Nigeria: Police raids gay wedding event, over 200 persons arrested, homosexuals can get 14-year jail sentence

The Nigerian Police has arrested more than 200 people at a suspected gay wedding. This comes as one of the biggest mass arrests in recent years targeting the country’s LGBTQ community, CNN reported.

A police spokesperson in the southern Delta state on Tuesday told reporters that 67 people will be prosecuted for “allegedly conducting and attending a same-sex wedding ceremony.”

Same-sex relationships are criminalized in Nigeria, and its penal code approves a punishment of up to 14 years in prison for people who are convicted of entering into a same-sex civil union.

A police official in a a live broadcast on Tuesday described the event as evil and said “we cannot copy the Western world… we are Nigeria and we must follow the culture of this country.”

Behind him were the suspects, some of whom told journalists that they were not gay and were models and fashion designers.

The incident was condemned by Amnesty International Nigeria. They called it “a witch-hunt”. The organisation called on Delta state police to release the detained people who were “arrested and paraded to the media” and to “put an immediate end to this witch-hunt,” in a statement on X, formerly known as Twitter.

The human rights group said: “In a society where corruption is rampant, the law banning same-sex relationships is increasingly being used for harassment, extortion and blackmail of people by law enforcement officers and other members of the public. This is unacceptable.”

Police said a video recording of the wedding party and alleged prohibited substances were obtained during the raid.

A police statement said: “The venue of the illicit event was searched, and the following items were recovered at the scene: one codeine bottle, three cups of refined Canadian loud, five sachets of SK, one sachet of tramadol, four tablets of molly drug, one crusher, gay marriage ceremonial dresses.”

The statement added that police got wind of the event after operatives on routine patrol stopped an attendee late Sunday. “He had claimed to be an actor,” the statement said.

“Upon interrogation, he confessed that he is a member of a certain gay club and that he was on his way to join his fellow members for a gay marriage ceremony,” the statement said, as per CNN.

This latest arrest comes five years after 57 men accused of homosexuality were arrested during a police raid on a hotel in Lagos in 2018.

During the celebrations of Chinese Valentine’s Day on 22nd August 2023, a couple was busy kissing by the picturesque West Lake in China‘s Zhejiang province. As their non-stop 10-minute-long passionate kiss unfolded, the man experienced a peculiar sensation.

His left ear started to ache, accompanied by a bubbling sound. This unsettling experience resulted in his hearing impairment. Swiftly seeking medical attention, the couple visited a hospital where doctors diagnosed a perforated eardrum. The medical prognosis indicated that a two-month recovery period was required.

Medical experts assert that enthusiastic kissing can induce a swift alteration in air pressure within the ear. When coupled with the heightened breathing of a partner, this dynamic triggers an imbalance, resulting in the possibility of an eardrum perforation.

In addition to such passionate kissing, activities like physical assaults and fights, road accidents, diving, and air travel can also lead to a perforated eardrum. Tympanitis typically serves as the primary cause behind these ruptures for most individuals. Tympanitis refers to the inflammation of the tympanic membrane, commonly known as the eardrum. It can result from various factors such as infections, trauma, or sudden changes in pressure. This condition can cause discomfort, hearing impairment, and in severe cases, lead to a perforated eardrum.

Notably, this isn’t the first case of sudden hearing loss due to intense kissing. A similar incident was reported in 2008, in which a Chinese woman lost her hearing while kissing her boyfriend. Last month, a couple in southern China lost their hearing while watching TV at home.

The Qixi festival in China is celebrated on the seventh day of the seventh lunar month. This year, it was observed on August 22. It is the Chinese equivalent of the Valentine’s Day.

Chandrayaan-3 update: Pragyan Rover conducts experiments on lunar soil, confirms Sulphur, Titanium, Chromium and much more, ISRO says search for Hydrogen underway

In another first, the Indian Space Research Organisation (ISRO) has confirmed the presence of Sulphur (S) on the lunar surface near the south pole, through first-ever in-situ measurements. As part of its ongoing in-situ (on-site) experimentation, ISRO has also found traces of various elements that were anticipated to be present on the lunar surface. 

