Suspended J&K DSP Devender Singh was working under Pakistani handlers in Pakistan High Commission for espionage activities: NIA chargesheet

Suspended Deputy Superintendent of Jammu and Kashmir Police Devender Singh, who was arrested along with two Hizbul Mujahideen terrorists, was working under Pakistani handlers from Pakistan High Commission in New Delhi. This was revealed in the chargesheet in the case filed by the National Investigation Agency (NIA).

The chargesheet was filed in front of a special court in Jammu by the terror probe agency in the first week of July. According to it, Devender Singh was instructed by his handler to establish contact with the Ministry of External Affairs for espionage activities. According to NIA, Singh was in constant touch with his handlers in the Pakistan High Commission. These handlers were sent back to Pakistan by the Indian government after they were caught spying in India.

Giving details of how the once decorated police officer had worked with Pakistani handlers, the 3,064 page charesheet says that he had saved the number of his contact in the Pakistan High Commission as “Pak Bhai” (Pakistani brother). His handler had assigned him various tasks, which included detail of movements of armed forces and schedule of visits of VIPs in the Kashmir valley.

After Devender Singh started to spy for Hizbul Mujahideen, he was asked to establish contact with the external affairs ministry so that he can gather information from there. But he was unable to make any progress in this task, the NIA said.

The chargesheet filed by NIA accuses Singh and others of waging war against India with the help of Pakistani spies in India and Pakistan-based terror organisations. The NIA also says that Singh was in touch with Pakistan High Commission officials through social media platforms. He was being groomed by Pakistani handlers to obtain sensitive information from Indian government.

Apart from Devender Singh, the chargesheet also names Hizbul commander Syed Naveed Mushtaq alias Naveed Babu, his brother Syed Irfan Ahmad, the terror group’s overground worker Irfan Shafi Mir, accomplice Rafi Ahmad Rather and businessman Tanveer Ahmad Wani.

NIA has said in the chargesheet that the Pakistani govt has been using all possible means to fund, arm and sustain the terrorist activities of the banned terrorist organization Hizbul Mujahideen.

Devender Singh was arrested in January 11 this year by Jammu and Kashmir police when he was travelling in a car along with two Hizbul terrorists Naveed Babu and Asif Rather, and an advocate. They arrested near Mir Bazar in Qazigund area of Kulgam District when they were reportedly travelling to Delhi. Arms and ammunition including an AK-47 rifle and some hand grenades were found in the Maruti car used by them. Later, more arms were recovered from Singh’s house in Shivpora near army headquarters in Badamibagh.

After the arrest by J&K police, the case was handed over to the NIA.

The Hizbul terrorist Naveed Babu arrested along with Singh is also a former J&K police constable, who had fled in 2017 with two AK-47 rifles and joined the terror group.

During arrest, DSP Davinder Singh was currently posted at the Srinagar International Airport. Earlier he was in the anti-hijacking squad of J&K police, and before that a part of the special operations group when the elite force was established. He was posted as an inspector in the SOG, and due to his successful anti-terror operations, he had got an out-of-turn promotion as DSP.

But later he was removed from SOG after there were allegations of extortions against him, and he was suspended from services for some time. After that, he was posted at the police control room and then the anti-hijacking unit.

‘Pune is well-equipped to handle Coronavirus crisis if state govt runs health centres professionally’, says BJP MLA Siddharth Shirole who is leading the fight in the city

As the coronavirus cases continue to surge in Pune with nearly 1.7 lakh coronavirus positive cases being reported, Siddharth Shirole – the BJP MLA from the Shivajinagar constituency in Pune on Sunday said despite the sporadic rise in the number of cases, the city is well equipped to tackle the fresh coronavirus cases provided the Maha Vikas Aghadi government professionally ran the health centres.

Speaking to OpIndia on the issue of the recent rise in cases in Pune, Siddharth Shirole, who is leading the charge of Pune’s fight against the coronavirus pandemic, said that even though there was a sudden splurge in the coronavirus cases, there is no need to panic as the mortality rate is in very much in control in Pune.

Shirole, who represents Shivajinagar constituency of Pune, added that they have already created enough healthcare facilities that are equipped with ventilators and oxygen support that could treat nearly 2,000 coronavirus patients effectively.

“The numbers have increased in the last 7-8 days. Fortunately, we have sufficient infrastructure in terms of oxygen beds and ventilators…Our only objective is to get the mortality down and it can be done with early detection and treatment,” Siddharth Shirole added saying they were ready to tackle the pandemic if the second wave of coronavirus cases hits the city.

The Shivajinagar MLA also said the city now has two dedicated coronavirus facility of 2,000 beds, one in Pune and the other in Pimpri Chinchwad Municipal Corporation areas. However, Shirole insisted that there is a need for carrying out more real-time polymerase chain reaction (RT-PCR) to detect the fresh cases in the city, which according to him has now spread to more affluent areas of the city.

The early detection of the cases and treatment is extremely important in keeping a check on mortality rates, said Shirole.

“The early intervention, detection will lead to better treatment thus reducing the number of mortality rates in Pune,” the Shivajinagar MLA pointed out while speaking to OpIndia.

