Congress under lens for receiving unaccounted Rs. 106 crore cash at party headquarters, much of it before 2019 general elections: Details

The Congress party, which has been under the watch of central investigative agencies over charges of receiving kickbacks in the Agusta Westland case, is now shrouded in yet another controversy. The Income Tax Department has revealed that the cashier at the old Congress headquarters on Akbar Road in New Delhi had received tranches of unaccounted cash between 2016 and 2019, reported Times Now.

As per reports, the IT Department has now launched an investigation to ascertain the source of the cash. Times Now has accessed the 408-page dossier of the IT Department that revealed that the cash payment was made in instalments. Between February 13 and October 4 last year, the Congress Headquarters had received a whopping ₹74.62 crores. Moreover, another payment of ₹26.50 crores was made between August 2016 and September 2016. The third tranche was a payment of ₹5.22 crores that was made between April 2017 and September 2019.

Times Now reported that several payments of unaccounted cash were made to the erstwhile Congress Headquarters, prior to the 2019 General Elections. It was revealed that an amount of ₹5.4 crores was received on February 27 last year while ₹3.75 crores were received on the next day. On April 20 2019, the Congress party had received ₹6.40 crore while another tranche of ₹ 5.45 crore was received on April 24, 2019.

Political war of words breaks out between the BJP and Congress

The massive development has put the Congress party on the backfoot with the BJP demanding accountability of party leadership. BJP IT Cell Head, Amit Malviya stated that Sonia Gandhi must explain the documents and the IT trail. “In 2016, demonetisation was undertaken and the Congress party has been constantly criticising it. Congress has to answer for this money that has been traced back to their HQ. This points to the greed and hunger that Gandhis have for money. The documents and the IT trail needs explaining and none other than Sonia Gandhi should explain this as she is the party head right now,” Amit Malviya emphasised.

Dismissing the charges against the grand old party, Congress leader Rashid Alvi has claimed that the IT Department probe is being facilitated by the Prime Minister. While counter-questioning the BJP, he inquired, “The BJP has built a seven-star office in Delhi, may I ask him to tell the IT to investigate that as well.”

The AgustaWestland Scam

India had signed a deal in 2010 under the UPA regime to buy 12 AgustaWestland AW101 helicopters for the service of the Prime Minister, the President and other VVIPs. It is alleged that some politicians and public servants had abused their official positions to reduce the service ceiling of the VVIPs helicopter from 6000 metres to 4500 metres to make AgustaWestland eligible for the contract and had awarded the contract for an amount of Euro 556.262 million in 2010. The deal was cancelled in 2013 after the scam was revealed.

One of the prime accused turned approver in the AgustaWestland scam, Rajiv Saxena, has named key Congress leaders and their relatives over alleged involvement in the Rs 3,600-crore VVIP chopper scam. In his interrogation in connection with the scam, Saxena named senior Congress leader Salman Khurshid, Kamal Nath’s son Bakul Nath and Sonia Gandhi’s close aide Ahmed Patel. Saxena, who was picked up by UAE government security agencies in Dubai and later extradited to India on January 30, 2019, and who later turned approver, was interrogated by the Enforcement Directorate, which attached his assets worth Rs 385 crore.

Delhi: Burkha-clad woman Nusrat fires gunshots to threaten a shop owner, arrested later

The Delhi police have arrested a woman named Nusrat for firing multiple shots at a shop after a quarrel with its owner, reported Times of India. The incident took place on November 18 at Chauhan Bangar area in North-East Delhi.

As per reports, the Jaffrabad police was alerted about the woman last week after she had fired shots at a closed grocery store in Lane No.4. The police officials had informed that the shop belonged to a man named Fahim and that the accused had fired four shots at it. In a video shared by Times of India journalist Raj Shekhar Jha, the woman could be heard shouting the choicest of expletives, before firing the shots. While hurling abuses, she claimed to be the sister of gangster Nasir. The woman was then taken away by her accomplice on a bike. The video has since then gone viral on social media.

The quarrel was over a mortgaged mobile phone

The accused has been identified as one Nusrat. After her arrest, she conceded that the gun was bought from a man named Maksood. The police informed that she had a quarrel ensued between with Fahim and Nusrat for not returning the mortgaged cell phone of another man named Shahrukh. Deputy Commissioner of Police, Ved Prakash Surya, said, “She said they had an altercation as Fahim was not returning the mortgaged mobile phone of Shahrukh, a man known to her.”

‘Mamata Banerjee most secular leader in India, has championed Muslim cause’: Former AIMIM leader as he joins TMC with several others

The West Bengal elections that are all set to be held in 2021 is likely to see a bitter battle between TMC and BJP as the latter emerges as a strong contestant in the state, for the very first time. However, one party that is fighting with TMC to bag a chunk of the Muslim vote, is AIMIM led by Asaduddin Owaisi. In a jolt to AIMIM on Monday, 20 of its leaders joined Mamata Banerjee led TMC ahead of the polls and hailed her as the most secular leader in the country.

Speaking to the media, former AIMIM leader Anwar Hasan Pasha, who led the 20 leaders joining TMC said, “Mamata Banerjee is the most secular leader in India. She has championed the Muslim cause (and) has been criticised for it. She is the only leader in the country who was on the road to opposed NRC (national register of citizens)”.

The leader said that Owaisi ended up polarising the votes in Bihar, and that he should not attempt to do the same in West Bengal. “If Mr Owaisi comes to Bengal, we will stand up against him. What we saw in Bihar will not be allowed in Bengal. The politics of divide and rule, and polarisation. Mr Asaduddin Owaisi polarised the voters in Bihar. My advice to Mr Owaisi is… don’t come to Bengal”, said Anwar Hasan Pasha while hailing Mamata Banerjee for championing Muslim cause.

TMC leader Bratya Bose claimed that the former AIMIM leaders led by Pasha (who had hailed Mamata Banerjee for championing the Muslim cause) were tired of the “communal politics” played by AIMIM and had been inspired by Mamata Banerjee to join TMC. He also claimed that Pasha was AIMIM’s key leader in Bengal, thereby predicting doom for the party.