The various metals/non-metals found by ISRO include Aluminum (Al), Calcium (Ca), Iron (Fe), Chromium (Cr), Titanium (Ti), Manganese (Mn), Silicon (Si), and Oxygen (O). The space agency added that the process to find traces of Hydrogen (H) is still underway. 

Taking to X, ISRO shared this elating news. In the post, it also included a graph that shows the emission spectrum of the lunar surface.

ISRO said, “Laser-Induced Breakdown Spectroscope (LIBS) instrument onboard the Rover unambiguously confirms the presence of Sulphur (S) in the lunar surface near the south pole, through first-ever in-situ measurements. Al, Ca, Fe, Cr, Ti, Mn, Si, and O are also detected, as expected. Search for Hydrogen (H) is underway.”

In simple terms, various elements react differently when they are subjected to various wavelengths. Afterward, they could be identified on the basis of certain characteristics (emission spectrum) they exhibit. 

This scientifically important data has been gathered with the help of a Laser-Induced Breakdown Spectroscope (LIBS) instrument which is onboard the Pragyan rover.

Notably, the LIBS instrument is developed at the Laboratory for Electro-Optics Systems (LEOS)/ISRO, Bengaluru.

Earlier, the ISRO shared some high-quality images of the lunar surface from the navigational camera. The space agency revealed that it successfully navigated a massive 4-metre diameter crater which was located on the earlier path of Pragyan rover. However, it relayed a message and asked the rover to retract its path and find an alternate route for conducting experimentation. 

During the ongoing experimentation, ISRO added another historic feat when it shared the first-ever temperature profile of the lunar south pole. Back then, the Space Agency shared that temperature sharply changes at various depths highlighting that the temperature difference could be as high as 10°C in a meager depth of 2 cm.

CBI registers case for minority scholarship scam: 830 fake institutions across 18 states found to have claimed over 144.33 crores between 2017-22

The Central Bureau of Investigation (CBI) has registered a case against unnamed officials, nodal officers, and PSU bank staffers for a scam in minority scholarships worth Rs 144 crores. The complaint has been registered by the Ministry of Minority Affairs.

As per the FIR filed by CBI, the Ministry of Minority Affairs has highlighted a case of alleged scam worth Rs 144.33 crores against unnamed officials with regards to the distribution of minority scholarships. The FIR has been filed under sections 120B, rw 420, 468, and 461 of the IPC and 13 (2), 13 (1)(c), and (d) of the PC Act 1988. The charges include criminal conspiracy, cheating, forgery, using forged documents as genuine, and criminal misconduct.

The suspected accused include unnamed officials of the government, officials of several PSU banks, and nodal officers of 830 different institutions located across 18 states.

The complaint states that for the last 5 years, between the years 2017-22, approximately 65 lakh students received minority scholarships every year from the central government under 3 different schemes namely: Pre-Matric Scholarships, Post Matric Scholarships, and Merit- cum-Means for the students of Six Minority Communities i.e. Muslims, Christian, Sikhs, Jains, Buddhists and Parasis.

These scholarships are all DBT schemes where students receive funds directly in their bank accounts. After reviving reports of fund embezzlement, the Ministry has engaged the National Council of Applied Economic Research (NCAER) to carry out Third Party Evaluation of the Scholarship Scheme. An evaluation was also carried out through the national scholarship portal to flag suspicious institutions and applications. Based on the evaluation a total of 830 institutions were found to be fake, partially fake, or non-operational.

The total loss to the exchequer has been estimated at Rs 144.33 crores. The ministry has stated in the FIR that there is a possibility that the forgery and thus, fake embezzlement of scholarships have been going on since before 2017. However, digitally verified data could be collected for scholarships distributed between 2017 and 2022.

