disputed. However, the leap from physical relations or ‘samband’ to sexual assault and then to penetrative sexual assault is one which has to be established on record by means of evidence, and the same cannot be presumed or deduced as an inference. In such cases, the benefit of doubt ought to be in favour of the accused.”

Because of the inconsistencies in the evidence and lack of clarity in the statements given by the victim, the High Court acquitted Ali. The court further stated that the prosecution failed to prove the charges beyond a reasonable doubt. The Bench also criticised the trial court as it failed to analyse the evidence in a comprehensive manner.

Arvind Kejriwal takes fake moral high ground on Yamuna issue, promises to ‘clean the river’ despite not being benefitted electorally

Ahead of the 2025 Vidhan Sabha elections in Delhi, Aam Aadmi Party (AAP) supremo Arvind Kejriwal has attempted to take a ‘moral high ground’ on the issue of Yamuna river pollution.

In a recent podcast interview, Kejriwal said, “I have started understanding politics a bit. I will not get votes on the issue of Yamuna.”

With an air of moral superiority, the AAP supremo claimed, “Even then, I will get the Yamuna river cleaned. I did not come to the scene for electoral politics. Others are doing it anyway.”

He further alleged, “They were already politics with money and making money from politics. I did not enter politics to do that.” Arvind Kejriwal claimed that he did not build schools and hospitals to get votes.

“Yamuna can be cleaned and it will be cleaned,” he promised during the podcast interview.

While the AAP supremo seems to have turned the Yamuna issue into a moral obligation, the truth is that his latest posturing is a diversionary tactic to avoid accountability.

Arvind Kejriwal and his decade-long promises to clean the Yamuna river

Yamuna river and the associated water pollution become a focal point in the politics of the National Capital during festive seasons. Devotees are seen taking a holy dip amid carcinogenic foam.

This triggers debates in public discourse about the progress of the Yamuna cleaning campaign, which was advocated by none other than Arvind Kejriwal as early as 2015.

At that time, the AAP supremo had promised to clean and revive the water body within a span of 5 years i.e. by the year 2020. “We will revive Yamuna within five years,” he had claimed then.

In November 2019, he said his government has planned to clean the Yamuna in the next four to five years, and people would be able to take a dip in it.

In December same year, he promised the people attending his rally that by the next elections (scheduled in 2025), he would take the whole village for a dip in the Yamuna.

In January 2020, just before the assembly elections, Arvind Kejriwal had claimed, “The Yamuna will be cleaned and made pollution-free. We promise that after five years, anyone will be able to take a dip in the Yamuna without fear of diseases due to dirty water.”

In the budget presented by Delhi Government for the financial year 2023-24, around 1,028 crores have been earmarked for cleaning River Yamuna. CM Kejriwal again promised that he would take a dip in the river in the next assembly elections, a promise that he made before but never fulfilled.

In April last year, it came to light that the Delhi Government led by Arvind Kejriwal spent around ₹6,856.91 crores in 5 years between 2017-2021. 

Interestingly, data obtained from the Delhi Pollution Control Committee (DPCC) suggests that the pollution in the Yamuna river has doubled between 2015 and 2023.