AIMIM, however, did not see this as a massive loss for their party ahead of the West Bengal elections. Reacting to what Bose said, AIMIM’s Bengal observer Syed Asim Waqar said that Pasha was ‘just another leader’ of the party and had, in fact, been inactive for the past 1 year. Further, he alleged that Mamata Banerjee had been “planting moles” in AIMIM for a long time and now, the “moles” had been exposed.

Congress, which often sings a completely odd and different tune has alleged that TMC is trying to weaken opposition parties, hinting that she might be trying to help the BJP.

The Owaisi conundrum for Mamata Banerjee in West Bengal

In July 2019, it was reported that the AIMIM had announced their decision to contest the Assembly Elections in the state scheduled to be held in 2021. “It is true that we are fewer in number, but do not dare touch us. We are atom bombs. Didi, we welcome your friendship and enmity as well. You have to decide whether you consider us friends or foes,” AIMIM national spokesperson and Bengal observer, Asim Waqar, had stated sometime back.

The AIMIM had also organized a meeting at Dharmatala in Kolkata where the former MLA from Maharashtra Waris Pathan was also present. Consequently, in November, the Chief Minister of Bengal had warned the citizenry about the radicalism of the Owaisis. She did not name them but it was quite obvious who her comments were directed at. “I am watching that there are some extremists among minorities,” she told her party workers in Coochbehar, “They have their base in Hyderabad. Don’t listen to them.”

On the 8th of December, AIMIM leader Zameerul Hasan accused the Mamata Government of targeting his party. “Across the state, police officers are abusing our leaders, threatening them not to take up political programmes. This has happened after the Chief Minister indicated to the police to ensure that we don’t hold meetings and processions,” he told IANS. Hasan also announced that the party will organize a mega rally in Kolkata where Asaduddin Owaisi will be the main speaker.

Thus, things are not looking very good for Mamata Banerjee. She has spent too much of her political capital on her Muslim vote bank to be able to win without complete Muslim consolidation in her favour. In the course of the said appeasement, she has alienated significant sections of the Hindu community which have then consolidated in favour of the BJP. This is what we saw happen in the 2019 Lok Sabha Elections where the saffron party massively increased its seat tally.

Mamata Banerjee faces a situation where Asaduddin Owaisi is threatening to capture her Muslim vote bank while the Hindus have consolidated behind the BJP due to her continuous Muslim appeasement.

How this switch by AIMIM leaders to TMC might work out for Mamata Banerjee

Interestingly, the strategy to accept AIMIM leaders into TMC at this point with them calling Mamata Banerjee a ‘champion of the Muslim cause’ might not work out very well for Banerjee in West Bengal.

Hindus have already, large consolidated behind the BJP, especially the faction that sees Mamata Banerjee as a leader who is beholden to her Muslim vote bank. The consolidation of Hindus was evident during the Lok Sabha election where defying pundits, BJP managed to bag a massive 18 seats in West Bengal.

With former AIMIM leaders now joining TMC, the people of the state could see this as a signal of their already set perception of Mamata Banerjee, hinting that TMC is focussed on its Muslim vote bank.

Therefore, while TMC might hail this move as one that might benefit the party, in the long run up to the elections, this may as well prove to be a handicap.

Uttar Pradesh: Golu and Guddu kill driver Mushtaq with an axe for harassing their sister, surrender to police

Two brothers of a young woman killed a 32-year-old driver Mohammed Mushtaq with an axe in Lucknow. As per reports, Mushtaq has been harassing the woman for some days. After the incident, both brothers reached the police station and surrendered. They told the police officers that Mushtaq Ali had been harassing their sister for several days, so they killed him. Both of them have been arrested by the police. The police also booked the woman’s mother and sister.

Mushtaq harassed Golu’s sister on several occasions

Golu lives with his family near Durga Mata temple in Mohanlalganj, Lucknow. Mushtaq, who lived in the neighbourhood, allegedly used to harass his sister. On 22 November, Mushtaq was driving his container to Kolkata. Upon reaching Bhawani Kheda, Mushtaq and Golu’s sister got into a dispute. There was a lot of argument between the two, and the people present at the spot intervened to pacify the matter. The woman informed about the whole incident to her family after reaching home.

After learning about the incident, her brothers Golu and Guddu we to Mushtaq’s house in the evening. They dragged Mushtaq out of his house and beat him fiercely. Then they inflicted several blows on Mushtaq with an axe. Seeing his condition deteriorating, they thought he was dead and left him.

Golu and Guddu surrendered to police

Mushtaq’s family learned about the incident and rushed him to the local hospital. The doctors at the local hospital referred him to the trauma centre as he was in critical condition. Mushtaq was declared dead at the trauma centre.

Inspector GD Shukla provided detailed information about the incident. He said that Golu and Guddu came to the police station with an axe stained with the blood. They surrendered after informing the officers present at the police station that they have killed Mushtaq.

Mushtaq’s brother filed FIR against four members of the family

The police reached the hospital and gathered information related to the case. Imtiaz, Mushtaq’s brother, has lodged FIR against Golu, Guddu, Renu (sister), father (Bhailal) and Vimala (mother). The police have booked them and questioned the mother. The sister was not present at home, and the police are looking for her whereabouts.

Israeli PM Netanyahu flies to Saudi Arabia to meet crown prince MBS and US Secretary of State Pompeo, Israeli sources claim

Prime Minister Benjamin Netanyahu and Mossad chief Yossi Cohen reportedly flew to Saudi Arabia to meet with Crown Prince Mohammed bin Salman, known as MBS, and the US Secretary of State Mike Pompeo. 

According to the Israeli sources privy to the developments, Netanyahu used a private jet belonging to businessman Udi Angel, to fly to Neom, Saudi Arabia, on Sunday. Netanyahu has used Angel’s private plane for making past diplomatic trips as well. The plane left Israel after 5 PM on Sunday evening and returned some time after midnight. 

A report published in the Wall Street Journal cited a Saudi source to claim Israeli and Saudi sides discussed the normalisation of ties between the two countries and the threat they face from Iran. One of the sources quoted by the WSJ said that the meeting between the leaders of the two countries lasted for several ties during which the establishment of diplomatic ties between Riyadh and Jerusalem was discussed. However, the meeting did not yield any concrete agreements.

However, Saudi Foreign Minister Faisal bin Farhan rubbished the reports of a meeting between Israeli Prime Minister and Saudi crown Prince. He posted on Twitter that only Saudi and American officials were present.