Pakistan: Imran Khan arrested in Cipher case hours after getting bail in Toshakhana Case

Former Pakistan Prime Minister Imran Khan, who was granted bail by the Islamabad High Court on Tuesday (29 August), will have to remain behind bars in the Attock Jail in connection with the Cipher case

Hours after getting bail in the Toshakhana case, a special court recently established to hear cases under the Official Sec­rets Act directed the Attock Jail authorities, the place where Former Pakistan PM is incarcerated, to keep Imran Khan in “judicial lockup”. It also directed the jail authorities to produce him before the court on the 30th of August in connection with the Cipher case.

The Dawn report stated that it had accessed the letter that Special Court Judge Abul Hasnat Muhammad Zulqarnain sent to the Attock jail superintendent. 

In the letter, Judge Zulqarnain said, “That accused Imran Khan Niazi s/o Ikramullah Khan Niazi r/o Zaman Park, Lahore is hereby ordered for judicial remand in case FIR mentioned above, who is already detained in district jail, Attock.”

OpIndia had earlier reported that the Federal Investigation Agency (FIA) is grilling Khan in connection with a diplomatic cable (Cipher) that reportedly went missing from his possession. Apparently, it was the same cable that he presented for a long time as evidence of a “foreign conspiracy” against him. On the basis of this purported cable, Khan had claimed that the US wanted to oust him from the Prime Minister’s office and install a puppet regime.

Earlier, on 19 August, Former Foreign Minister Shah Mahmood Qureshi was arrested and was reportedly being taken to the FIA’s headquarters. 

Confirming this development, the Dawn report added that proceedings against PTI Vice Chairman and Foreign Minister Qureshi in the same case are also underway.

Earlier in the day, Imran Khan got some respite when the Islamabad High Court (IHC) suspended the Pakistan Tehreek-e-Insaf Chairman Khan’s conviction and three-year jail sentence in the Toshakhana case. 

‘Mumbai mein Narendra Modi ke nareti (throat) pe chadhne jaa rahe hain hum log’: Out on bail RJD Chief Lalu Prasad Yadav

On Tuesday (29th August), out on bail RJD Chief and Former Bihar CM Lalu Prasad Yadav landed himself in another controversy after he made a disparaging remark against Prime Minister Narendra Modi. While speaking about the upcoming opposition meeting, the RJD supremo claimed that they have caught hold of Prime Minister Modi by his throat and would soon remove him. 

The fodder scam convict said, “Mumbai mein Narendra Modi ke nareti (throat) pe chadhne jaa rahe hain hum log. Narendra Modi ka nareti pakde huye hain hum, hatana hai.(We are going to climb on the throat of Narendra Modi. We have caught hold of his throat and we have to remove him)” 

Lalu Yadav made the controversial remark at Patna airport when he was leaving for the upcoming I.N.D.I.A. alliance meeting in Mumbai. When the incident unfolded, he was accompanied by the Bihar Deputy CM and his younger son Tejashwi Yadav.

Meanwhile, the Central Bureau of Investigation (CBI) recently moved to the Supreme Court urging the court to cancel the bail of the RJD chief in the fodder scam case. Significantly, it was accepted by the Supreme Court for hearing. 

Lalu Yadav was granted bail by the Jharkhand High Court on 22 April 2022 in the Doranda Treasury case related to four cases of fodder scams amounting to crores. He was granted bail on medical grounds, however, when he was seen actively taking part in political activities, despite a ban on it, and playing badminton, it prompted the central agency to challenge his medical bail.

Mumbai meeting of I.N.D.I.A. alliance

Later in the day, Lalu-Tejashwi father-son duo reached Mumbai for the I.N.D.I.A. bloc meeting which will begin in Mumbai on the 31st of August. During the two-day meeting, around 26-27 opposition parties will try to chalk out further nitty gritty of the ideologically amorphous I.N.D.I.A. bloc. 

Speaking to ANI, senior Congress leader Ashok Chavan shared what would be the agenda of the third opposition meeting. According to him, the opposition bloc may come up with a common logo for the alliance and this could potentially be unveiled on the 31st of August. 

