Mumbai: Court orders FIR against former SEBI Chairperson Madhabi Buch. Here is what we know so far

0

A Mumbai special court has ordered the launching of an FIR against former SEBI Chairperson Madhabi Puri Buch and five others over alleged financial fraud, regulatory violations, and corruption, a court order showed.

An application was filed before the Special ACB Court in Mumbai by the complainant- Sapan Shrivastava, a Thane-based legal news reporter- seeking directions to the concerned police station for the registration of an FIR and investigation into alleged offenses committed by the accused, which includes Buch.

The complainant alleged a large-scale financial fraud, regulatory violations, and corruption. The allegations pertain to an alleged fraudulent listing of a company on the stock exchange.

It was alleged that the fraudulent activity was done with the active connivance of regulatory authorities. The complainant contended that SEBI officials failed in their statutory duty.

They facilitated market manipulation and enabled corporate fraud by allowing the listing of a company that did not meet the prescribed norms.

The complainant submitted before the Court that despite the complainant having approached the concerned police station and regulatory bodies on multiple occasions, no action was taken, necessitating judicial intervention.

The Court, while ordering for the launch of FIR, noted that the complainant has placed on record substantial material to support the allegations, including written complaints lodged with SEBI, the police, and other authorities, with their acknowledgments; documents revealing procedural lapses and noncompliance in the IPO process, leading to an irregular listing of the company; regulatory filings and stock market reports indicating artificial inflation of share prices and market manipulation; correspondence from whistleblowers within SEBI, indicating undue favoritism towards the accused company; among others.

The complainant specifically alleged that the SEBI permitted the listing of the accused company despite its alleged failure to comply with essential regulatory norms, including disclosure requirements and due diligence procedures mandated under the rules.

Also, the complainant alleged that the accused persons engaged in round-tripping, insider trading, and price manipulation and misled investors into believing the company was financially sound.

Upon reviewing the material on record, the Court noted that the allegations disclose a cognizable offense and, hence, necessitate an investigation.

“There is prima facie evidence of regulatory lapses and collusion, requiring a fair and impartial probe. The inaction by law enforcement and SEBI necessitates judicial intervention under Section 156(3) CrPC,” the court document read.

In that context, the court has directed the Anti Corruption Bureau, Worli, Mumbai Region, Mumbai, to register an FIR under the relevant provisions of the IPC, Prevention of Corruption Act, SEBI Act, and other applicable laws.

The Court would monitor the investigation. The Court also ordered that a status report be submitted within 30 days.

Mahakumbh 2025 emerged as a historic event with its divine, grand, and well-organized execution, witnessing an unprecedented gathering of over 66 crore devotees. Held on the banks of Sangam in Prayagraj, this Mahakumbh marked a sacred occasion after 144 years, drawing immense crowds from across India and the world.

Amidst the sea of devotees, many got separated from their loved ones. However, thanks to the foresight of the Yogi government and its dedicated efforts, 54,357 separated individuals were successfully reunited with their families, a release said.

A significant number were women. The police also played a vital role in reuniting devotees from different states of India and Nepal with their families.

The Yogi government implemented several exemplary initiatives to ensure the safety and seamless organization of this divine event. A key highlight was the establishment of the Digital Khoya Paya Kendra, which facilitated the swift reunion of more than 35,000 separated devotees and their families.

During the Amrit Snan Parv on Makar Sankranti (January 13-15), 598 individuals were reunited, 8,725 people were reconnected during Mauni Amavasya (January 28-30), and 864 devotees were reunited during Basant Panchami (February 2-4). Additionally, 24,896 individuals who got separated during other bathing festivals and on regular days were reunited, bringing the total to 35,083 by the end of Mahakumbh, it added.

On the initiative of Chief Minister Yogi Adityanath, 10 digital Khoya Paya Kendra were set up across the Mahakumbh area. These centers featured state-of-the-art AI-based facial recognition systems, machine learning, and multilingual support.