Maharashtra government need to run coronavirus facilities effectively

According to Shirole, the newly created infrastructure in both Pune and PCMC areas are sufficient to tackle the crisis, however, in order to carry out effective treatment, he added that the Maharashtra government needs to responsibly manage the jumbo coronavirus centres that were recently built in Maharashtra’s second-largest city.

Interestingly, the two jumbo coronavirus centres, an 800-bed-facility each at Pune and PCMC, were only built after an intervention from Siddharth Shirole. With private facilities already stretched and also being used for non-COVID related cases, Shirole had fought hard for a dedicated coronavirus facility in Pune to free up the private and other healthcare facilities to treat non-COVID patients from in and around the city.

Earlier in July, Siddharth Shirole had also written a letter to the central government seeking intervention from them to ward off the looming medical infrastructure crisis in Pune.

In a scathing criticism of the Maha Vikas Aghadi government in Maharashtra, Shirole had said that the Maharashtra government had left Pune to fend for itself from the surging coronavirus spread. He had accused the government of gross negligence which has pushed the city on the cusp of a medical calamity.

Accusing the state government of failing on multiple levels, Siddharth Shirole had said that Chief Minister Uddhav Thackeray had not made a single visit to Pune in the last three months either to oversee the preparedness of the administration.

After a long battle with the Shivajinagar MLA over the issue of dedicated coronavirus facility in Pune, the Maharashtra government had finally relented in the last week of July and had agreed to set up two dedicated coronavirus facilities in Pune.

Maharashtra government need to enforce Central guidelines on coronavirus, need to relax restrictions

The Pune MLA also said that the Maharashtra government should follow the guidelines issued by the centre and relax certain restrictions to restart the economic activities in the state.

Explaining that the continuous restrictions is detrimental to the economic activity of the country, Shirole accused the Uddhav Thackeray-led government of regulating travel and imposing curfew that has resulted in slowing down of business activity. He also added that the e-pass facility has become a cumbersome process and already turned out to be a big hurdle for people to start their livelihood.

The lawmaker also urged the Maharashtra government to adhere to the recently issued guidelines and open up the state for the economic revival of small, medium and big businesses across industries.

Siddharth Shirole, rejecting the idea of another lockdown to bring down the number of cases in the state, the lockdown will not help to tackle the pandemic but instead opening up of the economic activities could revive the livelihood of the people in the state, he added.

As of Sunday, August 30, Pune has recorded almost 1,70,000 total coronavirus positive cases with almost 4,000 new cases registered on Saturday. More than 1,16,000 patients have already recovered with only less than 50,000 active cases.

It has overtaken Mumbai long back, which has been one of the major hotspots for coronavirus. As of now, Maharashtra contributes to over 21% of total coronavirus cases in India. Maharashtra also contributes to almost 40% of total deaths due to coronavirus in India, with more than 7,64,000 cases and nearly 24,000 deaths.

Lockdown musings: The Bloomsbury debacle, the legacy of the Congress party and Narendra Modi’s vision of Aatmanirbhar Bharat

The distressing news that Bloomsbury India, who had printed Advocate Monica Arora’s co-authored book “Delhi Riots 2020, the Untold Story” has recently decided to stop its announced launch and publication; and to reduce all its printed copies to pulp. The book covers the violence that erupted in the capital after the passage of the Citizens’ Amendment Act (CAA) by both the houses of the Indian Parliament on 11th December 2019. 

Interested political and religious groups opposed this bill on mostly unfounded fears, and they organized a prolonged sit-in protest at Delhi’s Shaheen Bagh and other Left-controlled venues. The sit-in and the attendant protests have been covered in detail by the press and TV and it is not my purpose here to recount the entire sordid saga.

Nupur Sharma, the intrepid editor of the web journal Opindia, burnt the proverbial midnight oil to put together a report on these riots. Published as an ebook on Kindle by Amazon, “An Opindia Report on Delhi Anti-Hindu Riots 2020” has been available for download from the Amazon portal. The ebook is today marked as No. 1 Bestseller in the Kindle Store and carries a 5-Star rating. For Kindle subscribers the book is available for free, while for others it costs a mere Rs. 101/-. Ms Sharma too found it difficult to get a publishing house to print her incendiary findings.

Bloomsbury India is a chicken-livered branch of Bloomsbury UK, and has acquired quite a reputation for chickening out when some extremist left-wing fringe, merely bares its teeth to show unhappiness with its choice of publications. This time it appears that the Jaipur Litfest organizer William Dalrymple (a known Hindu-hater) had shown his displeasure at Bloomsbury India’s choice of book. This information was put in public domain by none other than Aatish Taseer who hates everything about Hindu India, ever since he was caught lying that resulted in the cancellation of his OCI status.

Tavleen Singh and Salman Taseer’s son has never missed a single opportunity to spew venom against India, especially its Hindus. He has specifically targeted Prime Minister Modi and Home Minister Amit Shah in language that is not only disrespectful, but also, downright disgraceful.

Some years ago Bloomsbury India had entered into an agreement with Business Standard to publish a book “The Descent of Air India” written by Jitender Bhargava, former Executive Director of the airline. The book, published in October 2013, had exposed the nefarious role of the Nationalist Congress Party (NCP) leader Praful Patel, as the Minister for Civil Aviation from 2004 to 2011, and held him directly responsible for the “descent of Air India” into extreme financial windstorms.