Chavan said, “An informal gathering will be held on the evening of August 31 in Mumbai and a formal meeting on September 1. So far, two meetings have been organised. So in this third meeting, the next agenda will be discussed. We are deciding to make a common logo and it may get unveiled on August 31.”

“We reject these claims as they have no basis”: MEA registers strong protest against China’s distorted map laying claim to Indian territories

On Tuesday evening (29 August), India’s Ministry of External Affairs (MEA) hit back at China hours after it had released the 2023 edition of its territorial map as per its imagination. In regard to media queries regarding China’s bizarre claims, the MEA issued an official statement rejecting the so-called 2023 “standard map” of China. 

MEA’s official spokesperson Arindam Bagchi told the media that the Ministry has lodged a strong protest against the Chinese map which has laid claims on Indian territories.

He said, “We have today lodged a strong protest through diplomatic channels with the Chinese side on the so-called 2023 “standard map” of China that lays claim to India’s territory.” 

Diplomatically blaming China for hindering in resolving border dispute, Bagchi further highlighted that with all these baseless claims, China is only complicating the boundary dispute.  

He added, “We reject these claims as they have no basis. Such steps by the Chinese side only complicate the resolution of the boundary question.” 

Earlier in the day, China released the ‘latest imaginary’ version of its territorial map in which it claimed the Indian territories such as Arunachal Pradesh and parts of Ladakh (Aksai Chin region) as its own.

Apart from Indian territories, China also included Taiwan and the contentious 9-dash line in the South China Sea. 

It is pertinent to note that with this imaginative map fiasco, China has manufactured another controversy right at the wee hours of the G-20 summit. Notably, India is all set to host the G20 Summit on 9th September and 10th September. Despite being a global nuisance, China is one of the G20 countries and Chinese President Xi Jinping is set to visit Delhi for the G20 Summit.

The controversy came to light when the mouthpiece of the Chinese government, The Global Times carried a post. In the post, it stated that the Ministry of Natural Resources launched China’s latest ‘standard map’ on its website on 28th August. This is marked as the latest edition of the ‘standard map’ of the country.

However, China has been a habitual offender and has repeatedly claimed parts of India, including Arunachal Pradesh and Aksai Chin. In December 2021, the Ministry of External Affairs strongly objected to China assigning its own name to 15 places in Arunachal Pradesh.

In April 2021, OpIndia reported about a Chinese citizen who made pro-China edits to open-source maps of the Line of Actual Control. In March 2019, it was reported that China destroyed over 30,000 world maps that showed Arunachal Pradesh as part of India.

In an act of duplicity, Chinese President Xi Jinping recently met PM Modi during the BRICS Summit in Johannesburg. He asserted that the two nations should hold comprehensive talks to ease border tensions. However, even in the backdrop of that discussion, and just days before the G20 Summit, China’s belligerent behavior in claiming Indian territories as its own displays a lack of sincerity on its part to resolve tensions at the LAC.

Surat police arrest fake ISRO scientist Mitul Trivedi who claimed to design Chandrayaan-3, says did so to attract students to tuition classes

On August 29, Tuesday Surat Police Crime Branch arrested Mitul Trivedi, the bogus scientist who claimed to play a vital role in the development of the Chandrayaan-3 design. The Surat Police Crime Branch registered a case against Mitul Trivedi under sections 478, 471, 419 and 420 of the IPC. Later in the evening, he was taken into custody.

The police will now take further action after conducting a detailed probe into the case.

According to reports, the Surat police had summoned Mitul Trivedi to question him regarding the claims he made about playing a crucial role in designing the Chandrayaan-3 but he failed to submit any evidence to substantiate his claim. Later the case was handed over to the Crime Branch. Trivedi was finally detained by police after ISRO headquarters in Bengaluru confirmed that he was associated with ISRO in any manner.

The Surat police are now going to probe Mitul’s education qualifications.

Sharad Singhal, the City Additional Police Commissioner, claimed in a press conference that Mitul Trivedi had claimed to be an ISRO scientist, but the police had contacted ISRO and learned that there was no such person associated with the organisation.