Non-governmental social organizations also played a commendable role, with Bharat Seva Kendra and Hemvati Nandan Bahuguna Smriti Samiti leading the efforts. According to Umesh Chandra Tiwari, Director of Bharat Seva Kendra’s Bhoole Bhatke Camp, the camp successfully reunited 19,274 lost individuals with their families by the end of the event. All 18 children who were reported lost were also safely returned to their families, as per release.

The Khoya Paaya Centers proved particularly effective in reuniting separated individuals with their families and continuously tracking them until they were safely returned.

On the final day of Mahakumbh, Krishna Devi from Muzaffarpur, Bihar, was reunited with her family, as was Jangi Devi from Raipur, Chhattisgarh. Similarly, Jagjannan Dharu from Banke district, Nepal, and Bindi, wife of Sitaram Shah from Saptari, Nepal, safely reconnected with their loved ones, release said.

The successful reunions at these centers prompted heartfelt gratitude from the devotees, who expressed their appreciation to Chief Minister Yogi Adityanath for this thoughtful initiative.

ECI clarifies identical EPIC numbers don’t indicate duplicate or fake voters

0

The Election Commission of India on Sunday clarified that having the same Electors Photo Identity Card (EPIC) number doesn’t mean there are duplicate or fake voters.

The ECI’s clarification comes after concerns were raised on social media and in media reports about electors in different states having identical EPIC numbers.

“Irrespective of the EPIC number, any elector can cast a vote only at their designated polling station in their respective Constituency in their State/UT where they are enrolled in the electoral roll and nowhere else.” ECI clarified in an official statement.

This issue arose because different states and union territories used the same alphanumeric series for EPIC numbers before switching to the ERONET platform.

“The allotment of identical EPIC number/series to some electors from different States/UTs was due to a decentralized and manual mechanism being followed prior to shifting of the electoral roll database of all States/UTs to the ERONET platform. This resulted in certain State/UT CEO offices using the same EPIC alphanumeric series and leaving a scope for the possibility of duplicate EPIC numbers being allotted to electors in different Assembly Constituencies in different States/UTs, the statement read.

The ECI further added that it has been working on the rectification of the duplicate EPIC number.

“The Commission has decided to ensure allotment of unique EPIC number to registered electors. Any case of duplicate EPIC number will be rectified by allotting a unique EPIC number. The ERONET 2.0 platform will be updated to aid and assist in this process.” ECI stated.

‘Congress and elections ultimately took her life’: Mother of Himani Narwal, whose body was found in a suitcase, accuses party of murder

On 1st March, the body of a woman identified as Congress worker Himani Narwal was found in a suitcase in the Sampla police station area of Rohtak District in Haryana. Notably, Narwal had participated in Rahul Gandhi’s Bharat Jodo Yatra. Her mother, Savita, has levelled serious allegations while speaking to the media. She said that someone from the Congress Party could have killed her daughter as there was rivalry that arose from within.

In her statement, Himani’s mother stated that her daughter risked her life for the Congress Party. She had put her education aside and had been working for the party for the past 10 years. “But in the end, it was the party and elections that took her life. Her rivalry, which arose from within, became the cause of her demise,” she said.

When asked if she suspected anyone, she said, “I suspect the people she was always with, those from the party gatherings. Who else could it be?”

She further suggested that her daughter had confided in her that enmity stemmed from within the party itself, as her associates could not “accept how she had progressed at such a young age.” Himani’s mother told the media that she last spoke to her on the night of 27th February after she returned to Delhi from Rohtak.

Himani had told her that there was an event the next day, on 28th February, and she might not be able to attend her calls. She had assured her mother that she would call back once she was home, but there was no contact between them on the 28th. When her mother tried calling her, the phone was switched off.

She added that she had high hopes for her daughter. “If my daughter doesn’t get justice, I will not perform her last rites. I demand justice,” Himani’s mother added.