But the Education Minister of Israel, Yoav Gallant, appeared to confirm the meeting and hailed it as an “amazing achievement” and “a matter of great importance” in an interview with Army Radio. 

The trip was kept under tight wraps and even key Israeli leaders such as Defense Minister Benny Gantz and Foreign Minister Gabi Ashkenazi were not informed about the meeting before it took place. 

The US Secretary of the State Mike Pompeo also met Benjamin Netanyahu and Saudi crown prince MBS, in Neom, a city in northern Saudi Arabia on the Red Sea. Earlier on Monday, Pompeo said that he held a constructive meeting with Saudi Arabia’s crown prince the night before. However, he made no reference to the presence of the Israeli leader. Even Netanyahu’s office did not confirm the meeting and neither did the Saudi press made any mention of the talks.

Meeting between Saudi and Israeli leader an attempt to normalise ties between the erstwhile foes

Traditionally, Saudi Arabi and Israel have been foes. However, the recent meeting between the leaders of the two countries should be viewed in the context of the United States’ attempts to normalise ties between Israel and the Arab countries, who had been in a bitter dispute for decades over the vexed issued of Palestine. Since the last few months, Pompeo and the Trump administration have been encouraging Arab countries to normalise their ties with Israel. 

Earlier, America had mediated to normalise ties between Israel and three Arab countries—the UAE, Bahrain and Sudan. The recent meeting between Netanyahu and his Saudi counterpart, MBS, is viewed by many as a parting gift of the Trump administration in America’s Middle-East policy before President-elect Joe Biden officially assumes charge. 

Harassment over selling firecrackers: Haryana Police beats up people, security men of BJP leaders, protesting suicide of BJP Councillor

A BJP Councillor in Haryana, Harish Sharma, committed suicide recently after he was booked for allegedly selling firecrackers during Diwali and misbehaving police officials. Reportedly, he was under mental duress after a case was registered against him and his daughter Anjali Sharma. His family alleged that the Police was pressing for his arrested.

The atrocious conduct of the Police in the matter, however, was far from an end. A National Disaster Response Force (NDRF) team on Sunday recovered the body of Harish Sharma from Delhi Parallel canal near Khubru jhal in Sonepat district. The body was subsequently sent to a general hospital at Sonepat district for a post-mortem examination.

Hundreds of people gathered at NH-44 on Panipat-Delhi lane and refused to cremate Harish Sharma until their demands were met. A criminal case was demanded against Panipat SP Manisha Chaudhary, then police post in charge; SI Baljeet Singh, ASI Mahavir Singh and others and their arrest was demanded as well. As per reports, Panipat Superintendent of Police, the then police post in-charge and ASI Mahavir Singh have now been booked under Sections 306 (abetment to suicide) and 34 of the IPC.

BJP MP from Rohtak, Dr. Arvind Sharma, former Minister Krishna Lal Pawar and MLA Pramod Vij had reached the spot to hold a meeting with the family members of the deceased and assure them that justice will be done. However, at the same time, the Police started a lathi-charge against those who had gathered.

The glasses of an office near where the BJP leaders were having a discussion with the family of Harish Sharma was also damaged. Not just the people, but the security men of the BJP leaders were also beaten and so were members of the press. Pawar said that his security men and those of the MLA were beaten up in front of him.

The Chief Minister and the Home Minister were subsequently informed of the conduct of the Police and an SIT will be formed to investigate the matter. Karyakartas of the BJP alleged that under the current government, police officials have gone out of control. Neither do they listen to their leaders, nor their government. Numerous people have been injured during the course of the lathi-charge.

Meanwhile, the leaders assured Anjali Sharma that her family will receive justice. She has alleged that police officials are forcing her to leave the city. It is also reported that as per the SIT that has been constituted, the police-in-charge of Tehsil Camp intentionally registered a case against Sharma. Despite being advised against it by Home Minister Anil Vij, he went near the house of the Councillor with a police force.

Anvay Naik suicide case for which Arnab Goswami was arrested: Letters exchanged, the closure report, and unanswered questions

On the 4th of November, the country watched as Republic TV editor-in-chief Arnab Goswami was dragged out of his house by over 20 armed policemen for a 2018 abetment to suicide case which was closed. The arrest was led by encounter specialist Sachin Vaze, who has been reinstated into the police force for 16 years of sabbatical as he was accused in a custodial death case. In between, Sachin Vaze had also joined the Shiv Sena before he was brought back to the police force by Commissioner Parambir Singh, because he needed reinforcements to fight the Coronavirus pandemic.

As Arnab Goswami was dragged out of his home for a closed abetment to suicide case, without wearing shoes, he was shoved into a police van and taken to Alibaug police station. Thereafter, he was beaten and tortured, as claimed in his affidavit to the court. He said he was beaten with boots, made to drink a liquid that choked him, not given water to drink and had a 6-inch long gash on his hand.

After his police custody was denied, a few days later, the police stealthily transferred him to Taloja jail. The Supreme Court granted him bail after 9 days of his custody and made some scathing remarks against his illegal detention by the police and also, the high court for not granting him bail earlier.

What was interesting is that Arnab Goswami was suddenly arrested in a 2018 abetment to suicide case which was closed and re-opened only recently, unilaterally, without the consent of the court. This observation was made even by the magistrate while granting his judicial custody.

The case that the Maharashtra government has chosen as a hill to die on, is an abetment to suicide case from 2018 in which a closure report was filed by the very police that arrested Arnab Goswami for it. OpIndia has accessed the entire communication between ARG Outlier Media Asianet News Pvt Ltd (ARG), CDPL (the company of Anvay Naik, who committed suicide) and that of the wife and daughter of Naik, who are now spearheading this case, claiming that Arnab Goswami abetted the suicide of Anvay Naik and his mother, who were directors in CDPL.

The suicide of Anvay Naik and the alleged suicide of his mother Kumud Naik

On the 5th of May 2018, architect Anvay Nail and his mother, Kumud Naik were found dead in their farmhouse in Kavir village in Alibaug in Maharashtra’s Raigad district. At the time, a suicide note was found from their house where the two were found dead.

In the suicide note that was recovered, three people were named.