Singhal further said that when Mitul was interrogated it emerged that he ran tuition classes and had purposefully disseminated these stories in the hopes of attracting more pupils. The police stated that an additional inquiry is ongoing and the police will soon be presenting him in court and requesting his remand.

Notably, on August 25, following the successful soft landing of Chandrayaan-3’s lander on the lunar surface, Mitul Trivedi hogged the limelight, particularly on social media in Gujarat, after he claimed he played a significant role in the development of Chandrayaan-3 design.

An audio recording of a discussion between Mitul Trivedi and his teacher surfaced the day after the soft landing of Chandrayaan. In this conversation, both were heard conversing about the mission and its triumphant outcome. Mitul informed his teacher that he is situated at the ISRO centre. During the dialogue, he also asserted that he was the one who formulated the design for Chandrayaan. 

Mitul Trivedi also participated in interviews with multiple news channels and made similar claims.

After Mitul Trivedi’s claims were reported by local media and gained traction, a report by Sandesh quoted his neighbours calling out his lies. They claimed that Mitul Trivedi was in his house when the Chandrayaan-3 soft-landed on the moon. The report also claimed that Trivedi had no evidence or information to join ISRO. According to the report, when asked for proof, he said he could not disclose it saying he was on contract.

Kerala Assembly speaker AN Shamseer, his diatribe against Hinduism and how it was not a product of a ‘scientific mind’ but plain bigotry

Kerala Assembly Speaker A N Shamseer’s uncalled-for and ridiculing comments about Hindu God Ganesh, have stirred a Hornet’s nest. During a programme at a school in Ernakulam on July 21, Shamseer told the students in his speech that science should be promoted in the education sector instead of myth. He singled out Lord Ganesh as a ‘Myth’. This led to an uproar among all Keralites against this veiled attack on Hinduism and Hindu beliefs. 

Sensing that his diatribe had not gone down well among the Hindu community, and had invited adverse comments in the media, in political circles and among the devout, he attempted to backtrack by stating later to reporters at the Legislative Assembly complex Shamsheer said, “Article 51 of the Constitution says that we have to promote scientific temper. Unfortunately, someone is saying that the aeroplane was invented by the ancient Hindu community and plastic surgery was done during the Hindu period. These are all baseless. I told the students that we have to promote science. That is the only statement I made. But unfortunately, some people want to disturb the communal harmony in Kerala.”

Public servants in important positions of political authority, drawing salary and perks from the taxpayers’ money, need to be circumspect about their language, subject and audience. Verbal aggression in a country having a diverse religious landscape can be hurtful to lakhs of faithful, as it was aimed at creating a hostile environment and promoting ill-will between communities. His diatribe against Hindu Gods and sciences was certainly denigrating, invalidating, and prejudicial. What he conveniently forgot was that myths abound not only in his religion but also in every religion on this planet. Mankind has been on this planet for millions of years, yet nobody including those who claim an exclusive filial relationship with One True God, or those who claim sole religious plenipotentiary status has ever seen God nor even been able to describe him. This world has seen the rise and fall of innumerable religions, yet, none could describe God or where he resides in this universe. “Each mind conceives god in its own way. There may be as many variations of the god figure as there are people in the world”, it is said. (Bangambiki Habyarimana, Pearls Of Eternity).

All religions are obsessively engrossed about the phenomenon of ‘death’. Death means a permanent cessation of life, which was very heart-wrenching for the devout. To assuage the feelings of followers, religions across the world came up with fancy ideas of heaven and hell. Certain religions invented the idea of heaven akin to a seven-star brothel, and for others a realm of luxurious living. In contrast, hell which was a diametrically opposite destination, was conceived as a place of great physical torment and torture. How much of these are scientific truths, validated by research and experimentation? But, does anybody call them myths? Everybody respects the feelings of those who believe in such ideas. 