Speaking about the investigation, she told the media that the police said they were investigating the case. She questioned how a crime like this could happen at a time when local body elections were taking place in the state.

Himani’s mother also accused Congress leaders of not reaching out to her. She said, “Neither has anyone visited our home nor contacted us over the phone.” She told the media that Himani was very close to Asha Hooda, wife of Congress MP Deepinder Hooda.

In another statement, Himani’s mother said that everyone at the party office, including Asha Hooda and MP Hooda himself knew that there was enmity against her within the party. She said, “She was sticking out like a sore thumb for a few people, right after Rahul Gandhi’s padayatra. Some people wondered how she could advance so quickly despite being young. Asha Hooda knew this, Batra Sahab and even Hooda Sahab knew this. Everyone knew this. She used to work till 2 am during elections. They did not come to us even once today. I called up Asha Hooda (wife of Bhupinder Singh Hooda) but she did not receive the call.”

‘No one came to meet us’ – Himani’s brother calls out Congress leaders for not reaching out

Himani’s brother, Jatin, spoke to the media about the incident. He said that the colony where Himani lived had a lot of CCTV cameras. The suitcase in which Himani’s body was found was from their house. He said, “If the administration wanted to catch the culprits, they would have done so by now. I believe the administration is not cooperating.”

He further echoed his mother’s statement that someone from within the Congress Party could have killed her. He said there were people jealous of her as she rose quickly through the ranks within the party.

Jatin also accused Congress leaders of not reaching out to him or his mother. He said, “My mother called Asha Hooda herself, but no one picked up the call. Only two women from the Congress Party came last night. No one else has come forward to meet us or called.”

BJP leader assured truth will come out

Haryana Minister Anik Vij said, “The allegations are serious. The people of Congress have done this before as well. Pushing others back to make progress is an old habit of Congress. The police are investigating this. Whatever truth comes out, it will be taken to its conclusion.”

Congress leaders demanded swift investigation

Speaking to media, Congress leader and former Haryana CM Bhupinder Hooda said, “It is a very painful incident. There is a breakdown of law & order in Haryana. Haryana is number one in the country in terms of crime against women. The incident should be investigated as soon as possible. I am in touch with Police personnel, I also spoke with SP. They are hopeful that they would get some clues by the evening. I told them that this should be investigated and the guilty should be given the strictest punishment. Whoever it is, if they are guilty, they are guilty. Be it someone in the party or outside, they guilty should be given strictest punishment. I had no event on 28th Feb, I had gone to Chandigarh.”

Congress MP Deepender Hooda said, “This has shaken the people of not just Haryana but the entire country. Once more, an example of failure of law & order is coming out of Haryana. We demand that an SIT be formed immediately and there be a high-level investigation. The culprits should be brought to light, and the family of the deceased should get justice. We will fight all possible fights for justice. We will continue to raise our voices until the deceased’s family gets justice. No guilty should be spared.”

Congress leader Pawan Khera said, “All our leaders have demanded from the government that there should be an immediate and impartial investigation so that the truth comes out as to how our Congress worker was brutally murdered. This is a very horrific incident. We hope that the government will take immediate action.”

Congress leader Sandeep Dikshit said, “This should be known better by the Haryana Minister but if there is any political involvement, it should be investigated. We also demand that the case should be investigated properly.”

Police investigating case from many angles

Speaking to media, investigating officer SI Narender says, “FSL team was called once the body was found, and they collected all the needed evidence from the site. The body was identified, and the postmortem will be done. The evidence that we have and the report that will come, we will take further action after corroborating both facts. We have lodged a case of murder based on what we saw prima facie… Family members (of the deceased) have told us that she was a Congress worker and was studying Law. We are looking at the case from many angles, but we will take action as the evidence and reports suggest to us.”