  1. Arnab Goswami who, according to Naik and his mother, owed the Company Concorde Designs Pvt Ltd (of which he and his mother were the directors) – Rs. 83 lakhs due
  2. Feroz Sheikh – Rs. 4 crores due
  3. Nitesh Sarda – Rs. 55 lakhs due

The interesting aspect of this suicide letter that was found was that it was signed only by Anvay Naik. His mother who was also found dead had not signed the suicide note or left behind an alternate suicide note for herself. The FIR in the case was filed on the very same day, mentioning the three people were named in the suicide case, including Arnab Goswami.

Immediately after that, police had visited the offices of Arnab Goswami to question him in the case and he was subsequently asked to submit his and his companies financial records. On the 8th of May, all financial details including visitor log of the Republic office, phone records and financial papers were submitted to the Alibaug police by CFO S Sundaram and chief executive officer Vikas Khanchandani.

According to a Times of India report from 6th August 2018, Anvay Naik had first killed his mother and then, proceeded to commit suicide.

It was quite clear that Kumud Naik was murdered, as there was a murder case that had also been registered at the time. However, it was only circumstantial evidence that led the police to believe that it was Anvay Naik who had himself murdered his mother before committing suicide. The only evidence cited in news reports is that there was nobody else present at the farmhouse.

By the 16th of April 2019, Alibaug police submitted an ‘A’ Summary Report to the court, saying that they had found no evidence in the case against Arnab Goswami and the others, and therefore, the case was considered closed.

From the letters accessed by OpIndia, it is evident that several meetings to resolve the issue of payment between ARG Pvt Ltd and the Akshata Naik and Adya Naik (the wife and daughter of Anvay Naik). Further, it was also discussed as to how, legally, ARG can make a payment to CDPL’s vendors directly, as was also demanded earlier. However, the issue remained unresolved. From a perusal of the letters though it becomes rather evident that the case is not as cut and dry as vested interests would have one believe. There are several misrepresentations that are now in the play that get discredited after a perusal of the letters.

Letter 1: 12th April 2019

On the 12th of April 2019, a letter was written by ARG to Concorde Designs Pvt Ltd, also marked to Akshata Naik (wife of Anvay Naik), Adnya Naik (daughter of Anvay Naik) and the Investigating Officer, Mr DS Patil. From the letter, it is evident that multiple meetings had already been held between the Naiks, CDPL’s sub-contractors and ARG to discuss dues for work done in terms of work orders issued by ARG to CDPL.

In the letter, ARG informed the Naiks that a substantial amount of the pending work had to be undertaken independently by contractors appointed by ARG itself. The letter says that after settling the amount for the work left incomplete, the amount that was due to CDPL according to ARG was Rs. 39,01,721. ARG says that the amount can be paid to CDPL and further, the letter mentions the bank account in which previous payments were made to CDPL.

Interestingly, the letter also mentions that CDPL’s sub-contractors have not been paid by CDPL and thus, they had approached ARG separately on a couple of occasions asking for payment of dues directly to them.

The letter, therefore, made the following requests:

  1. Confirm the names of CDPL’s authorised personnel
  2. Confirm if payments may be made by ARG directly to the sub-contractors on CDPL’s behalf as a part of settlement of CDPL’s outstanding amount.

The closure report filed in April 2019 – Accepted by the Chief Judicial Magistrate L G Pachchhe on April 16, 2019

It is pertinent to note that the A Summary Report, in this case, was filed in April 2019. The closure report accessed by OpIndia shows that officers investigating the Anvay Naik suicide case had found no links between Republic TV Editor Arnab Goswami, Nitesh Sarda and Feroz Shaikh. They found no evidence that could establish that the trio made life ‘unbearable’ for Naik or led to the abetment of suicide. As such, the Raigad police investigating the case had filed an ‘A summary’ in its closure report before the magistrate in April 2019. It is important to mention that an ‘A summary’ is filed in the absence of adequate evidence against the accused, thereby preventing the cops from submitting a charge sheet.

“The three accused who have been named work in different fields, locations and no link between the three has been established in the investigation…No evidence has been found so far in the investigation that the action on the part of the three accused named in the suicide note until now, individually or together, made it unbearable for the deceased to continue living or had no option but to commit suicide. Hence, in the absence of evidence in this case, ‘A final’ summary should be accepted,” the closure report emphasised.

It further noted, “Investigation has revealed that since the past six to seven years (prior to 2018), Concorde (Anvay Naik’s company) has been facing financial losses, due to which Anvay Naik and his mother were under mental stress. Since his mother was a partner in the company, he throttled her to death, wrote a suicide note and then hung himself.” 

The closure report reiterated that Concorde Designs Private Limited had left the work incomplete of several clients, including that of the ones named by Anvay Naik in the suicide note. “The accused then carried out the work among themselves and paid the vendors, as per the documents submitted before the police,” the report clarified. The closure report, submitted by the Raigad Police was accepted by the Chief Judicial Magistrate L G Pachchhe on April 16, 2019.

In fact, Indian Express exclusively accessed the annual statutory returns filed by Concorde with the Registrar of Companies. As per the details, the company had a debt of ₹26.5 crores in the fiscal year 2016. Interestingly, the company soon became inactive and also stopped filing its annual returns since that year.

Letter 2: 11th June 2019

On the 11th of June, another letter was sent from ARG to Mrs Akshata Naik and Ms Adnya Naik. The letter was also sent to CDPL, which was the company of Anvay Naik. The letter was not only sent by speed post and courier but was also sent on WhatsApp to Mrs Akshata Naik.

In the letter, the letter was again in reference to the ‘several meetings’ that were held between Akshata Naik, Adnya Naik, the sub-contractors who wanted to be paid directly by ARG and the representatives of ARG. ARG says that they had asked for an indemnity letter so they could pay the sub-contractors directly, however, there was no response from the Naiks or from the representatives of CDPL.

It is important to note here that Akshata and Adnya Naik were meeting ARG as the ‘heirs’ of Anvay Naik and had no stakes in CDPL.

In the letter, ARG also reveals in the letter that CDPL had not paid the dues to its sub-contractors for the work done at the Republic studio and the sub-contractors were now demanding that they be paid directly by ARG. It was for this that ARG wanted an indemnity letter from CDPL waiving future claims so the money due can be used to settle the bill of the sub-contractors of CDPL who were not paid.