Immediately upon its publication Praful Patel filed a criminal defamation suit against the publishers. Incidentally, the lawyer who represented him then was the same Satish Maneshinde who is representing Rhea Chakraborty now in the Sushant Singh Rajput case. Bloomsbury chickened out and in January 2014 made an out of court settlement with the complainant.

Bhargava insisted that his book was based on existing documents, and Business Standard had said that it would stand by its commitment, but the publisher had no spine to stand up to this bullying. Bhargava subsequently published the work as an ebook on Amazon Kindle in March 2014. He self-published a hard copy in 2016, though it is my understanding that Business Standard picked up the tab for the same, honoring the agreement the newspaper had made with the author. Praful Patel withdrew the defamation suit in 2017.

The airline has not recovered from the battering it received during the Patel era, and the hole he dug for it is so deep that it is impossible to fill in. In fact, it is a mystery why this man has not been hauled in by the investigative machinery and put behind the strongest bars possible.

The social restrictions imposed by the current epidemic have reduced one to a state of mental torpor. With travel and outdoor activities on the banned list, one has had to take solace in reading books and sitting in front of the idiot box for prolonged periods. Not that these activities do not have their own rewards. I have been able to get through many large volumes; their size making one put them off repeatedly in favor of smaller and thinner books.

But once the slim ones are dealt with, there are no more reasons to keep the fat ones waiting on the shelves. I have managed to go through my entire “unread” library at home. Bhyrappa’s “Crossing Over”, Murakami’s “Killing Commendatore”, Roberto Bolano’s “2666”, Vikram Sampath’s “Savarkar” and Ghose & Dhar’s “Conundrum” were some of the books I had kept waiting on my shelves. With nothing “unread” now on the shelves, I have started re-reading some books that have somewhat faded from my memory.

Recently I re-read Aleksandr Solzhenitsyn’s “Cancer Ward” originally published in 1968. An absolute masterpiece, the book is an allegorical autobiography. Solzhenitsyn was diagnosed with cancer while undergoing exile in the Kazhakastan steppes, and the experiences of his protagonist Oleg Kostoglotov, while undergoing treatment at one of the squalid hospitals in Communist Russia, must be drawn directly from his own experiences.

“Cancer Ward” is Communist Russia in microcosm. Not only are ordinary people the victims of the Stalinist Police state, but also the instruments of that state are succumbing to various kinds of cancerous diseases. Solzhenitsyn’s despair is unrelieved by some attempts at humor, and the picture he paints of Soviet Russia is one of gloom and doom. The Communist interlude in Russia’s history had completely destroyed its soul, and Solzhenitsyn has tried to bring home to the people their true condition. According to him the country had forfeited the entire 20th century, and only a spiritual renewal could revive the patients in the Ward.

Somewhat similar is the case in India. Not only have we forfeited the entire 20th century, but also the first decade-and-half of the 21st. Nehru and the Congress party’s obsession with Communist Russia blinded them to the actual goings-on within that totalitarian state. The failures of the five-year plans; the successive disasters in agricultural experiments made Russia increasingly dependent upon the West. But Stalinist Russia did not graft any Western criteria upon the Russian spirit. On the contrary, its influence let loose violent, Dionysiac, and sometimes demonic forces. 

Nehru and his daughter adopted the Russian models without even trying to think if these could be applied wholesale on the Indian spirit. A nation that had been crushed by invasive Islamic demonic and European Dyonysiac forces for 700 years was looking forward to a spiritual renewal, but Nehru and the Congress party, in their search for perpetual hegemony, instead continued to crush its spirit under a manufactured, false “secularism” that demonized the ancient Hindu culture and put “socialism” on a pedestal.

I am not sure if it was the old Roman historian, Gaius Sallustius Crispus, who said, “the struggle between parties is and will always remain a misfortune for the people, worse than war, famine, plague, or any other manifestation of God’s wrath.” The struggle between the Congress party, now reduced to a rump, led by a dangerous buffoon and his grasping family, aided by almost the entire political opposition in the land, on one hand, and the BJP trying to revive the ancient spirit, on the other, is resulting in all that Crispus had predicted. Crushed in between this struggle are the unfortunate people who, in 2014, had put all their hopes at the door of Narendra Modi.

When Modi first spoke to the people from the ramparts of the Red Fort in Delhi, he was aware of the expectations of those who had given him the necessary vote of confidence to lead the nation. That morning on 15th August 2014 he spoke with quiet assurance about the real tasks ahead of him and his countrymen. He wanted to put to rest the divisive agenda that had informed political discourse until then.

He spoke about the safety and education of the girl child; the urgent need to clean up the dirt and squalor from public areas; the need to build millions of toilets to avoid the indignity of open defecation. He spoke about the need to build “pucca” homes for the poorest of the poor; to stop farmer suicides by providing them with safety nets, crop insurance, easy and cheap credit facilities; and many other structural reforms that would make the lives of ordinary Indians more bearable, if not happy. Modi has never deviated from this script, even after signing multi-billion dollar contracts for the modernization of the Indian armed forces.