Before the advent of modern science, practically every religion had its own version of cosmogenesis, a notion of the origin of the universe in some distant past. Most are based on the idea that an all-powerful god created a world of matter and man. These doctrines cohered with the view of a single god or many gods who created the universe and all life, hence, should be invoked and thanked. These religious interpretations were widely accepted because there was no better hypothesis to explain the existence of the universe. However, modern science has come up with different explanations about how the universe came into being which are entirely different from what the Abrahamic religions claim. Will Shamseer call the explanations of science mere myths?

People like Shamseer and many others, pretending to possess a scientific mind, should know what world-renowned theoretical physicist and cosmologist, Stephen Hawking says in the Final Book that there’s ‘No Possibility’ of God in Our Universe’! Will Shamseer say that Stephen Hawking does not have a scientific mind? The scientific mind refuses to accept that there is a creator! What is meant by a scientific mind? The scientific habits of mind taught in FroSci of Colombia University’s  Colombia College include a range of quantitative reasoning skills and an understanding of the scientific process: basic statistics and probability, experimental design, sense of scale, calculating with units, back of the envelope calculations, feedback loops, and graph reading. Can any religion practised today across the world, match these requirements? Shamseer should also disclose to the public, what he has done to promote the scientific mind among his brethren. 

There is a growing consensus in the scientific community that the Hindu interpretation of the Cosmos closely aligns with the scientific view. Carl Edward Sagan  American astronomer, planetary scientist, cosmologist, astrophysicist, astrobiologist, science communicator, author, and professor opines “The Hindu religion is the only one of the world’s great faiths dedicated to the idea that the Cosmos itself undergoes an immense, indeed an innate, number of deaths and rebirths. It is the only religion in which the time scales correspond, to those of modern scientific cosmology”. Will Shamseer say that this scientific opinion is a myth?

Muhammad Darah Shikoh, son of Mughal Emperor Shah Jahan, disclosed “After gradual research; I have come to the conclusion that long before all heavenly books, God had revealed to the Hindus, through the Rishis of yore, of whom Brahma was the Chief, His four books of knowledge, the Rig Veda, the Yajur Veda, the Sama Veda, and the Atharva Veda. The Quran itself made veiled references to the Upanishads as the first heavenly book and the fountainhead of the ocean of monotheism.” Will Shamseer say it is a myth?

Niels Bohr, Heisenberg and Schrödinger regularly read Vedic texts. Heisenberg stated: “Quantum theory will not look ridiculous to people who have read Vedanta.” Vedanta is the conclusion of a Vedic thought. Schrödinger, in speaking of a universe in which particles are represented by wave functions, said: “The unity and continuity of Vedanta are reflected in the unity and continuity of wave mechanics. This is entirely consistent with the Vedanta concept of All in One.”

A similar view is expressed by Hans-Peter a German physicist who made his contribution to the field of nuclear and quantum physics. He was so influenced by Hinduism that he dedicated 33 years of his life to studying and mastering the Vedas and Upanishads. He once said that when he teaches Quantum Physics, he feels like he’s giving a lecture on  Vedanta philosophy.

The famous Danish physicist and Nobel Prize Laureate Niels Bohr was a follower of the Vedas. He said, “I go into the Upanishads to ask questions.” 

The Father of the atomic bomb, Julius Robert Oppenheimer,  also a Sanskrit scholar opined that  “Access to the Vedas is the greatest privilege this century may claim over all previous centuries.”

Will Shamseer and his ilk call the above Nobel Laureates and eminent scientists, as believers in myths?

The Drake Equation first proposed by radio astronomer Frank Drake in 1961 is used to estimate the number of communicating civilizations in our galaxy, or more simply put, the odds of finding intelligent life in the Milky Way, The equation calculates the number of communicating civilizations by multiplying several variables. Scientists in different countries are probing the universe to detect intelligent life forms. NASA’s Perseverance Rover is currently looking for signs of life on Mars or for life,  that may have once existed on Mars. This is at complete variance with Shamseer’s belief. Will he condemn this scientific expedition as a pursuit of myth?

Before politicians utter gibberish they should heed the advice of Ayn Rand “Check your premises, choose your issues”.