To this, ARG says that neither CDPL nor the ‘heirs’ (Akshata and Adnya Naik’) have responded to the request by ARG to furnish a legally acceptable indemnity.

In this letter, ARG then says that since neither CDPL nor the Naiks are responding to the request by ARG to issue a legally acceptable indemnity, they are left with no choice but to transfer the fund directly to the account of CDPL (State Bank of India), in which the rest of the payment was made. ARG, at the end of the letter, gives CDPL 10 days to furnish an indemnity from either the creditors, lenders, directors of shareholders, or the amount (less TDS) would be credited to the CDPL bank account.

It is to be remembered that the amount that ARG said it was liable to pay was Rs 39,01,721 after deducting for the work not done. Notably, ARG had already paid CDPL over Rs 5.20 crores.

The interesting question that arises here is that if Rs 5.20 crores was already paid to CDPL, why had CDPL not cleared the dues of its vendors and at this juncture, why was CDPL (Directors, shareholders, creditors etc) not issuing an indemnity. If the Naiks too wanted ARG to clear the outstanding amount of the vendors, which CDPL had failed to do despite being paid over Rs 5 crores, it would stand to reason that they would be happy to take the opportunity to furnish an indemnity and clear the dues. However, this was not done and neither the heirs nor anyone from CDPL responded to ARG.

Letter 3, dated 15th June 2019: The angry letter from Mrs Akshata Naik to ARG

On the 15th of June, Akshata Naik sent a long, angry letter to ARG Outlier Media Private Limited. The assertions made by her are following:

  1. Akshata Naik claims that in her contract with ARG (amounting to Rs. 6.45 crores), there was a retention rate of 5% for defect liability for a year. She claims that the period of 1 year ended in April 2018 and hence, ARG cannot withhold or deduct any amount for defects/incomplete work. She, therefore, says that the amount payable to the company is Rs 88 lacs and not Rs 39.01 lacs, as calculated by ARG.
  2. She then says that ARG wants to pay the Company (CDPL) and not the heirs directly (Naiks) knowing ‘fully well’ that “the account cannot be operated as both directors of the Company have committed suicide abetted by Arnab Goswami and for which FIR is registered against him at Alibaug Police Station”.
  3. She further accuses Arnab Goswami of deliberately asking for indemnity from CDPL, knowing fully well that there is nobody to grant such an indemnity since the directors of the company are dead.
  4. She accuses Arnab Goswami of ‘always having the intention to cheap and defraud CDPL’.
  5. She writes, “As you were made aware of the hardships suffered by me and my daughter in coming out of the grief and trauma, you denied making any payments till we came to you after we were pressurised by our contractors who had to make payment to their labourers for the work done. As this was communicated to you and after you realised that labour payment had to be made and you could not wash your hands of it under any labour laws, you may have realised that there was no running away and therefore, you have intentionally made out this letter in an abrupt attempt to wipe your hands clean out of it”.
  6. She also threatens, saying, “any such unilateral action by you as mentioned in your letter will be drawing flax to further prosecution of Mr Arnav Goswami in person and you in your representative capacity for offences delineating of criminal breach of trust and cheating to CDPL”.

It becomes extremely important to cut through the emotional outburst of Mrs Naik here and examine the law. Firstly, Concorde Designs was a private limited company. A limited company is a going concern and does not abruptly come to an end at the time of the death of its directors. Akshata Naik here has repeatedly asserted that CDPL cannot receive payments in the company account and also cannot issue a letter of indemnity to ARG, so payments can be made directly to the sub-contractors. However, that is not true.

Firstly, this is an unusual case where both the directors die at the same time, especially, the mother and the son. If one director had died, for example, the mother, the shareholding of the mother would go to his legal heir, the son, and then a second director would be appointed after an AGM was called.

However, since both have passed away there are two ways to deal with this legally.

First – The legal heirs, Akshata and Adnya Naik, in this case, would need to write to the company, with proof that they are indeed the legal heirs of Anvay Naik. Per that letter, the company would transfer the shares held by Anvay Naik and the mother to the two legal heirs. Once the share transfer process would be done by the company, they would have to call an Extraordinary General Meeting (EGM) and appoint two new directors. Once the directors are appointed, they could approach the bank to revive the bank account and accept the dues in that account.

Second – If the debts of the company were too high and Akshaya and Adnya did not want to take responsibility of that, they could simply sit tight till the creditors of the company approach the court for their dues. Under those circumstances, the legal heirs could have simply said that they have nothing to do with the company and have no stakes in it. If the company itself did not have the assets to clear dues, the court, for example, could ask the ROC to open an account, take money from the people who owed the company money, like Arnab Goswami and others, and then settle the dues of the sub-contractors.

Under no circumstances can Adnya Naik and Akshata Naik demand that the money be paid to them personally (and not the company) even as legal heirs. If they had chosen the first route, the money would have been settled a long time ago. Had they chosen the second route, they would have got rid of not only the debt of the company, but they would have to forego the assets of the company too (the money owed to it by Arnab Goswami and others).

Akshaya Naik, however, chose to not take either of the legal routes. What she did was demand money either in her personal account or for ARG to pay to the sub-contractors directly, both of which is legally untenable. Essentially, the Naiks are demanding that they bear no responsibility of the debt of the company by becoming the directors and shareholders of the company, however, want to be entitled to the assets in their personal accounts. This is a legally untenable position.

As for her claiming that Arnab Goswami abetted the suicide of Anvay Naik – in an abetment to suicide case, the police would have to show that Arnab Goswami actively assisted and drove Anvay Naik to commit suicide by the way of a conspiracy. There was no proof found of that and a closure report was filed later – which would be discussed later in this article.

Letter 4, dated 6th November 2019: ARG rebuts the claims by Akshata Naik

The last letter that was sent by ARG to Akshata Naik and Adnya Naik on the 6th of November 2019. In a 4 page letter, all the points that were raised by the Naiks were responded to, point by point, raised in Akshata Naik’s letter dated 15th June.