Unfortunately, from the very first day Modi has been attacked by the demonic forces unleashed by the erstwhile “secular” and “socialist” parties and not one of them has come forward to assist him in his national endeavors. In their attempt to unseat him they have coopted the mainstream media consisting of the press and television, not only within our borders, but also all over the West. Forces inimical to a rising India have joined hands with these malcontents and are destroying the very fabric of our society.

The media is particularly pernicious and bent upon proving the 19th century German philosopher, Walter Benjamin, right about his views on the 4th estate. Benjamin called the press “an industry that mass produces empty phrases.” The term “public opinion” outraged him, for as he put it, “opinions are a private matter. The public has an interest only in judgments. Either it is a judging public or it is none. But it is precisely the purpose of the public opinion generated by the press to make the public incapable of judging, to insinuate into it the attitude of someone irresponsible, uninformed.”

The forces that hate a rising and open India have once again struck when they bullied Bloomsbury into cancelling the publication of the alternate version of the Delhi 2020 riots, while giving full attention to a false narrative written by Ziya-us-Salam and Uzma Ausaf. The hold of these demonic powers is still intact, six years after the defeat of the Congress party.

Narendra Modi, it seems, has read and internalized many of Walter Benjamin’s ideas. His emphasis on “Atmanirbhar Bharat” for promoting small industries with micro loans for “Make in India” vision, is fully in tune with Benjamin’s warning when he said that the energies developed by technology beyond their threshold “serve primarily to foster the technology of warfare, and of the means used to prepare public opinion for war or for orgies of buying in the consumer society.”

Undeterred by the opposition of the enemies within and without, he has quietly been applying his shoulder to the wheel in order to keep the cart moving. I am sure he must be disappointed by many of his supporters who do not possess the macro vision he has for India. Modi knows that there is an entrenched system that has been in place for hundreds of years. There is no short cut to removing each obstacle on the track. These have to be handled one by one, and at first there may not be any visible progress.

The old Colonial setup is still largely in place. Though much has changed superficially, but deep underneath the premise that the West is culturally superior still continues to inform our intelligentsia, and most of our reforms in religion, customs, values and laws are designed to meet the imperatives of Western ideas of rationality. We keep looking to the West for approval and this mindset is making the vision of “Atmanirbhar Bharat” that more hazy.

Coming to the idiot box, I must admit that I have had some really rewarding moments while watching some classical cinema from various international masters of the art. I have seen some wonderful films from Turkey, Iran, Spain and Russia. “Rams” a film from Iceland, was fabulously shot – the story simple, stark, and soulful. However, the film that has profoundly affected me is Paul Schraeder’s “First Reformed.” Schraeder has written some remarkable scripts that include “Taxi Driver” “Raging Bull” and “Last Temptation of Christ.” He wrote and directed “Mishima – A Life in Four Chapters” that is based upon the legendary Japanese writer’s magnum opus “The Sea of Fertility” a tetralogy, at the completion of which the author committed ritual seppuku.

“First Reformed” is brilliantly written and directed by Schraeder, while the protagonist, Ethan Hawke’s performance is outstanding, to say the least.  There are some lines from this film that are indelibly etched in my memory. When I think how much despair and despondency is felt by some of those who supported Modi in the beginning, I recall the following words of Ethan Hawke as Rev. Ernst Toller:

“Courage is the solution to despair, reason provides no answers. I can’t know what the future will bring; we have to choose despite uncertainty. Wisdom is holding two contradictory truths in our mind, simultaneously, Hope and despair. A life without despair is a life without hope. Holding these two ideas in our head is life itself.”

“We tend to think that anxiety and worry are simply an indication of how wise we are, yet it is a much better indication of how wicked we are. Fretting arises from our determination to have our own way.”

Most of us on social media are generally part of the well-educated, well-provided elite, even though we may not belong to the Left-Liberal gangs. We tend to look at public policy through our own lenses, usually ending up with the question “what does it have for me?” We think that since we support Modi he has some obligation to address our particular pet peeves. We want him to reduce our taxes, especially during these distressing times. We want him to boost the economy, provide jobs and employment, as if he possesses some kind of a magic wand.

We want him to put the wrongdoers away almost instantly, and fret when these things do not happen, or happen slowly. We are impatient with the pace at which he addresses our demands. We were unhappy with his policy on education and fretted at the control the leftists had on our educational institutions.

Now that the NEP has come, we expect the entire cabal of the erstwhile controllers to go into instant and prolonged coma. Today’s Bloomsbury episode would have further alienated some of his supporters, the so-called right-wingers. I have read many tweets that threaten not to vote for him in 2024. When asked whom they would vote for, there’s a deafening silence. I have to remind them all that NOTA is not an alternative – it is as good as a vote for the opposition that we dislike.

In his 15th August 2020 address from the Red Fort, the PM has once again reiterated his commitment to the poorest of the poor. If I have heard him right, currently, we are not in his scheme of things. Covid-19 has devastated the economy, more so the informal one. There are millions who are reduced to destitution and despair by this epidemic. Though it has not spared the well to do, its impact on the poor has been calamitous.