One of the Eyewitnesses, who is a street vendor spoke to ANI and said, “It was around 11 am when I saw the body of a girl in a suitcase. A crowd had gathered here. Police too came here. They brought the body out, it was wrapped in a blanket.”

Another eyewitness told ANI that the dead body was wrapped in a blanket when it was taken out of the suitcase. She said, “I had come from Rajasthan when I saw a crowd here. It must be a 20-22-year-old girl. Her body was wrapped in a blanket and kept in the suitcase. Her ‘chunni’ was lying at the spot.”

Further investigation in the matter is underway.

Israel stops entry of aid into Gaza during Ramazan after Hamas rejected American proposal to extend phase 1 of ceasefire

Israel has stopped the entry of aides into Gaza as phase 1 of the ceasefire has ended. The Israeli PM’s office said that since Hamas didn’t agree to the American proposal to extend the ceasefire along with the release of more hostages, it is not allowing any more goods to enter Gaza during the occasions of Passover and Ramadan. Israel had accepted the US proposal, but Hamas rejected it.

The PMO said, “With the end of Phase 1 of the hostage deal, and in light of Hamas’s refusal to accept the [US special envoy Steve] Witkoff outline for continuing talks – to which Israel agreed – Prime Minister Netanyahu has decided that, as of this morning, all entry of goods and supplies into the Gaza Strip will cease.”

The statement added, “Israel will not allow a ceasefire without the release of our hostages,” and threatened further consequences if Hamas does not agree with it.

Israeli government believes that enough material has entered Gaza, which will last for several months, therefore, the halt in aid will not affect the people.

Notably, earlier Israel had said that it will adopt the proposal by U.S. President Donald Trump’s envoy, Steve Witkoff, for a temporary ceasefire in Gaza for the Ramadan and Passover periods. As per the Witkoff plan, half of the hostages held by Hamas in Gaza, both alive and dead, were to be released. The remaining hostages were to be released after a permanent ceasefire was agreed.

Witkoff made the proposal to extend the phase 1 of the ceasefire after realising more time was needed for talks on a permanent ceasefire.

However, Hamas rejected the proposal, calling it a manipulation. Hamas senior official Mahmoud Mardawi said, “This continued manipulation will not return the hostages to their families.. But on the contrary… it will lead to their continued suffering and endangering their lives.”

The ceasefire agreement began on January 19, during which 33 Israeli hostages and five Thais captured by Hamas during the October 7 attack were released. In exchange, Israel released around 2,000 Palestinian prisoners and detainees.

Talks on the second phase of the ceasefire have been ongoing. While Israel and US wanted the first phase to be extended, Hamas wants to move to the second phase.

This in itself is a blot on the law and order situation of the state.”

He added, “There should be a high-level impartial investigation into this murder, and the government should provide justice to the victim’s family as soon as possible and impose the harshest punishment on the culprits.”

Punjab: Woman accuses Pastor Bajinder Singh of sexual assault, Christian evangelist was previously arrested for rape and murder

A 22-year-old woman has filed a complaint with the Punjab police in Kapurthala, accusing Pastor Bajinder Singh of sexually assaulting her as a teenager.

The police registered a case of sexual harassment, criminal intimidation and stalking against the Christian evangelist on Friday (28th February). The victim had been attending Pastor Bajinder Singh’s congregation since December 2017.

By 2020, she had become a part of his ‘worship team.’ According to the victim, the Christian evangelist began sending her unwanted messages after taking her phone number. She was only 17 years old then.

“I started fearing him and was wary of informing my parents. In 2022, he started making me sit in his cabin on Sundays. When I would be alone, he would forcibly hug me and touch me in a dirty way,” the FIR read.

“He started chasing me in his car when I would go to college and he would threaten me that if I would not marry him or would inform my parents, he would get my parents and brother killed. I started having panic attacks,” the woman informed.

She said that Pastor Bajinder Singh also promised to marry her, despite already being married. The victim suffered panic attacks and had to receive treatment in 3 different hospitals.