The letter said that ARG Outlier Media Asianet Private Limited (ARG) placed work orders fated 10/12/2016, 8/03/2017 and 26/05/2017 with CDPL. The contract was between ARG and CDPL and therefore, no third party can demand payment for those work orders and ARG cannot pay any other party other than CDPL. It further revealed that after the death of Anvay Naik and Kumud Naik, no process has been initiated to appoint new directors. Despite several requests, both Naiks have shown no interest to become shareholders and/or directors of the company. The letter says, “the present impasse can only be resolved with the appointment of directors in CDPL, which is clearly not a factor within ARG’s control”.

At this point of the letter, ARG informs the Naiks that their defamatory statements about Arnab Goswami abetting the suicide of Anvay Naik are uncalled for. Firstly, there were three people who were accused and not Goswami alone. Secondly, they inform the Naiks that the police has already filed a closure report since no offence was made out.

The letter then says that ARG says that Akshata Naik’s claim of ‘defect liability period’ is incorrect and the contract makes no mention of it. It further says that she is unaware of the correspondence between ARG and CDPL about the defected work since she was not involved in the process at all and that the allegation that they have reduced the amount from Rs 88 lac to Rs 39 lac ‘unilaterally’ is false since the computation and the amount was communicated to the Naiks in a previous meeting and no objection was raised for the computation.

Saying that prior to the death of Anvay Naik and Kumud Naik, no meeting had taken place between ARG and Akshata/Adnya Naik ARG says that they can ONLY make payment to CDPL and no third party and that their account is inoperative is not in ARG’s control and under the circumstances, they had no choice but to pay to the CDPL account that they were aware of. The payment was remitted by ARG to CDPL in 4 tranches on the 30th of July 2019, but the amount was returned. In her letter, Akshata Naik had claimed that the sub-contractors of CDPL were planning to take legal action against ARG and it was because of that ARG had agreed to meet the Naiks. However, ARG says that this assertion is false. The sub-contractors had, in fact, told ARG about Akshata and Adnya Naik’s unwillingness to resolve this issue by becoming the shareholders/directors of CDPL. “ARG had made payments amounting to Rs 5,21,54,383 to CDPL in the past”, the letter says, asserting that their allegation that ARG wanted to ‘cheat’ CDPL is completely baseless.

Abetment to suicide case and Arnab Goswami: Important question that arises from the exchange of letters between ARG and CDPL:

1. From all the facts that have come to the fore, the first and foremost thing which is clear is that an FIR was filed on the very same day that the bodies of Anvay Naik and his mother Kumud Naik were discovered. Why did Adnya Naik then claim that the police had refused to file an FIR in the case and supposedly got ‘scared’ after they heard the name of Arnab Goswami? In fact, on the next day itself, the police visited Republic TV to inform of the case and on the 8th, only a couple of days later, ARG executives submitted details to the police.

This claim was not only made by Adnya Naik in her interview to Caravan Magazine but also by Akshata Naik on several occasions in several of her videos. This claim is false.

2. In the entire interview with Caravan Magazine, Adnya Naik speaks about Arnab Goswami. She claims that Arnab had threatened Anvay Naik and said that no matter what Anvay did, he would not get the money. Further, she says that the amount payable was actually much higher than Rs. 83 lacs. She claimed that her father kept crying after being threatened by Arnab Goswami and reduced the amount payable to Rs 83 lacs.

She says in the interview, “The amount was much higher than Rs 83 lakh [the amount that Goswami owed Naik, according to the suicide note]. My father cried and kept cutting it down and finally made it Rs 83 lakhs. If someone takes Rs 25,000 from you and does not return it, you will say that if not Rs 25,000, at least return Rs 15,000”.

The fact, however, don’t add up.

This interview was given to the Caravan Magazine by Adnya Naik on the 5th of November 2020. Over a year prior, her mother, Akshata Naik had written an extremely angry letter to ARG (we have detailed the letter above). In that letter, Akshata herself never once mentioned that Anvay was threatened by Arnab Goswami or even that the amount was much higher than Rs 83 lacs. In fact, this entire claim of Arnab Goswami not wanting to pay Anvay Naik does not add up since ARG had already paid over Rs 5.20 crores to CDPL for the work done.

Adnya says that the amount was reduced from 1.2 crores to 83 lacs, however, this fact is not mentioned by her own mother in the letter she wrote.

3. Adnya claims in her interview with Caravan Magazine that “After April 2017, for more than one year, we kept demanding the money and he still did not pay”.

This claim is patently false, and that is proven by the letter Akshata Naik sent to ARG. In the letter she sent, she had given a break up of the amount she thought CDPL was owed (The amount is disputed by ARG, however, it is sufficient to refute the claims by Adnya).

This is the break-up of the amount payable that Akshata Naik had added in her letter to ARG. In this letter itself, according to Naik herself, Rs. 4.33 crores were already paid till 15th August 2017. Thereafter too, payments were made till the 31st of October 2017.

So while over Rs 5 crores were paid by ARG to CDPL till October 2017, Anvay Naik and his mother committed suicide in May 2018 over a relatively smaller amount of due compared to the amount already paid. It is not clear why Adnya Naik would lie in her interview.

4. Adnya Naik in her interview with the Caravan Magazine claimed that they did not know that a closure report had been filed in the case till May 2020.

This claim was also made by Akshata Naik, repeatedly. Even in several of her YouTube videos.

However, this claim too does not add up. As explained above, in a letter dated 6th November 2019, ARG had mentioned that according to their information, a closure report was filed in the case. Now, one can only assume that the police must have informed the Naiks as well. However, even if we assume they had not, the Naiks certainly knew about the closure reported at least by November 2019.

5. Legally, ARG cannot pay the amount personally to Akshata Naik or Adnya Naik since the contract was with CDPL. There was a relatively easy fix to this situation – Akshata Naik and Adnya Naik could have become the shareholders and/or Directors of CDPL and the dues could have been easily cleared. Why were both of them unwilling to become the shareholders/directors of the company.

6. According to Indian Express, the company had a debt of ₹26.5 crores in the fiscal year 2016. According to the closure report, the company CDPL had been in financial doldrums for the past 7-8 years. In such a scenario, is Akshata Naik refusing to become the shareholder/director of the company because she wants to accept the assets of the firm but not the debt? Since she insists she wants the amount paid to her personally?