The prolonged lockdown has destroyed hundreds of millions of jobs, with no alternatives in sight. That the devastation has been reasonably contained is mainly due to the immediate relief and release of funds and food grains to the BPL families. The system of Direct Benefit Transfer that was put in place six years ago has ensured minimum leakage from the relief packages. Corruption may still pervade the system, but its impact is not as pernicious as it used to be.

We are still far away from safety, and it is not sure when the lockdown and other restrictions would be lifted. Many of the businesses may never reopen. Many employees may find that their employers have either gone bankrupt or have no customers for their products. Many may not have the appetite to reopen shut shops. Many will have to reskill themselves in order to find a foothold in the employment bus.

At the end of the film, “Just Mercy” that deals with racial prejudice that never really died in Alabama and other southern states in the US, even after affirmative action, the protagonist, a young black lawyer, Bryan Stevenson, has these profound words for us:

“The opposite of poverty isn’t wealth, the opposite of poverty is justice; that the character of our nation isn’t reflected in how we treat the rich and the privileged, but how we treat the poor, the disfavored, and the condemned.”

That, in short, is what Narendra Modi is trying to tell us. He is trying to save us from being crushed under the rubble. Are we listening?

Portland, USA: Trump supporter murdered during violent riots after Democrat Mayor refuses federal aid to end rioting, Antifa celebrates

A supporter of US President Donald Trump was murdered in Portland, USA during a night of violent clashes following months of rioting by Antifa goons. Following the murder, the far-left rioters celebrated the death of the Trump supporter, branding him a fascist. The murder occurred after the Mayor of Portland, who happens to be a Democrat, Ted Wheeler, rejected federal law enforcement in the city.

In his statement rejecting the offer made by US President Donald Trump, Ted Wheeler claimed, “We don’t need your politics of division and demagoguery.” He also claimed that there was no place for rioting and looting in the city, However, for weeks on end, he has been utterly unable to put an end to the endless spree of violence in the city.

Portland Police said in a statement, “Homicide detectives are aware of videos circulating on social media that show the shooting. It is important for detectives get a full and accurate picture of what happened before, during, and after the shooting. If anyone was a witness, has video, or has information about the homicide, they’re asked to contact the primary detectives.”

Police Chief Chuck Lovell stated, “It is still early in this investigation, and I ask everyone to give the detectives time to do their important work before drawing conclusions about what took place.” “If anyone can provide information about this case, I ask them to please reach out to our detectives. This violence is completely unacceptable and we are working diligently to find and apprehend the individual or individuals responsible,” he added.

Radical Islamist Sharjeel Imam wanted to turn Anti-CAA protests into a pan-India movement: Reports

The Delhi police have made shocking revelations in a new charge sheet filed against radical Islamist Sharjeel Imam. According to it, The former JNU student, accused of engineering Jamia Riots in December last year, ‘desperately’ wanted to turn the Anti-CAA ‘protests’ into a pan-India movement.

“The accused was very desperate to take the protests that level where the leaders of the protestors take the control of the mob in their own hand,” the charge sheet revealed. Sharjeel Imam was in close contact with a member of the radical Islamist outfit, Popular Front of India (PFI) who asked him to take part in the Anti-CAA protests as a part of the organisation. As a part of his modus operandi, he had visited Anti-Caa protest sites in Khureji and Seelampur which witnessed widespread violence.

Sharjeel Imam distributed pamphlets and mobilised mobs

The Whatsapp chats of Sharjeel Imam has also exposed how he weaponised ‘misinformation’ in north-East Delhi to further his agenda with the help of local Islamic clerics. Imam mobilised the Muslim community and laid the foundation for a ‘disruptive Chakka Jam’ in Delhi and other parts of India.

According to the charge sheet filed by the Delhi Police,  Sharjeel Imam had visited several mosques and distributed pamphlets in the Nizamuddin area of Delhi and other places with the help of one Mohammed Kasif. His objective was to provoke Muslims to engage in violence, under the pretext of Anti-CAA protests.

The new charge sheet against Sharjeel Imam was filed under the Indian Penal Code (IPC) Sections 124A (Sedition), 153(A) (Promoting enmity between different groups), 153 (B) (prejudicial assertions), 505 (rumour mongering) and Section 13 of UAPA (Unlawful Activities Prevention Act). On August 25, he was arrested by the Delhi Police Special Cell in another case related to the Delhi riots. Reportedly, Imam was brought back to Delhi from Islam on a productional warrant and then remanded in police custody for 4 days.

The Conspirator behind Jamia riots

Earlier, Islamist Asif Iqbal Tanha admitted to orchestrating a march of 2500-3000 people from the Gate no.7 of Jamia Millia Islamia on December 12. He revealed that Sharjeel Imam gave a provocative speech to encourage ‘protestors’ to execute a ‘chakka jam’ on December 13. Asif confessed to organising a ‘Gandhi peace march’ on December 15 from the Jamia metro station to the Parliament via Zakir Nagar and Batla House. He stated that the purpose of naming it after Mahatma Gandhi was to lure more people into joining the march.

Conviction of Prashant Bhushan for contempt of court is justified and does not amount at all to ‘destruction of democracy’

Recent controversy relating to conviction of Sri Prashant Bhushan, Advocate (herein after referred to as the contemnor) for contempt of court has given opportunity to some interested persons to create erroneous impression in the minds of the public and more importantly among law students and Junior Lawyers about the judiciary in the country and in particular the Supreme Court of India.