She informed the police that Pastor Bajinder Singh threatened her before her marriage to another Christian preacher, Raja Singh, in March 2023. The victim added that he tried to intimidate her into silence by making the President of his Church talk to her mother.

Police permission not required for construction of buildings: Delhi Government issues circular after Amit Shah’s direction

A day after Home Minister Amit Shah gave directions that permission of Delhi Police will not be required in matters related to construction in the national capital, the Delhi Government issued a circular asking the police to sensitise its field officials to remove the misconception that police permission is required for carrying out any building construction.

The circular said that building construction activity is regulated by the MCD and other local bodies in their respective jurisdictions.

It said Section 312 / 313 of the DMC Act (Delhi Municipal Corporation Act), 1957 provides finalising of layout plan, Section 336 of the Act provides for sanction of building plan and Section 346 for occupancy or completion certificate.

The circular said there is no provision under DMC Act, 1957 by which a person is required to seek the permission from police for carrying out the construction.

It said there are, however, certain provisions in the DMC Act related to police giving information to the MCD with respect to an offence or for probe of such offence.

The circular said “there is a misconception” that a person needs to obtain permission from the police for carrying out construction of a building and there is sometimes misuse of the provisions “for the purpose of rent seeking”.

It asked Delhi Police to sensitise its field officials “to prevent the misuse of the provisions” and to remove the misconception that there is any need for permission from the Police for carrying out any construction of buildings.

Police authorities will continue to assist and provide full support to all municipal officers and other municipal employees in the exercise of their lawful authority, the circular said.

Senior Delhi Police officials met at the police headquarters here earlier in the day following yesterday’s meeting on law and order chaired by Amit Shah and discussed follow-up measures, including ways to mount greater vigil against street crime, improve the security of senior citizens and women, and take steps against gangsters.

The sources said that senior officials also discussed ways to prevent the entry of drugs in the national capital.

Measures will be intensified to identify and deport illegal immigrants from Bangladesh as part of drive against those staying illegally in the country, they said, adding that a plan will be prepared to effectively tackle street crime.

The sources said police have been asked not to get involved in matters relating to construction and underground boring in unauthorized colonies.

To check threats received by businessmen, action will be intensified against gangsters operating from abroad, as well as their local accomplices in Delhi.

Sources said that Deputy Commissioners of Police (DCPs) have been told to personally listen to the complaints of people.

The meeting chaired by Amit Shah yesterday was attended by Delhi Chief Minister Rekha Gupta, Home Minister of Delhi government Ashish Sood, Union Home Secretary Govind Mohan and senior officials.

Several measures and suggestions to strengthen safety of women, children and senior citizens and improve law and order in the national capital and controlling crime were discussed in detail in the review meeting held on Friday.

The Home Minister expressed hope that the double-engine government will work with double speed for a developed and safe Delhi, as per the expectations of Prime Minister Narendra Modi.

Amit Shah directed the Delhi Police that strict action should be taken against the entire network that helps Bangladeshi and Rohingya intruders enter the country, get their documents made and facilitate their stay here.

He said that the issue of illegal intruders is also related to national security and it should be dealt with strictly and they should be identified and deported.

Amit Shah emphasized that strict action should be taken against police stations and sub-divisions which fail to perform.

The Home Minister said that there is a need to work with a ‘top to bottom’ and ‘bottom to top’ approach in dealing with narcotics cases and dismantle its entire network. He directed that permission of Delhi Police will not be required in matters related to construction in Delhi. He directed that 25 security committees should be formed, on a pilot basis, in JJ clusters and after seeing their results and efficacy the initiative may then be taken forward.

Amit Shah said that it should be the priority of the Delhi Police to eliminate interstate gangs in Delhi with a ruthless approach. The Home Minister said that DCP-level officers should go to police stations and organize public hearing camps and solve the people’s problems.