These are some pertinent questions that must be answered in this case. There are two scenarios that could have played out had ARG agreed to the demands of Akshata Naik and Adnya Naik:

  1. Had ARG paid the amount to the Naiks in their personal account, since CDPL is still an active company it could have come back to claim the same amount from ARG yet again since there is no legal provision under which the amount can be paid to the Naiks personally from the company ARG when the contract was with CDPL
  2. In another scenario, if ARG had paid the sub-contractors of CDPL without indemnity from the representatives of CDPL, Akshata Naik and Adnya Naik could have then become the shareholders/directors of the company and demanded that ARG now paid CDPL since CDPL did not authorise them to pay the sub-contractors on their behalf.

Either way, both demands of the Naiks were beyond the realm of legality.

How Arnab Goswami was arrested in the abetment to suicide case and how it all started

After all of this, on the 26th of May, Anil Deshmukh, the Home Minister of Maharashtra had ordered that the case would be re-opened and CID would investigate the case.

Interestingly, the re-opening of the case came only a few days after Congress had brought up the issue again after they started targeted Republic TV over their coverage of Palghar case.

On the 7th of May, after Congress had picked up the issue, Akshata Naik had released another video where she claimed debunked details like an FIR was not filed, that she did not know about the closure report etc.

Months later, on the 4th of November, Arnab Goswami was dragged, assaulted and arrested in this case after a closure report was filed by the same police. The team was led by encounter specialise Sachin Vaze.

The magistrate, while granting judicial custody of Arnab Goswami and denying the police custody as sought by the police, made the following 9 observations:

  1. “A” Summary report remains in the abetment to suicide case against Arnab Goswami
  2. Police started probe without court permission
  3. The arrest of Arnab Goswami in the closed abetment to suicide case is illegal
  4. Even if it is accepted that Anvay Naik was being pressurised by his creditors to repay the debts, why did his mother Kumudini Naik commit suicide? Then the CJM went on to ask, “did she even commit suicide?”.
  5. The link between deaths and the accused not established
  6. No evidence that the previous investigation was incomplete
  7. No evidence against accused
  8. Evidence collected only from the complainant
  9. The police have failed to mention the alleged role of the accused in the suicide

The Supreme Court too, while granting bail to Arnab Goswami in the closed abetment to suicide case after 9 days of custody made some scathing observations.

In all, the abetment to suicide case against Arnab Goswami is certainly not as cut and dry as is being made out by detractors to score political points and the conduct of the police that arrested Arnab and the government that reopened the case unilaterally certainly not above reproach.

Uttar Pradesh: Two Sadhus die after consuming tea at an ashram in Mathura, one admitted to hospital

Two Sadhus passed away while a third was admitted to a hospital in Mathura in Uttar Pradesh after they consumed tea at Giriraj Vatika ashram located in the Govardhan area of Mathura on Saturday.

Confirming the news, Mathura SSP Gaurav Grover said that in an incident that took place at about 10 am, one Sadhu named Gulab Singh (60) died on the spot, while the other named Shyam Sundar Das (61) was declared brought dead by doctors at the district hospital. The third sadhu, identified as Rambabu Das, is undergoing treatment at the district hospital, he said.

Deceased Gulab Singh hailed from Dalauta village under the Kosi Kalan police station, while Shyam Sundar and Rambabu are residents of Paintha village under the Goverdhan police station.

SSP Gaurav Grover said that though prima facie, it appears that they were poisoned, an investigation into the case has been launched to determine the cause of their deaths and an FIR under section 302 (murder) of the Indian Penal Code (IPC) has been registered against an unidentified person after Das’ family approached the police. A forensic team is also collecting evidence at the ashram where the two sadhus died after consuming tea, he said. 

Meanwhile, the deceased Sadhu’s kin has alleged that the sadhus were poisoned inside the ashram.

Post mortem report of Uttar Pradesh Sadhus mentions cause of death “uncertain”

The autopsy report of the two deceased Sadhus mentions the cause of death as “uncertain”. However, the final deduction will only be made on the basis of the viscera report, said the SSP.

The third Sadhu, who is currently undergoing treatment at the district hospital has reportedly told the police that the three men made themselves tea in the morning and started feeling sick shortly after drinking it. The sadhu stated that the tea had been prepared in utensils cleaned by him.

Deputy Superintendant of Police (DSP) Mathura Ravikant informed that the Sadhus had been living at the Goverdhan ashram for 25 years and prayed at the ashram every day after having their morning tea. On Sunday too, the three sadhus made tea and within 30 minutes of drinking the tea, they started experiencing stomach aches and vomiting. 

Meanwhile, Shri Krishna Janma Bhumi Suraksha Nyas Committee President Acharya Dev Murari called the deaths of the two sadhus a ‘heinous murder’ and demanded a CBI inquiry.

The Quad Tech Network, deteriorating trade relationship and war of words: Australia-China ties on a downhill track since pandemic began

The Coronavirus pandemic has had profound implications for international relations as well as the global economy, apart from causing an irreparable loss of human life. China has adopted an aggressive stance with numerous countries pointing fingers at it for its dubious handling of the crisis in its initial days. Simultaneously, a cry to hold China accountable for its actions has been steadily gaining momentum over the course of the year.

One relationship that has undergone a profound transformation since the beginning of the pandemic is that between China and Australia. China is Australia’s biggest trading partner and relations between the two were, compared to current circumstances, quite cordial. But things appear to have taken a decisively downward turn since April.

In April, Australian Prime Minister Scott Morrison threw his weight behind an independent inquiry into the origins of the Coronavirus that was first detected in China. He again reiterated the necessity of such a probe before the UN General Assembly in September. Apart from that, Australia has also condemned the manner in which Hong Kong is being dealt with and voiced its concerns for the treatment of Uyghurs in Xinjiang.

Australian Trade Minister speaks up

China, as has been the norm, does not take criticism very well and it did not on this occasion as well. In his most recent interview, only a day ago, the Australian Trade Minister demanded to know why the country was singled out for trade restrictions. Simon Birmingham on Sunday also accused China of engaging in a number of actions that are conducive to a healthy relationship.

Birmingham told sky News that he did not believe “that a number of the actions from China’s embassy in Australia have been particularly helpful this year”. His comments were prompted by a Chinese official who said on Friday that “the problem is all caused by the Australian side” and they should stop treating China as a strategic threat if it wanted a resumption of ministerial level talks.