People are led to believe that this judgement of the Supreme Court is a frontal attack on free speech exercised against judiciary and in particular the Supreme Court or an assault on an independent Bar attempting to prevent it from fearlessly speaking out against wrong doing in the judiciary. It is alleged that, by this judgement, the Supreme Court wants to send a message that the judiciary will not tolerate any criticism, however justified it may be, and that it wants to threaten and warn members of the bar by misusing its power to punish for contempt. Nothing is farther than truth as it will be discussed later.

In their attempt to find fault with the Supreme Court, actions of the contemnor are glorified and he is portrayed as a crusader fighting against corruption and a fearless champion of right causes. Students of law and junior lawyers are led to believe that a lawyer who frequently criticizes judiciary and judges will receive great admiration as a fearless lawyer and gain immense popularity.

Several articles and write ups supporting Prashant Bhushan and critical of judgement of the Supreme Court are thus misleading the law students and junior lawyers, virtually leading them on the wrong and dangerous path which will undoubtedly mar their future career.  This article is essentially to prevent the same.  

So far as the assertion that the judgment is to threaten the members of the Bar impairing their freedom of speech so that they may not level any criticism against judiciary or the judges is concerned, it may be remembered that the Bar in India is independent and strong enough not to be swayed away by such threats. Experience has shown that the lawyers have never lagged behind nor shirked their responsibility to criticize judges whenever the same was justified and necessary.

Such criticisms are frequent occurrences and there have been no instance of any action for contempt. Those supporting the contemnor and criticizing the judgment are not bringing it to the notice of the public that the contemnor is a repeat offender so far as contempt of court is concerned and there are numerous instances in the past when the Supreme Court has passed adverse comments against him. They have also been instances where action was not taken since he withdraw the allegations/tendered apology.

There is a long list of instances where different judges of the Supreme Court including Chief Justice R.M.Lodha, Chief Justice Dipak Misra, Chief Justice Khehar, Chief Justice T.S.Thakur,  Justice Dr. DY Chandrachud, Justice Madan Lokur, Justice Kurian Joseph, Justice A.K.Sikri, Justice R.Bhanumathi, Justice Arun Misra, Justice S.K.Kaul, Justice Gavai have passed adverse comments on him for his conduct.

The present case should not be seen in isolation but has to be considered in the light of the past conduct which unmistakably points to the malicious intention to malign judges whenever their judgements are not in favour of the contemnor. Very rarely courts have initiated action for contempt and it is unfair to say that judges are intolerant of any criticism. Mostly, even wholly unjustified criticism is ignored.

But where an Advocate continuously makes scandalous allegations and in spite of several warnings and reprimand continuous to denigrate the Supreme Court and the judges, will not the court be justified in taking action? That is what has happened here. The court would have failed in the duty if no action was taken when such persistent and deliberate attempts are made to malign and denigrate the Supreme Court resulting in people to losing faith in the highest court of the country.  

Now coming to the facts of the case, as I pointed out, there are two tweets. Suffice to deal with only one that too very briefly. In the second tweet the contemnor says democracy is destroyed by the Supreme Court in the last six years and four Chief Justice of India are also responsible for this. In justification of the comment, Sri Navroj Seervai, Senior Advocate has referred to only two instances, one regarding complaint of sexual harassment against Former Chief Justice of India Justice Gogoi and the other is the conduct of Former Chief Justice of India Justice Dipak Misra as complained of by four judges in the press conference mostly relating to allotment of work amongst judges.

One fails to understand what these allegations have to do with destruction of democracy by the entire Supreme Court. Allegation in the tweet is not against individual judge but on the entire Supreme Court as an institution. It is a scandalous allegation against every judge of the Supreme Court during the last 6 years and that includes four judges who held press conference. Apart from the question of contempt, can it even be considered as a responsible statement of an advocate practicing before Supreme Court and who claims to have lots of love and affection for the Supreme Court?

My appeal to the law students and junior lawyers is to not consider the conduct of contemnor as a model worthy of emulation so far as criticism of the Judiciary and Judges is concerned. They should not be guided by the fact that the contemnor has quoted Mahathma Gandhi in the contempt action initiated by the British against the latter. Those circumstances were entirely different. There is no comparison between the two cases.  

Withdrawn by Bloomsbury, ‘Delhi Riots 2020: The Untold Story’ book being published by Garuda Prakashan gets an overwhelming response with 30,000 preorders

Days after publishing house Bloomsbury de-platformed the ‘Delhi Riots 2020: The Untold Story’ book and Garuda Prakashan went ahead with the publication, the book has crossed a whopping 30,000 preorders.

Taking to Twitter, BJP leader Kapil Mishra tweeted, “30,000 copies already booked… I pledge I will buy 100 copies of Delhi Riots’ Untold Story.” He added that he would distribute the books to people. Mishra then set an ambitious target of 50,000 pre-orders and urged people to make the target possible. “Let us make a record of 50,000 bookings”, he reiterated.