‘J&K’s statehood will be restored, Ladakh will remain a Union Territory’: SG Tushar Mehta during Article 370 hearing

On Tuesday (29 August), during the 12th day of hearing on a batch of pleas related to the dilution of Article 370, the Supreme Court asked the Union Government to provide a time frame or roadmap for the restoration of the statehood of Jammu and Kashmir. 

The 5-judge constitutional bench headed by CJI DY Chandrachud asked this specific query while deliberating the issue of the conversion of J&K from a state to a Union Territory (UT) as per the J&K Re-organisation Bill in 2019. 

Representing the Union Government, Solicitor General (SG) Tushar Mehta cited Union Home Minister Amit Shah’s Parliamentary remarks when he tabled the J&K Re-organisation Bill in 2019. The Solicitor General reiterated the government’s stated stance that the statehood of J&K would be reinstated in due course of time. However, he added that Ladakh will remain a UT. 

When he asserted that the UT status of J&K is not permanent, CJI asked, “How impermanent is this? When are you going to have elections?”

Later during the proceedings, CJI said, “We understand that these are matters of national security. The preservation of the nation itself is the overriding concern. But without putting you in a bind, you (SG) and AG may seek instructions on the highest level – is there a time frame in view?”

CJI added, “Equally, restoration of democracy is important.”

During his submissions, the Solicitor General reiterated that the process of restoring statehood was already in progress. He also shared steps taken to bring normalcy and stability to the region that are the precursor for restoring the statehood of J&K. 

When the hearing resumed at 2 PM, the Solicitor General, after taking instructions from the Central government, informed the bench that the statehood of J&K would be restored, while Ladakh would be retained as a UT. 

He said, “The instructions are that UT is not a permanent feature. But I will make a positive statement day after tomorrow. Ladakh will remain UT.”

He also submitted that except for police and public order, all other powers are there with J&K.

Larger Debate: Should the Parliament be not empowered to convert a state into UT for a specific time in lieu of National Security?

Meanwhile, during the course of the argument, the bench deliberated upon certain powers of the Union government. The bench pondered whether it was possible for the Union government to convert a state into a UT for a temporary period in lieu of national security. 

Nonetheless, CJI clearly stated that when faced with such a situation, the Government had to make a statement before the Supreme Court outlining that the transition of a Union Territory (UT) back to a state had to take place. 

Emphasising the need to prioritise national security above other issues, CJI said, “Can a union not do that (convert a state to UT) for a certain period, to bring stability? Because let’s face it, whether it’s a state or UT, all of us survive if a nation survives.”

The bench further contemplated should the court not permit Parliament to change the status of a state to a UT in the interest of the preservation of the nation itself, however, this has to be done by clearly stating that the statehood will be restored. 

Regarding this, CJI said, “Should we not permit parliament to postulate that for a certain period, in the interest of the preservation of the nation itself, we want for a certain period that this particular state shall go in the fold of UT- on the clear understanding that this shall revert back to a state.”

However, CJI clearly maintained that it can’t be a UT permanently. 

The constitutional bench further deliberated on the possible misuse of this power, if available or granted. 

CJI asked, “Once you concede that power to the union in relation to every Indian state, how do you ensure that the kind of abuse they apprehended- this power will not be misused.”

In response, SG Mehta claimed that J&K was “one of a kind situation” and it will not arise with respect to other states. 

However, Justice Kaul retorted and highlighted that there are other border states too that have problems. 

He said, “It’s not one of its kind situations. We have seen the northern border of Punjab- very difficult times. Similarly, some states in North East. Tomorrow if there is a scenario that each of these states faces this problem. I understood your argument that these border states are their own category. How do you distinguish between J&K with any other border states?” 

In reply, SG cited the historical background of J&K and its proximity to Pakistan-occupied Kashmir. He also highlighted the positive development post the repeal of J&K’s special status by giving the example of local body elections. 

The bench then deliberated whether the parliament has the power to convert an existing Indian state into a UT. If it does have that power, how does the court read Article 3?

The bench also asked what will be the nature of the exercise of that power, will it be permanent, or temporary?