Birmingham also cited the comments made by the Chinese ambassador in April in response to Australia calling for an independent probe into the origins of the Coronavirus. He said that the latter’s comments “essentially were threats of coercion”, while the list of “claimed grievances” constituted the “types of things that … any country rightly does in terms of providing for rules around foreign investment to make sure it’s in the national interest, rules to protect critical infrastructure and security provisions in nations”.

He also said that the Australian government was “so deeply concerned at the fact that the number of regulatory interventions China has taken this year that seem to have disrupted the flow of trade do then undermine that economic cooperation”. But instead of only complaining, Australia has taken certain actions as well.

The Quad Tech Network

On Monday, the 23rd of November, it was reported that Australia has decided to spend $500,000 to set up a tech network among the ‘Quad’ democracies, that is, India, Australia, Japan and the United States of America. The Australian National University will be provided with $497,000 to set up a “Quad Tech Network”.

A notification on the government’s grant website stated, “DFAT’s Cyber Affairs and Critical Technology Branch is seeking to establish a Quad Tech Network (QTN), to support and complement the development of Australia’s first Cyber and Critical Technology International Engagement Strategy (CCTIES).”

Significantly, it states, “QTN will support research and promote engagement with academic and think tank partners on cyber and critical technology issues that reflect Australia’s interests as a liberal democracy committed to the international rules-based order.” “The QTN is intended to produce policy-relevant research and recommendations relevant to Australia’s national interests across the breadth of cyber affairs and critical technology issues; deepen and strengthen public understanding of these issues; and promote informed public dialogue,” it stated.

The Downward Spiral

China has taken a series of actions against Australian industries. Barley, beef, coal, and cotton to lobster, timber, and wine among others have been targeted by anti-subsidy and anti-dumping measures by China or had their deliveries delayed. China claimed that it was due to quality issues but it is widely recognised that it was in retaliation to the political positions taken by Australia in recent times.

In response, Australia has barred Chinese traders from purchasing at least 6 six different categories of Australian products. It was also the first country to ban Huawei from developing a 5G network. It also joined the other three members of the Quad in Naval exercises in the Bay of Bengal in the Malabar region.

Meanwhile, ever since Australia made the call for a probe into the virus origins, China has made consistent efforts to up the pressure on the country. “(They) have subsequently taken a series of wrong moves related to China, which is at the root cause of China-Australia relations taking a sharp downturn and stuck in the current difficult situation … the responsibility for causing this situation doesn’t lie with China at all,” Chinese Foreign Ministry spokesman Zhao Lijian said.

“These practices have grossly interfered in China’s internal affairs and seriously hurt the feelings of the Chinese people,” he added , commenting on Australia raking up China’s human rights abuses. Things reached their zenith, however, when Chang Lei, an Australian citizen and high-profile host for China’s English-language broadcaster CGTN was detained on suspicion of endangering national security. Consequently, two Australian journalists had to be evacuated from China on the advice of diplomats after they were questioned aggressively by authorities.

The future of the Australia-China relationship

Australia has also asked traders to loom for alternative exporting destinations apart from China. Despite all of this, China remains Australia’s top trading partner. Even so, experts on the matter remain cautious about the unfolding scenario. James Laurenceson, director and professor at the Australia-China Relations Institute (UTS), University of Technology Sydney, said, “The Australia-China relationship is unravelling at a pace that could not have been contemplated just six months ago.”

Michael Shoebridge, a national security expert at the Australian Strategic Policy Institute, said Australia’s approach towards Beijing shifted as Xi “aggressively used Chinese strategic, military, cyber, technological and economic power against Australia’s and others’ interests, not just internationally, but also inside our own nations.” Earlier, it focused “wholly on the mutual advantage of economic engagement”.

Not everyone is happy, however, with how Australia has responded to China, choosing to confront rather than placate. Bob Carr, Australia’s former minister for foreign affairs, is one of them. He believes that his country has become more hawkish than most and would end up paying the price for it while the allies benefit at their expense.

“We inflicted self harm to impress Washington, but under its phase one trade agreement with China, it’s US farmers, wine makers and fishers who will fill the gaps in the supermarket shelves vacated by Australian produce,” he said said, adding that Australia will look “even more foolish if (President-elect) Biden opens up partnerships with China on climate and pandemic management even as he maintains pressure” on other issues such as the South China Sea, Hong Kong, and cyber security.

Tamil Nadu: Hindu Mahasabha leader brutally murdered outside his house, was denied police protection

On Sunday, the State Secretary of Hindu Mahasabha in Tamil Nadu, Nagaraj, was found murdered near his house in Anumandha Nagar in Hosur.

As per reports, he was hacked to death by an unidentified gang at 8 o’clock in the morning near his residence, after they had convinced him to step out of his house. Other reports suggested that Nagaraj was out on a walk when the miscreants stopped their car in front of him and began assaulting him. When the victim tried to flee, the accused chased him down and murdered him in full public view. They then managed to flee the crime spot. He sustained cut injuries to his head and abdomen and died on the spot.

Hindu Mahasabha leader had sought police protection

On being informed about the incident, the Krishnagiri police rushed to the spot and initiated a probe in the case. Nagaraj’s body was sent to Krishnagiri Government hospital for post-mortem. Reportedly, sensing threats to his life, Nagaraj had sought for police protection a few months prior to his murder. However, the police had then refused to provide him with protection. He is now survived by his wife, son and 3 daughters.

Police claims personal enmity behind murder

While speaking about the murder, Superintendent of Police (SP) Bandi Gangadhar claimed that preliminary reports suggested personal enmity behind the gruesome incident. He added that 6 teams have been constituted to apprehend the killers of Nagaraj. A police officer conceded, “We suspect Nagaraj had a rivalry in his real estate and money-lending business.” Ruling out communal or political angle, the police stated that a gang of 3-5 people is suspected to have committed the crime.

Dalit BJP leader was murdered in Krishnagiri in September

In September, a Dalit BJP leader named Ranganathan was brutally hacked to death outside his home in Kelamangalam, Krishnagiri while he was celebrating his son’s birthday. Ranganathan had joined BJP after quitting AIADMK and was appointed as the BJP Youth wing president of Kundumaaranappalli village.