The book, which is a factual account based on investigation and interviews conducted by the authors, was scheduled to be published by Bloomsbury in September. 100 copies of the book were printed and handed over to the authors, and it was available for pre-order on Amazon. However, following the outrage by Islamists and left-liberal jamaat on social media, Bloomsbury issued a statement announcing the withdrawal of the book. The book authored by Monika Arora, Sonali Chitalkar and Prerna Malhotra was abruptly withdrawn by the publishing house on 22nd August under pressure from UK Office even as the authors were attending a virtual launch of the book. Later, co-author Monika Arora informed that they have decided to publish the book through Garuda Prakashan. Now the book is being published in Hindi too.

The backslash from the Islamists came as a blessing in disguise for the book, as people from the right-wing rushed to place orders for the book just after it was announced that Garuda Prakashan will publish it. Due to overwhelming demand, the server of the publication house had crashed, and publishers had to make alternate arrangements for receiving orders. Within less than an hour of the book was open for pre-booking, it had sold over 10,000 copies.

Soon after the book shifted hands from Bloomsbury to Garuda, a PDF copy of the manuscript of the book had emerged on social media. The copy mentioned Bloomsbury as the publisher of the book, after which it was alleged that Bloomsbury had released the manuscript that was available with them to harm the same of the sale of Garuda Prakashan’s book. This allegation holds weight as the manuscript is available only with the authors and the publication house before its release, and authors will not release it as it may harm the sale of the book after it is published.

Delhi Riots Case: Court rejects bail plea of Faizan Khan arrested under terror charges, is accused of providing Jamia student with fake SIM cards

The bail plea of one accused in the Delhi Riots case, Faizan Khan, has been rejected by the Additional Sessions Judge in the Karkardooma Court stating that there is prima facie evidence of guilt against the accused. The bail plea was dismissed by Additional Sessions Judge Amitabh Rawat on Friday.

The order notes that Faizan Khan was working as a promoter of Airtel at a shop in Okhla for the past one and a half years. It states, “He further disclosed [during his interrogation] that one student (name withheld), student leader of Jamia University had visited his shop and had demanded a SIM card on a fake I.D by enticing him to pay some extra money in cash.”

“In greed of the money, in December 2019, he activated a SIM Card No. [number withheld] on a fake I.D with the live photograph of [name withheld] (JIO Promoter at the shop) and I.D. (Aadhar Card) of one [name withheld]. Faizan Khan confessed that he deliberately issued the above said Airtel SIM card on a fake identity. Hence. he was arrested,” it adds.

The order further mentions that Faizan Khan “knowingly, dishonestly and deliberately activated the said SIM cards”. It stated, “The case is at the stage of investigation and from the perusal of the case diary and the statements… along with the Whatsapp chats, it can be inferred at this stage that there is a prima facie evidence against the accused and thus, the embargo under Section 43D (5) Unlawful Activities (Prevention) Act, (UAPA) 1967 is attracted in this case.”

“In view of the above discussion, at this stage, I do not find any reason to grant bail to the accused/applicant Faizan Khan. Consequently, the bail application of applicant/accused Faizan Khan stands dismissed,” the judge noted. The counsel for the accused had claimed that the accusations against Faizan Khan were false and baseless. It did not convince the Judge.

Tahir Hussain, former Councillor wit h the Aam Aadmi Party, and Khalid Saifi along with others hatched the conspiracy to unleash violence at the national capital, investigation into the Delhi Riots has revealed. DU Professor Apoorvanand was also arrested under the UAPA for allegedly masterminding the riots. Others such as Gulfisha and Umar Khalid are also believed to have been involved in the conspiracy.

A day after burning the streets of Sweden, Muslim mob clashes with anti-Islamization protestors in Norway

A day after Muslim mob unleashed violence on the streets of Swedish city of Malmo, a similar incident has occured in Norway capital city Oslo on Saturday. Clashes broke out between Muslim mobs and a group of protestors identified as Stop Islamization of Norway (SIAN) during a rally in Oslo.

Reportedly, an anti-Islamization rally was organised by the protestors in the Norwegian capital of Oslo on Saturday near the parliament building. However, these protestors were confronted by a counter-protesting Muslim mob.

The Muslim mob had assembled on the streets of Oslo, banging drums, singing and chanting “No racists in our streets” during the rally organised by the group Stop Islamization of Norway (SIAN).

Some of the members of the Muslim mob were also seen kicking a police van and climbing on the hood of the vehicle. 

Following the confrontation by a Muslim mob, tensions gripped on the streets of Oslo, which resulted in one female member of SIAN tearing pages from the Koran and spitting on them. “Look, now I will desecrate the Koran,” the woman, Fanny Braten allegedly said. Braten was soon attacked by the Muslim mob, who kicked her in the leg.

Police use tear gas, pepper spray to disperse the crowd

Sensing the situation, the police used tear gas and pepper spray to control the Muslim mob and the protestors. Fearing more violence from the Islamic groups, the police ended the SIAN rally earlier and dispersed SIAN supporters from the spot.

Nearly 29 people, including some minors, who tried to jump barricades and disrupt the SIAN protest have been arrested. Reportedly these mobs threw stones, eggs and other missiles at the police.

The protest in Norway comes on the backdrop of a similar incident in the Swedish city of Malmo on Friday, where radical Islamic mobs had targetted civilians in Sweden and had torched down properties on the streets of Malmo.

Muslim mob unleashes terror on the streets of Sweden

Amidst chants of Allahu Akbar, the Muslim mobs unleashed riots on the streets of Sweden after a member of the ‘Stram Kurs’ group had burnt a copy of the Quran.

The burning of the Quran was a part of an anti-Islam protest which took place in the city, following the arrest of one Rasmus Paludan, who is the leader of a Danish anti-immigration political party.

The incident triggered radical Islamists to take to the streets and unleash violence. While the rioters first protested against the actions of the group, they soon resorted to burning tyres and pelting rocks at the police.

Harassment by officials to ISI conspiracy: Multiple angles emerge in death of 11 Pakistani Hindu refugees in Rajasthan

On 9th August, dead bodies of 11 Pakistani Hindu refugees, all members of a family, were found in Jodhpur district in Rajasthan. More details have been revealed during the investigation that unearthed the struggle of three brave sisters. They all died after consuming poisonous liquid. The story behind Hindu refugees’ mass suicide has shocked everyone who heard what exactly forced the family to take such a drastic step.

The plight of Hindus in Pakistan is not something that is hidden from anyone. Their problems do not end after they come to India to take refuge. The same happened in the story of Lakshmi, Priya, and Suman of Sindhiani Tehreek, Sindh Freedom Movement Sangad unit. They fought and tolerated every atrocity in Pakistan. Their parents, brothers-in-law and children came to India as refugees with a hope to have a new chance to live peacefully.

The three sisters came to India after sending their family. They got permanent residency for five years and started living in Jodhpur, Rajasthan. However, the network of agents and guarantors was waiting for them as vultures to take advantage of their situation. As per the rule, an Indian can become the guarantor for someone who has come to take refuge in India. However, they all came on a visitor visa and decided to take the help of a leader of migrants who became their guarantor.

The Foreigner Registration Officer (FRO) does not allow residency without a guarantor. After getting permission to stay in India, the family moved to a colony of refugees in Anganwa. According to an exclusive report published in Dainik Bhaskar, the colony head wanted to control the three sisters just like their sisters-in-law. As the sisters-in-law were not living with their husbands, they started the exercise to bring them home.

Struggling to survive with agent-nexus controlling the area

The three sisters were forced to marry to deaf and dumb men. They settled in a field in Dechu that was illegal as their residence was in Jodhpur. By June, the visas of the three sisters and their parents got over. When they applied for extending their residency in India, the application was rejected as the guarantor showed displeasure.

In the end, after all the struggle, the three sisters who fought for the independence of Sindh decided to end their lives. They preferred to embrace death rather than going back to Pakistan. During the investigation, it was revealed that the sisters-in-law were making it difficult for them to stay in India. They filed a police case against the sisters that led to the rejection of their application of extending residency.

According to the family’s relatives, Kewalrm’s wife Dhandhidevi and Ravi’s wife Sharifa here earlier. When Kewalram and Ravi’s aged parents and children shifted to India, they refused to stay with them. The family quarrel led to the fight for child custody. The two sisters-in-law are aunt and niece by relation. Chetan Bhil, the head of the colony, came to India in 2012 with a religious group.

He was the one who gave shelter to the family. However, when the three sisters shifted to India, the dispute started. Gangaram and Bhagchand are the agents who also came from Pakistan. Bhagchand claims that he had helped 2000 migrants to date to get visas. Sunil Bhati is the local leader who agreed to become their guarantor. He was threatening the family after they had arguments with Chetan. It is alleged that the police arrested Lakshmi and abused the family on his complaint.

Police found evidence of abuse

The local DSP allegedly threatened the family that he will send them back to Pakistan. There are allegations that female constables also abused the family. Inspector-General of Police, Jodhpur Range, Navjyoti Gogoi said that the case is sensitive, and they have committed suicide. Lakshmi made a video before her death and wrote everything in her diary. The police are using them as evidence in the investigation.

Police said that they are checking the records based on Lakshmi’s video and diary. Also, they are questioning the people who were named by Lakshmi in the video and her diary. Gogoi said that several pieces of evidence prove that local leaders and police abused the family. He said whoever was involved in the case will be punished as per the law. However, the process will take time.

The ISI angle to the story

Based on the story of Dainik Bhaskar, OpIndia spoke to Omendra Ratnu from the organization Nimitekam. This organization helps the Pakistani Hindu migrants in Rajasthan. He denied the news and said that these are all lies that are being spread in the media. He said, under the CAA, the Government of India would grant citizenship to 31,000 displaced people during the Corona period. Thus this news is false.

He said that Pakistan’s ISI does not want Hindus to flee to India. They want to put fear in their minds that they are not safe in India. He said due to such news, many victims in Pakistan have converted to Islam. This is the reason such news run in media. He said the family committed suicide because of personal matters.

Omendra said that the incident neither has any connection to Congress nor any Jihadi link. He claimed that the girl named Lakshmi wanted to dominate the family. She was educated and was very persuasive. In the end, the family was forced to commit suicide. He said there is only one person from the family who is alive. Only his statement should be believed. He said there is an ISI connection to this conspiracy.
